FanDuel feeds bettors false info, says class action.

Online sports betting company FanDuel has been hit with a class action lawsuit claiming it provided bettors with inaccurate scores and game times, inducing wagers based on false information.

Filed Tuesday in Illinois federal court, lead plaintiff Andrew Melnick seeks to represent more than 6 million consumers across 10 states where online sports betting is legal, including Illinois, New Jersey, Pennsylvania, West Virginia, Indiana, Iowa, Colorado, Tennessee, Virginia, and Michigan.

Melnick, an Illinois resident, claims that he and others were duped into thinking they were placing much more advantageous bets based on the false information provided by FanDuel on its sports betting app that purports to provide “real time” information to bettors.

He says that he made an “over/under” bet in February of this year on FanDuel concerning a men’s NCAA college basketball game. Melnick says that he placed a bet based on the remaining game time information provided on FanDuel; however, he later found out that the game time information provided by the online betting company was off by up to 35 percent from the actual time.

Melnick says that after he discovered the discrepancy in game time information provided by FanDuel’s app, he attempted to get a refund by calling customer service; however, he says his request was denied.

In his class action lawsuit, he contends that the false information is no mistake. Instead, “while purporting to provide its customers with real-time, live sports game data, FanDuel regularly understates the time remaining in a given live sporting event in order to induce its customers to make wagers that they are more likely to lose, and/or that are riskier, than if they were being provided accurate, real-time information in connection with their live wagering,” says Melnick’s lawsuit.

In addition to false info about game times, the class action lawsuit contends that FanDuel provides inaccurate information about the score of the game. Class Members “have made and lost wagers that they would not have made had they known the actual time remaining in the given sporting event or, in the alternative, they would have, instead, wagered on the ‘Over’ and won that wager, rather than losing a wager placed on the ‘Under.’”

The plaintiff, who also points out that he has opted out of FanDuel’s arbitration clause, claims that he, along with hundreds of thousands of other FanDuel customers, have lost millions of dollars by placing bets based on false information provided by the app.

This happened to me over 10 times last two weeks during really huge games or prime time games. I have screenshots of my bets and the live in game info FanDuel is posting, synced by screenshots of other sports app (the score) showing real-time correct info.
. Its happened to me so much during live bets I started screenshotting it to validate my claims to be refunded, but customer service with FanDuel still just ignored me, gave me some page or paragraph to reference in their guidelines or rules book and dismissed my attempt to be refunded. Saying that they use a third party and sometimes the data is lagging or delayed and to always use other apps to be sure of betting info. I bet they aren’t going to make sure the opposite is happening and they lose money.
My argument back to them was that; “I would be ok with losing my bet if only the entire game as a whole was delayed because I would be making bet thru your site on delayed data that is also delayed for them and bet is made with info as the game was at an earlier time . But that’s not the case because only the time off but the score will be correct. Or the score will be inaccurate showing 2-2 in baseball game and bot 10th inning when the score is actually 4-2 but inning is correct. So my bets are made thinking now the home team has huge advantage to win with runner auto posted to 2nd base and no outs when actually they are down by 2 and odds are they will lose.
This happened to me 9/6/21 for Louisville vs ole miss college football game. I bet thinking the app shows 2nd qtr score was 35-14 I believe and Louisville down but driving to score so I bet they would come back and win, and the payout was huge so I made like 5 different bets. But I checked “the score” app to see what their chat room was saying about the game and noticed someone comment that loosville done because it’s too late in game for a comeback being 4th quarter. So I went back to the game info for the score and it was 4th qtr sure enough and all the game info matched for Fanduel but the correct moment the game was in.
Something not adding up. Like I said I have screenshots to validate my claims. I’m tired of people being taken advantage of and losing their money because they have a system in place to steal your money ever so slightly by means of “delayed” info that is completely mot the case

I placed a bet on the WMBA which I have never done. Only reason I placed the bet is because it said there were 7 min left in the first and the score was 75-64 and the over/under was 173.5. Of course I am going to take the over because at the time I thought it was the first half and they were already at 139 with a whole half left. I don’t watch a lot of basketball so I didn’t even know they have quarters. Anyways I thought I had a no-brainer so I put $300 on the over to win like $250+. Well once the time ran out it said it was the end of the game and that I lost the bet and they took my money. I have screen shots to prove what I was looking at and when I contacted Fanduel they pretty much said too bad and that they get their scoring information from a 3rd party and if the third part supplies them with an incorrect score or game time that it has nothing to do with Fanduel and they are not liable. So they have provided false information on their website/app causing me to bet money. I lose the bet because of the false information provided. Fanduel takes my money because I “lost the bet”. When I ask them for a refund of the money I bet and nothing else they say sorry, it has nothing to do with them. Your site said it was the 1st when in reality it was the 4th. How is that not leading your customer the wrong way with false information causing them to bet money when they have no chance of winning. I would have thought this would have been an easy situation to resolve but Fanduel said thanks for contacting us but too bad. Please add my to your lawsuit.
