A new class action lawsuit alleges Toyota sold model year 2024 Toyota Corolla vehicles with defective brakes that can prevent the cars from immediately decelerating.
Plaintiff Valerie Infante’s class action lawsuit claims Toyota failed to disclose the alleged brake defect to consumers prior to them purchasing or leasing a model year 2024 Toyota Corolla vehicle.
Infante argues the alleged defect can cause the Toyota Corollas to not respond to a driver’s sudden braking, making the vehicle unsafe to drive, and that the automaker refused to accept responsibility for the alleged brake defect and failed to offer a repair or remedy for the issue.
“Toyota has failed to disclose to its actual and potential customers that its 2024 Corolla vehicles suffer from the Brake Defect described herein, creating a dangerous risk of the car’s brakes failing to perform in critical moments,” the Toyota Corollas class action says.
Infante wants to represent a California class of consumers who purchased or leased a 2024 Toyota Corolla.
Class action: Toyota Corolla brake defect caused plaintiff to crash
Infante argues she was driving her 2024 Corolla in March 2024 when she was forced to brake suddenly to avoid a collision, but that the vehicle did not respond to her braking and, while the automatic emergency braking system eventually engaged, it was too late to prevent a collision.
“The only explanation for Plaintiff’s experience is that her car manifested a significant and dangerous, technological defect in its braking system,” the Toyota Corollas class action says.
Infante claims Toyota is guilty of violating California’s Consumer Legal Remedies Act, False Advertising Law, Unfair Competition Law and Song-Beverly Consumer Warranty Act.
The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of actual and consequential damages for herself and all class members.
A group of consumers filed a separate class action lawsuit against Toyota late last year over claims the automaker sold Tundra trucks with a dangerous engine defect.
