Roundup Cancer gardening MonsantoA man has filed a lawsuit on behalf of his late wife who he alleges developed non-Hodgkin’s lymphoma after using Roundup weed killer.

Plaintiff Ronald R. filed this Roundup non-Hodgkin’s lymphoma lawsuit on behalf of his deceased wife, Rosemary R. Ronald names Monsanto Company, manufacturer of Roundup, as the defendant in the case.

“Plaintiff maintains that Roundup and/or glyphosate is defective, dangerous to human health, unfit and unsuitable to be marketed and sold in commerce, and lacked proper warnings and directions as to the dangers associated with its use,” the Roundup non-Hodgkin’s lymphoma lawsuit states. According to Ronald, Rosemary’s injuries were avoidable.

Monsanto discovered the chemical glyphosate in the 1970s and began to design and manufacture the product that would later be sold and distributed as Roundup. Glyphosate kills weeds and grasses non-selectively, meaning that it kills anything that produces an enzyme known as EPSP synthase. Glyphosate interferes with the shikimic pathway in plants, causing a buildup of shickimic acid in the plant that causes it to die.

Crops are now genetically engineered to withstand the spraying of glyphosate. Crops can be entirely sprayed with the chemical and the crops can then grow weed-free. Neighborhood lawns, commercial nurseries, parks and golf courses are saturated with Roundup at approximately 250 million pounds annually.

In 2015, the World Health Organization determined that glyphosate is a “probable carcinogen.” Back in 1996, a lawsuit against Monsanto was filed by the New York Attorney General with allegations that its advertising was false and misleading. Monsanto had referred to Roundup as “safer than table salt” and “practically non-toxic” to birds, fish and mammals. Monsanto agreed to stop certain types of its advertising only in New York but did not do so in any other state, according to the lawsuit.

The IARC, the International Agency for Research on Cancer deemed Roundup as a class 2A “probable carcinogen” due to “mechanistic evidence of carcinogenicity in humans insufficient evidence of carcinogenicity in animals.” It found an increased risk of glyphosate exposure and non-Hodgkins lymphoma, the Roundup non-Hodgkin’s lymphoma lawsuit states. It also found that glyphosate led to chromosomal and DNA damage in human cells.

Ronald states that Rosemary began using Roundup approximately in 1976 and sprayed it according to the product labels during its use. Rosemary was then diagnosed with non-Hodgkins lymphoma which was “proximately and actually caused by exposure to Defendant’s Roundup products,” the Roundup non-Hodgkin’s lymphoma lawsuit states.

Ronald has brought forth a number of accusations against Monsanto including negligence, strict products liability for design defect and failure to warn, breach of implied warranties, loss of consortium (loss of an intimate spousal relationship), wrongful death and survival action.

The plaintiff is seeking judgment against the defendant and an award of compensatory damages related to pain, suffering, emotional distress, loss of enjoyment of life, economic and noneconomic costs, severe and permanent personal injuries, economic damages, pre- and post-judgment interest, attorneys’ fees and costs, and any additional relief as deemed just and proper by the court.
