In December 2016, plaintiff Neil Torczyner filed a Staples class action lawsuit claiming that the company short-changed its consumers on rewards points, by misapplying coupons to purchases, lowering the number of rewards points a consumer received. According to Torczyner, who participates in Staples’ rewards program, Staples rewards members build up rewards points based on a percentage of the dollar amounts of qualifying purchases.

Torczyner says he purchased three items from Staples — two containers of sanitizing wipes for $3.99, and one bottle of water for $4.49. He used a coupon for the bottle of water, saving $1.50 on the water. Torczyner notes that he was aware that the sanitizing wipes would qualify for rewards points, whereas the water would not.

When he made his purchase, Torczyner claims that he was told that the coupon would be applied to only the water bottle, and he says that his receipt reflected this fact. Based on this method of coupon application, he should have received $7.98 in rewards points.

However, Torczyner went on to claim that when he checked his rewards points online, the $1.50 coupon for the water had not just been applied to the water bottle, but had been applied across all three purchases, reducing his rewards points for that purchase to $7.02.

The Staples Rewards program class action lawsuit argued that this practice is one applied intentionally and systematically to many consumers, with the express intent of short-changing consumers on the number of rewards points they would receive as a result of their Staples’ purchases.

Torczyner claimed that this practice violates statutory and common law, and said that it is simply unfair and deceptive to apply coupons redeemable only for non-qualifying purchase under the Program on a pro rata basis across all purchases made in the same transaction—including merchandise qualifying under the Program.

The plaintiff argued that Staples intentionally concealed this practice from consumers. In the Staples Rewards points class action lawsuit, Torczyner sought compensatory and punitive damages for himself and all similarly affected consumers.

Staples allegedly continues to deny Torczyner’s allegations, but agreed to pay settlements to consumers.

The deadline to file a claim for the Staples miscalculated rewards class action lawsuit was July 24, 2017.
