SunRun Deceptive Marketing Class Action Lawsuit

SunRun Inc.SunRun Inc. has been hit with a class action lawsuit alleging the San-Francisco-based solar energy company deceived consumers into leasing SunRun solar panels by making misleading claims about their cost savings and about the increasing costs of electricity.

Plaintiff Shaw Reed alleges in the SunRun class action lawsuit that the company misled consumers into believing they could save money on “rising electricity costs” by using SunRun solar panels despite the fact that the energy prices at Southern California Edison began dipping or plateauing after 2008.

“The central premise of SunRun’s uniform marketing campaign is that increases in electricity prices will result in cost savings by installing the SunRun Solar system,” Reed says in the SunRun class action lawsuit. “But SunRun deceptively states with certainty something that is inherently unknowable.”

Reed further alleges in the SunRun class action lawsuit that the company was operating without a business license from 2007 to February 2012. The class action lawsuit is seeking a refund on customer fees from contracts entered into before 2012.

The SunRun class action lawsuit also claims company agents misleadingly told consumers they could terminate their SunRun contracts if they move.

The SunRun class action lawsuit is brought on behalf of all persons and entities in the state of California who entered into a solar power contract with SunRun prior to February 2012. It is also seeking to represent a subclass of all Class Members who were told by SunRun that they could terminate their contracts without further obligation if they moved.

The SunRun Class Action Lawsuit case is Shawn Reed v. SunRun Inc., Case No. BC498002, Superior Court of the State of California, County of Los Angeles.


UPDATE 6/29/13: A federal judge has refused to dismiss the SunRun Deceptive Marketing Class Action Lawsuit, allowing it to move forward.

    My kitchen cabinet was leaking and SunRun sent two guy out and they took down the cabinet in March and it has been sitting in my dining room on the floor every since ¡

    SunRun is trying to make my wife and I responsible for the replacement of an inverter which our agreement clearly states that it will be SunRun’s responsibility to replace the inverter. I have not been able to discuss the issue with anyone because my case manager Megan Tucker has refused to communicate with me. The price of the new inverter is $1261.00. I would not recommend SunRun. Their customer service is awful and at the end of my agreement we will terminate all business dealings with SunRun. Please do not do business with this company.

    Dealing with Sunrun what has been the most troublesome thing I’ve had in the 73 years.3 Things that have happened and I’m still dealing with them. my story #1- When the salesman came to my house, I told him other solar companies have been here, and they said there was not enough room on my roof for solar panel to cover my electric bill. So they looked at my electric bill and my roof. I was told that Edison would be paying me for the excess energy and I would never be paying more than my current Edison bill. End of the first year I received an overrun bill from Edison for $1000.. Oo they came back and said after examining my roof again that I would have to cut the trees around my house. My comment to them was those trees have been there since the 60s and they were there when they took pictures of my roof. #2 Disgusting before I signed the contract. I told him that the roof was very old. It had to be over 27 years because I have lived here that long. I was told as long as their engineers okayed the roof for Installation that it would be SUNRUN’S responsibility. The first year I had a small leak in the room attached to the main house. So I had that section of the roof repaired. The next rain came part of the ceiling of that room fell. I called the contractor to ask what happened and he came over, and did a water test said the water was coming from the panels. I called Sunrun and they came back, picked up a paddle and put some mastic underneath it. I think that’s what they did..The worker said it should be fine now OK. The next rain came my ceiling got so saturated. And it fell and developed a leak in the house. Another person was sent to look at the problem. He went into the attic and said the nails were all leaking and that panels should’ve never been installed on that roof. A roof that is that old and hard, when you start working on it you loosen up the shingles and the nails will start to leak, which is exactly what happened. #3 after much talking, they came to the conclusion that they were not responsible for the roof or damages in the ceiling of the house. They did send me a paper to sign that quoted. But they would remove the panels.After they remove the panels, I would have so many days to replace the roof and they would reinstall the panels. So that’s what I did. I had a new roof installed. Panels have been sitting in my backyard now; it is May and the roof was replaced in November. I asked if they could come and get the panels and close my contract, but they said they can’t do that. so I am still dealing with all this and I have a feeling in the house that needs to be fixed and a ceiling in my studio 3/4 of it has fallen. I wish I could get out of this contract..

    I see all the comments and know my osn situation, but where are any updates? This company is running quite a large scam that is nationwide, involves lots of shady pop-up/close-down sub contractors sales groups, and they provide absolutely ZERO in regards to support for their system. The contract i have states their end of the bargain is to keep the system running and in proper maintenance. It is now mid 2024, and I am still waiting for them to show up following Hurricane IAN in September of 2022! I am begging for an attorney group to contact me please as they are now demanding $80000usd. They are in breach of their end so contract null. Consumers muct have support and for the attorney group willing to take up this challenge, it is likely a very lucrative one. Help us put this company down for good.
