samsung-top-load-washerAn Oklahoma man says Samsung has failed to follow through on the terms of its recall of exploding washing machines.

Plaintiff Jerry Wells is specifically challenging the remedies that defendant Samsung is offering to purchasers of allegedly defective Samsung washing machines.

These machines are reportedly at risk for exploding, sending their lids flying and creating a risk of injury.

Wells argues the company has failed to follow through in good faith on the terms of its own Samsung recall.

Reports of exploding washers led Samsung to issue a voluntary recall late last year, affecting 34 models of its top-loading washing machines.

The company says it received hundreds of reports that these washing machines may suffer from excess vibration while in use and that their lids are prone to coming detached.

According to Wells’s Samsung class action lawsuit, when the machines’ lids detach, they can explode away from the machine with enough force to injure a nearby person.

Samsung says it received nine reports of physical injury resulting from the defect, including a broken jaw and an injured shoulder, according to Samsung recall announcement.

Under terms of the Samsung recall, affected machine owners could choose between in-home repair with a one-year warranty extension, a rebate to be applied to the purchase of a new Samsung washer, or a full refund for those who purchased their washing machines within 30 days of the recall announcement.

In his Samsung recall class action lawsuit, Wells says he purchased one of the Samsung washers at issue in November 2012.

By the time he learned about the Samsung recall, he says it was too late to exercise the full refund option, and he did not care to accept a partial rebate on the purchase of a new washer. So Wells tried to arrange for an in-home repair.

But despite numerous attempts to schedule service, Wells says no repair person ever showed up. Wells claims he scheduled three different appointments for service, and each time the repair person failed to keep the appointment.

Wells believes Samsung was purposely avoiding making an in-home repair to force him to take the rebate option instead.

Samsung repaired his washing machine on two prior occasions without difficulty, he claims. The only repairs Samsung failed to make were those he requested through this Samsung recall.

Wells proposes to represent a plaintiff Class that would include all U.S. residents who between March 2011 and November 2016 who purchased or otherwise acquired a washing machine subject to the Samsung recall.

He seeks a court order requiring Samsung to provide Class Members with an effective recall program including replacement of parts or entire washers free of charge.

The plaintiff is asking the court to bar Samsung from continuing to manufacture, market or sell the washing machines that are subject to the Samsung recall. He also seeks an award of damages, restitution, and attorneys’ fees, all with interest.

Wells is represented by attorney William B. Federman of Federman & Sherwood.

UPDATE: On May 30, 2017, Sears and Home Depot argued that they should be dropped from this litigation because the class action consumers did not allege that they purchased their Samsung washers at any of their store locations.

    I also bought one of the washer and dryer sets that are on recall. I finally got my washer repaired , with brackets and something put on the lid and decals sent telling me not to use certain levels. But I also had wall damage that ocured after my washer bounced all over the room and I have called several,several times about the repair and keep getting promised a call back. And know my washer is bouncing again and I’m not sure what to do , seeing that they do not keep their word about repairs and call backs. I will never,ever buy another SAMSUNG product again.

    I too am not satisfied with the result of this recall. My set was purchased in February 2012. Barring this issue, I would have thought the machine would have lasted for many more years considering it had a 10 year warranty on the motor or something. I was told that I would get a credit of $236 if I purchased another Samsung machine or $136 if I purchased another type. At the time when I looked I did not see any other Samsung top load washing machines, so I decided to replace both my Samsung W/D with a front loading pair from another manufacturer (with which I started employment in 2016, so the employee discount was a no brainer). I completed the paper work required to get the credit back in November 2016 and have yet to receive a check. Personally, I think the amount they offered was ridiculous when I spent at least $750 for the washer and it was only 4 years old. My previous washing machine was a Kenmore and it was 15 years old when I replaced it with the Samsung and it was still going. We just wanted to take advantage of the new advancements being offered on newer machines. I have a Samsung cellphone and several TVs. However, this will have a direct influence on whether I continue to support this manufacturer in the future.

