Unum claim denied stampA Kentucky woman recently filed an Unum long term disability lawsuit, alleging the insurance giant wrongfully denied her benefits.

The plaintiff, Angelia H., received insurance coverage through her employer, provided through Unum Life Insurance Company of America and guaranteed under the terms of the Employment Retirement Income Security Act (ERISA).

After initially becoming disabled, Angelia was granted short term disability benefits from Unum. Unfortunately, Unum later reversed its decision, rescinding its approval of Angelia’s short term disability benefits.

However, the lawsuit claims, there was no change in Angelia’s condition in the interim: she was not cured, and her disabling condition did not improve. Her lawsuit claims that the reasons for the reversal of Unum’s decision are “medically mysterious,” with no apparent reason. Any potential to receive Unum long term disability benefits has, therefore, also been denied.

After exhausting administrative approaches to reversing Unum’s denial decision, Angelia filed a lawsuit against the company. According to the Unum long term disability lawsuit, the company denied her benefits under a conflict of interest. Unum is both the entity that determines the plaintiff’s disability and the entity response for paying disability benefits, and therefore had incentive to deny the plaintiff’s benefits, Angelia claims.

Angelia filed her Unum long term disability lawsuit on Jan. 6, 2018 in the U.S. District Court for the Western District of Kentucky. She hopes that filing the lawsuit will grant her rightful disability benefits, as well as cover attorney’s fees and other costs.

Filing an Unum Long Term Disability Denial Lawsuit

A growing number of plaintiffs like Angelia are filing disability benefits lawsuits against Unum, claiming that the insurance giant unfairly denied their rightful Unum long term disability claims for benefits that they actually qualify for under the terms of their insurance policies under the terms of ERISA.

This Unum long term disability lawsuit and others like it allege that Unum, the largest disability insurance company in the country, has purposefully and unfairly denied the disability insurance claims of plaintiffs like Angelia who are actually qualified to receive such benefits.
