A new personal injury lawsuit was filed in U.S. District Court for the Eastern District of Texas, Marshall Division on Aug. 9, 2019 following an oil truck accident. The plaintiff, Tara T., is seeking redress for injuries sustained as a result of the oil truck accident with driver Ronathan H. and his employers Central Arkansas Petroleum Transport Inc., Tri-State Truck Center Inc., and Lamara Leasing LLC.
Tara, a resident of the state of Texas, alleges in her lawsuit that she was driving her 2011 Ford Ranger pickup Northbound on U.S. Highway 59 in a conservative and safe manner on Aug. 11, 2016 in Cass County, Texas. She says that immediately behind her drove defendant, Ronathan H., in a trailer-towing 2015 Volvo truck. The trailer being towed belonged to the other defendants, the employers of the driver.
According to Tara’s lawsuit, Ronathan came up behind her at an elevated rate of speed and, failing to control his vehicle, caused an oil truck accident involving unexpected force. Tara says her body absorbed a good deal of energy from the collision, allegedly causing significant physical injury and psychic trauma.
Plaintiff: Oil Truck Accident Caused by Driver Negligence
Tara alleges in the lawsuit that the blame for the oil truck accident lies squarely with the driver and the employing companies. She says that the Ronathan was a reckless and negligent driver that operated his vehicle in violation of Texas state law.
These laws stipulate that a driver needs to be aware of road conditions, the speed of other vehicles, and congestion and use that awareness to determine an appropriate following distance that allows for complete braking of their automobile if necessary.
Ronathan was purportedly negligent in this duty, and Tara alleges his driving was reckless and incompetent at the time of the oil truck accident. She additionally alleges he was “unlicensed,” in her lawsuit. She claims that the employing defendants were negligent in hiring the driver for transportation duties in the first place and for allowing him to remain on the payroll.
According to the plaintiff, the companies that allegedly retained him without appropriate training, licensing, and oversight were equally to blame for the oil truck accident. Tara is seeking to hold them liable for their negligence in training and supervising the driver that caused the oil truck accident. She is also seeking to hold them liable for their failure to maintain the truck in optimum condition.
The plaintiff brings specific counts of negligence and negligence per se, and negligent entrustment and undertaking against the defendants. She seeks damages for physical and mental pain and suffering, physical disfigurement, loss of income, and medical bills now and in the future.
