Ciox Health agreed to pay $1.85 million to resolve class action lawsuit claims it charged unfair fees for electronic copies of consumers’ medical records.
The settlement benefits consumers and entities who paid disputed fee amounts in connection with one or more electronic health records requests processed by Ciox Health between Sept. 13, 2015, and July 26, 2022.
The settlement also includes the following two subclasses:
- Subclass A: Individuals who specifically requested their medical records in electronic format
- Subclass B: Individuals who did not specifically request their medical records be delivered in electronic format
Ciox Health is a Datavant Group company that provides medical records services to healthcare providers. The company’s services include clinical data acquisition, clinical coding and records releases.
According to a class action lawsuit, Ciox Health wrongfully overcharges consumers to send their electronic health records.
One plaintiff says she was charged $77.50 to receive her electronic health records from a non-hospital urgent care clinic. Another plaintiff says he was charged $150.58 to receive his electronic medical records from a hospital.
Plaintiffs in the case say these excessive fees violate Texas law, which limits the fees that can be charged when requesting medical records. Under the law, the plaintiffs say, they should have only been charged $25 and $82.95, respectively, for their electronic medical records.
“Prices that exceed the legal maximums in the contracts between Ciox and patients (entered into on behalf of the patients by their attorneys) are illegal and void, as unauthorized charges, and the statutory maximums are deemed incorporated into the contracts in their place,” the Ciox Health medical records fee class action lawsuit contends.
The class action lawsuit also claims Ciox Health charges illegal additional fees including an “Electronic Data Archive Fee” or “Electronic Delivery Fee” of $2, despite these fees being prohibited by Texas state laws.
The plaintiffs seek to recover all fees that are over the threshold allowed by Texas laws.
Ciox Health hasn’t admitted any wrongdoing but agreed to pay $1.85 million to resolve these allegations.
Under the terms of the settlement, class members can receive a cash payment of up to 100% of the total fees they paid. Members of Subclass A can receive 100% reimbursement, while Subclass B members can receive 50% reimbursement.
Payments may be reduced on a pro rata basis based on the number of claims submitted with the settlement.
Class members can update their address on the settlement website.
The deadline for exclusion and objection is Nov. 23, 2022.
The final approval hearing for the Ciox Health class action lawsuit settlement is scheduled for Jan. 27, 2023.
In order to receive settlement benefits, class members must submit a valid claim form by Jan. 27, 2023.

Is this JUST for TX??? I have asked for and paid for multiple records via CIOX and did not receive a notice in the mail.

This company has over charged me 3 times, Everything was put on a disk and given to me yet I was additionally charged for paper copies that I was never given.
2nd time I was charged for X amount of copies when all the hospital gave me was a lot less.
The 3 rd time I got 18 pages from the hospital yet when this company sent me a bill I was charged for 44 pages. Each time I’ve complained they argued with me. The last time I had the envelope with the records in it and counted them while on the phone saying I was tired of being charged for something that I did not receive. However trying to talk to these people it like talking to a brick wall.
I dud not receuve a notice and have paid hige amounts iver the past 8 yrs since EHRs went into place can get invoices