    We too had one of the recalled washers. We were sent a plastic label to fix over the existing label on the machine so it shows less cycles. This is supposed to be so www don’t use the ones that explode. How stupid! First of all, I bought the set because it had those cycles, it was a selling point. So, now I loose them? When I spoke to Samsung, they gave me a few options. Have a repairman come out and fix the unit, (more on that later), buy another Samsung unit and they would give me $545. (all they had left not on the recall were front loaders, no thank you) Or I could purchase any other brand and get $445. Hmm, the Samsung one cost me over $600. So I guess we’re being forced to take a loss because their product explodes? Well, I found out that their repairmen have NO CLUE as to what to do to actually fix the machines. They were told to tighten the drum and make it look like they know what the heck they’re doing. But, in their own words, they have no clue if what they’re doing is going to fix anything. So I bought a $700 Maytag over at Lowes. The manager told me to come in and see this gal in that department and she would show me machines that compared to the Samsung one. After I chose one, he would give it to me for the $445.00 that Samsung said I would be refunded. That was well over 9 weeks ago. I still haven’t seen that refund check. I called Samsung and was told it’ll be several more weeks because of the heavy response they’ve received. So, let’s see, they have several products that explode, I’ll never buy anything made by Samsung again.

    I am one of the Samsung customers also that are stuck with a washer that can kill me, or I can take the $300 and spend out of pocket to replace. I have not done anything yet because both options were not fair. So I am scared every time I do wash

    The only way i can get a new machine is to purchase one then Samsung will send a check in 6 to 8 weeks. But unfortunately
    If you dont have the money to purchase a washing machine you (and I) am forced to keep the unsafe machine until we get the money. I dont feel safe by them attaching brackets to the machine. They (Samsung) should set up an account for the customers to go and buy another machine using a one time credits with the stores. It’s not fare to force us to use an unsafe product.

    I am also one of the unfortunate to own one of the recalled Samsung washers. In July 2016 my washer was having major problems jumping all over and continually stopping and showing the UE error. At the time there was no recall that had been announced, so we called a repairman. Needless to say, after the inspection from the repair person, he had to replace all four struts that more or less hold the drum. The repair cost $219. We had no choice, but fix the washer as it would have cost too much to replace it with a new one. After all, the washer wasn’t that old. A few months later Samsung announces the recall. I immediately filled out the forms online explaining our problems and that we had paid for a repair already. The only thing that Samsung did for us is send out a person to attach brackets so the top will not fly off (I should state that the gentleman that came out, knew nothing of washing machine repair…only knew how to put the brackets on) and they sent the labels which really do not correspond to the correct cycle placements. We can’t use the high spin cycle anymore, so the clothes are never fully spun enough. Oh, and by the way….the drum is not in a full circle shape, it is warped from spinning out of control before we had it repaired. I just can’t believe that the company is not standing by their products and helping those customers that had faith in their company. We own quite a few Samsung products. Shame on us!

      attached brackets and then I had to wait for decals to arrive in the mail to place on my washer. I am sorry the email I got when I signed up for repair said the decals would arrive BEFORE the tech came out. Tech came out 3 months later and I got no decals

    WORST customer service I have ever experienced! I spent a month calling, trying to talk with someone about the issue. I was always promised a call back within 24-48 hours. It never happened. I purchased my machine in August 2016. It was one month too ‘old’ for a 100% refund. It was not eligible for repair and had to be replaced. I finally just bought a new one and had the old one removed. I did the tedious rebate paperwork and submitted it. That was Dec. 20th, 2016. I am still waiting for my rebate check. I hope someone is successful in suing them.

    we just bought a new washer and dryer..paid 1000.00 for washer alone in May of 2016..and another 800 for dryer..heard about the recall just before christmas and filled out the rebate form ..Samsung offered us 600 for the washer..we had only had it for 5 months..Do not want to repair and got a sticker in mail that is suppose to fix problem ..REALLY STUPID..apply sticker and dont use the settings originally on washer..I dont think so..we went out and bought a new washer and sent all the required information in and STILL waiting on refund check ..which should have been for original amount but is not going to be…Mad angry frustrated…we are foster parents and have to have a washer so left no other choice here…

    I purchased one of the washers in August of 2014. In September 2015 it started vibrating and making a horrible noise on spin. I called Samsung and they tried to talk me through fixes on the control panel. Since I was 1 month past the 1 year warranty they did not want to offer to arrange for a repair person to come out and fix the machine. I had to call several local Appliance repair shops before I could even find one that works on Samsung products. When I did find one the cost to take apart the machine and replace all 4 “leveling rods” ( not sure what the are called.) But the final bill was $261.45. When I heard about he recall I called and reported it was one of the recalled models. They told me if I bought a new Samsung washer they would give me a credit of $235. If I chose to buy a new different brand credit would only be
    $135. I told them I had already paid to have the machine repaired once and had no plans of buying another Samsung. I feel they should pick up all of the recalled models and deliver a new washer that is not of the type with the exploding issues. Or better yet refund original price of machine + my personal cost to repair and let me buy whatever washer I want.
