Dollar General class action lawsuit overview:

  • Who: Plaintiff Alexander Hodorovyh filed a class action lawsuit against Dollar General Corp.
  • Why: Dollar General allegedly sells lidocaine patches that do not adhere for the advertised 12 hours.
  • Where: The Dollar General class action lawsuit was filed in Illinois federal court.

Dollar General Corp. sells lidocaine patches that peel off within a few hours despite promises the pain-relief patch can be used for up to 12 hours, according to a Dollar General class action lawsuit.

Plaintiff Alexander Hodorovych of Chicago says he purchased DG Health brand 4% lidocaine patches from Dollar General and expected them to provide maximum-strength pain relief for up to 12 hours, as indicated on the product label.

Lidocaine patches work as a topical anesthetic, blocking the transmission of pain signals from nerve endings in the skin to the brain, the Dollar General class action explains. The DG Health brand lidocaine patches Hodorvych purchased reportedly state clearly: “Stay-put flexible patch.”

However, Hodorovych alleges the Dollar General lidocaine patches did not adhere as well as advertised, and, in some cases, would peel off within just a few minutes of application.

Dollar General class action says adhesion essential for lidocaine patches to deliver adequate dosing

The Dollar General class action lawsuit notes that the U.S. Food and Drug Administration has received reports indicating that approximately 70% of lidocaine patch complaints are related to poor adhesion.

Adequate adhesion is critical for lidocaine patches to deliver the intended pain relief, Hodorvych says. When the patch lifts or detaches from the skin, the product dose may be compromised.

“The result of the failure to adhere to the user’s bodies is that the [DG Health lidocaine patches] cannot deliver the ‘Maximum Strength’ amount of lidocaine for 12 hours,” the class action lawsuit argues.

The plaintiff filed the class action on behalf of himself and a proposed class of consumers in Illinois and more than a dozen other states who purchased the DG Health lidocaine patches during the relevant statute of limitations.

Dollar General is not the first retailer to face allegations their lidocaine patches do not work as advertised.

Earlier this year, Target Corp. was hit with a class action lawsuit alleging its Up & Up lidocaine pain-relief patches are falsely advertised as providing a maximum strength dose of lidocaine for up to eight hours.

Hodorovych is represented by Spencer Sheehan of Sheehan & Associates PC.

The DG Health lidocaine patch class action lawsuit is Alexander Hodorovych v. Dollar General Corp., Case No. 1:22-cv-03415, in the U.S. District Court for the Northern District of Illinois, Eastern Division.

My statement is a little personal but who cares.. I had to go to a treatment facility for 30 days in S.W Kansas where from maltreatment of sections I had to there go..n
Be though’ I have a rare chronic pain condition that is known as adhesive arachnoiditis unfortunately I was disallowed any Aid in the help of medications or saw it and was limited to what was had ‘aloud’
These patches, i had to pay for and turn in to the office of this center but Only after a local doctor prescribed and allowed me to even have O.C patches, ibuprofen etc etc. but Then, I had to sign and document them signing then me, to be allowed and even use. As to desperately need and did as required to been medically prescribed lidocaine patches purchased via Dollar general during this time, in 2019 or 2020, as be ALL I could have for a very little pain relief… And the horror to these patches
there were so so horrible they did not stick they did nothing they would roll down from my back and my neck in simple minutes be unusable and be by the waste and not allowed more and not cared nor respected and the opinion of how unfortunate these were of mislabeling and I was forced to be abided by their label and they’re misrepresentation of those labels as it put me in extreme pain distress and emotional burdens that bestowed much more into my future..and I was only allowed to check out as labeled every 12,hours or if lucky twice a day in a mere few Ibuprofen and Tylenol with what was suffering and what is a permanent chronic spinal cord injury that is discriminated hidden not noticed and rather hard to understand from those who do not have especially when it can’t be seen…..
those patches for those 30 days if that one allowed easily became mangled mushed and munched together and adhered together and was unusable it would become unable to stick or unable to hear to my skin and it would do very little it was not flexible it was not a hearable and it definitely was monumental in my case because of its false advertisement false labeling and forced for me to go abided by that and it was ignored dismissed and I was rather perpetuated as masculated and extremely hurt from the causes it bestowed of pain suffering that comes with with pain untreated.. this was allowed to had and this is all definitely documented and should still be on file and definitely would like it looked into if anyway possible to please inquire into further of its details..and this is documented on file from just a couple years ago. I was put in such discomfort and put into such distress because I was in a situation where I was not believed I was disallowed any accurate pain relief and the only thing I was allowed was very few was ibuprofen patches and if Lucky tiger bomb but all had to be prescribed. I was put into such distraught and comfort and pain and suffering relying on only the few things I was allowed especially these horrific cheap misleading inaccurate purposely labeled as false advertisements, that I was forced and bestowed what future I had that had gone and was perpetuated from unable to be heard and labeled and dismissed that continued into what is and what has been unfortunate events of that failure to be even nearly able to be aided in any shape or form from these horrific patches.. i do say to them its was but a piece to my suffering my distraught and my unknowns pain that went to be a burden and rather dismissed and added to more inaccurate assumptions and horrific consequences from being disabled and pain with nothing to help and no one to hear or care and the labeling was but was and suffering to mine of unfortunately aided into an unfortunate circumstances. more so these patches were not only donot stick they would roll down and they would cause severe burning and irritation to the lower buttocks and areas of severe irritation of what was near 3rd degree burns and this always dismissed and I was lucky to have my one patch a day checked and initialed on a form prescribed and ordered that I was forced to go through for What Little I was allowed for treatment for a severe spinal cord injury of chronic pain from malpractice of adhesive arachnoiditis it was wonderful I tell you..
.thank you Dollar general Hit and Split I lost it… Oo’ to the woes of false labeling can do to the few
