3M lawsuit overview: 

  • Who: Kentucky sued 3M, Chemours, DuPont and more than 20 other companies. 
  • Why: Kentucky believes the companies knowingly contaminated Kentucky’s environment with PFAS “forever chemicals.”
  • Where: The 3M PFAS lawsuit was filed in federal court in Kentucky.

Kentucky wants 3M, Chemours, DuPont and other chemical companies held responsible for contamination caused by per- and polyfluoroalkyl substances released into the environment in the state.

The PFAS substances at question came into the environment through aqueous film-forming foam used in firefighting activities, according to the 3M lawsuit. The AFFF left PFAS behind in the environment and the companies knew the risks involved, the 3M PFAS lawsuit claims.

Tyco, a government contractor, said that it manufactured AFFF to the government’s exact specifications and should therefore be removed from the lawsuit.

Kentucky is seeking compensation for the PFAS contamination across the state and sites that “have or may have released AFFF into Plaintiff’s natural resources or property are military facilities or ‘Part 139’ civilian airports that are required to use MilSpec AFFF,” according to the Kentucky lawsuit.

The MilSpec AFFF was developed after a pair of catastrophic fires aboard aircraft carriers in the 1960s and it has been used to put out liquid fuel fires at military bases, airfields and aboard Navy ships, according to Tyco’s request for removal in the 3M PFAS lawsuit.

Defendants should pay for all past and future costs for PFAS contamination and cleanup across state, 3M PFAS lawsuit claims

Kentucky is asking for the defendants to pay all current, past and future costs related to the PFAS contamination to “fully investigate, assess, monitor, remediate, and restore the various locations contaminated by defendants’ fluorosurfactant products, as well as damages for harm to public property and natural resources,” according to the Kentucky lawsuit.

3M announced in December that it would stop using PFAS in any of its products by the end of 2025.

3M recently reached a $12.5 billion settlement with public water systems across the country over contamination with PFAS chemicals.That was just a few weeks after a $1.2 billion settlement between DuPont, Chemours and Corteva with 300 drinking water providers across the country, the first settlement of the consolidated multidistrict litigation on drinking water contamination.

    So does every citizen of Kentucky get a settlement, or at least the areas affected or is the money just going to the state? I am asking for precedence, because we should and hopefully will make corporations pay for poisoning our citizens. Check out Illinois. We have the most horrible water but we don’t know who is dumping. How would one find out where businesses are dumping their chemicals in the water. I think we could convince whistleblowers because this is in favor of the every man and an employee of the company would certainly know that these corporations can afford it.
