RTI Plumb-PEX Plumbing System Class Action Settlement
By Matt O’Donnell
The Plumb-PEX settlement will resolve a class action lawsuit known as In Re: Uponor, Inc., F1807 Plumbings Fittings Products Liability Litigation that alleges the companies designed, marketed and sold RTI Plumb-PEX Plumbing Systems containing brass insert fittings and stainless steel clamps that may leak and cause damage to property.
The Defendants deny all of the claims in the class action lawsuit but have reached a settlement to avoid ongoing litigation.
Class Members of the Plumb-PEX class action settlement includes anyone who owns or has owned a property containing an RTI Plumb-PEX Plumbing System with ASTM standard F1807 brass insert fittings and stainless steel clamps that was installed on or after May 15, 1999 and:
(1) had a leak in an RTI Plumb-PEX Plumbing System component; or
(2) can show a 50% reduction in water flow between the hot and cold lines to at least one fixture.
Also included in the class action lawsuit settlement are people and entities that paid for damages or repairs caused by a leak resulting from an RTI Plumb-PEX Plumbing System design or manufacturing defect.
The Plumb-PEX class action lawsuit settlement will provide reimbursements to Class Members for property damage caused by a qualifying leak from a system component. It will also pay for the reasonable costs associated with the repair or replacement of affected components.
If you own a structure that has had two or more leaks, you may be eligible to receive a complete replacement of the RTI Plumb-PEX Plumbing System.
For eligible claims related to reduced water flow, you can receive a repair or replacement of the RTI Plumb-PEX Plumbing System components as needed to restore normal water flow.
To request a payment for past property damage or repairs, or to have repairs performed on an RTI Plumb-PEX Plumbing System, you must complete and submit a claim form. The earliest deadline to submit a claim form is December 26, 2013. Actual deadlines will vary by property based on when a problem occurred and whether the system’s original warranty is still in place. You can determine your actual deadline by visiting www.RTISettlement.com.
