3M Company, CBS Corporation, and a number of other manufacturers are facing a new asbestos disease lawsuit, which was filed by a couple alleging the husband had developed lung cancer from asbestos exposure.
The plaintiffs claim these manufacturers had allegedly failed to warn the couple and the general public that their products could contain asbestos, which allegedly caused the man to develop lung cancer from asbestos.
Plaintiffs Gary F. and Melva F. conjointly filed this asbestos disease lawsuit, alleging the companies did nothing to prevent the possibility of lung cancer from asbestos.
Lung cancer from asbestos has been alleged by other claimants in the United States, with a high number of them being United States military veterans and retired manufacturing workers.
This was allegedly the case for Gary who had allegedly developed lung cancer from asbestos exposure, which reportedly occurred on the job. According to the asbestos disease lawsuit, Gary had worked in several locations throughout the San Francisco Bay area, each of which allegedly contained asbestos on the job site or in the materials he worked with:
- George’s Automotive Service in San Jose, California during summers of 1960 to 1964, replacing brakes and other car parts that were allegedly composed of asbestos. In addition, Gary says he also worked on cars for friends and family throughout the 1960s and 1980s that carried the same risk.
- United States Navy at Puget Sound Naval Shipyard and Long Beach Navy Shipyard from 1964 to 1967, serving on the USS Waddell. During his time here, he worked as a Fireman’s apprentice, Fireman, and boiler tender. In these positions, he was allegedly exposed to asbestos parts without any knowledge of the potential health risks.
- Photocopy repairman for various businesses from 1967 to 1989 throughout the San Francisco Bay area, in which he was allegedly exposed to asbestos while replacing parts or ink in photocopiers.
Due to the regular exposure from these job sites, Gary allegedly developed lung cancer from asbestos. According to the asbestos disease lawsuit, Gary was diagnosed with asbestos lung cancer in February 2016 and had been previously diagnosed with asbestosis.
Gary opted to file legal action against 3M, CBS Corporation, and other manufacturers, after discovering the companies either knew or should have known about the dangers of asbestos exposure.
Overview of Risk of Lung Cancer from Asbestos Exposure
Asbestos is a fibrous material that was commonly used for a number of manufacturing purposes before the 1980s for its fire and chemical resistant qualities. Furthermore asbestos was cheap to use, making it a favorite for manufacturers.
However, the Environmental Protection Agency (EPA) had eventually issued public warnings regarding the carcinogenic nature of asbestos and had also implemented strict guidelines that required companies to warn customers and tenants of possible asbestos exposure.
When asbestos fibers are released into the air, they can either be inhaled or swallowed and become embedded in the lungs. These fibers eventually fester, which can cause lung cancer from asbestos. It is important to note that asbestos lung cancer can take up to 35 years to show any symptoms, which often results in a late diagnosis.
Gary is currently contending with extensive medical treatment for the alleged lung cancer from asbestos exposure, and will most likely experience a shortened life. Gary and Melva are seeking multiple damages against the companies, including counts of negligence and failure to warn.
