A plaintiff has filed a lawsuit in Connecticut Superior Court against General Electric Company on behalf of her deceased husband, James B., who worked as an electrician for General Dynamics Corp. and Electric Boat Corp. at Electric Boat Shipyard in Groton, Conn.
Plaintiff Holly B. files the mesothelioma wrongful death lawsuit alleging James was allegedly exposed to and died because of asbestos exposure.
According to the mesothelioma wrongful death lawsuit, his work duties had caused him to “work in areas where he and others were handling and working with asbestos products or products containing, involving, or requiring the use of asbestos and was exposed to asbestos fibers and materials manufactured by the defendants….”
Moreover, the mesothelioma wrongful death lawsuit claims the defendant’s actions are violations of Connecticut Products Liability law.
The lawsuit maintains that the defendant’s actions were wrongful in that they were aware or should have been aware that their products were expected to cause asbestos exposure. The mesothelioma lawsuit states that “the defendants failed to advise the decedent of the dangerous characteristics of their asbestos, asbestos related insulation products, asbestos-containing products, products that contained, required or involved asbestos for use…”
As a result of the decedent’s exposure to asbestos, the mesothelioma wrongful death lawsuit states that the plaintiff was diagnosed with mesothelioma, asbestos-related lung disease, lung disease and/or loss of lung function.
In addition, James allegedly was caused to suffer mental anguish and significant pain. Holly alleges his earning capacity was impaired, as he had to spend large sums of money on treatment and medical care; he suffered from fear, anguish, and grief due to this illness. According to the mesothelioma wrongful death lawsuit, James B. died on or about March 12, 2017.
Mesothelioma Facts
Mesothelioma is a rare but serious condition that cannot be cured. According to statistics, fewer than 20,000 U.S. cases occur per year.
Mesothelioma is a tumor of the tissue that lines the heart, stomach, lungs, and other organs of the body. The most common type of mesothelioma is a cancerous, or malignant diagnosis which usually affects the lungs.
Some of the symptoms of a person that has been diagnosed with mesothelioma include shortness of breath, a cough, and chest pain. Other symptoms, according to the Mayo Clinic, include unexplained weight loss and unusual lumps of tissue under the skin on your chest.
Additionally, some complications from suffering and being diagnosed with pleural mesothelioma can include: difficulty breathing, chest pain, difficulty swallowing, pain caused by pressure on the nerves and spinal cord, and the accumulation of fluid in the chest, also called pleural effusion, which can “compress the lung nearby and make breathing difficult.”
Treatment for mesothelioma can include radiation, surgery, and chemotherapy. Other supportive treatments can also relieve symptoms. However, by the time mesothelioma is diagnosed, it is often too late.
