Purina-BenefulNestle Purina Petcare Company was hit with a class action lawsuit alleging that its Beneful dog food includes toxic substances which are capable of killing dogs.

According to the Beneful class action lawsuit filed in a California federal court by plaintiff Frank Lucido on Feb. 5, Beneful is responsible for making thousands of dogs either seriously ill or causing them to die, which happened to one of his own dogs.

Lucido owned three dogs — a German Shepherd, an English Bulldog and a Labrador. He bought a bag of Beneful for the first time in late December 2014 or early January 2015 and each dog began eating Beneful exclusively, the Beneful class action lawsuit explains.

On Jan. 15, the German Shepherd began to lose a large amount of hair and began giving off a unusual odor, which concerned Lucido and his wife, who first started to notice the symptoms. Two days later the German Shepherd became “violently ill.”

After being examined by a veterinarian, it was determined that the German Shepherd was suffering from internal bleeding in the dog’s stomach and the liver was also malfunctioning, which the veterinarian said was “consistent with poisoning.”

On Jan. 23, Lucido’s wife found the English Bulldog dead in their yard. “Post-mortem veterinary examination revealed signs of internal bleeding in the dog’s stomach and lesions on his liver, much like [the German Shepherd],” the class action lawsuit claims.

The Labrador also became ill and is being tested for similar problems.

Lucido claims that he and his wife “have suffered economic losses including the purchase price of Beneful and veterinary and related medical expenses” as result of the damage Beneful has done to their dogs.

According to the Beneful class action lawsuit, there have been more than 3,000 complaints posted by dog owners on the internet “about dogs becoming ill, in many cases very seriously ill, and/or dying after eating Beneful.

“The dogs show consistent symptoms, including stomach and related internal bleeding, liver malfunction or failure, vomiting, diarrhea, dehydration, weight loss, seizures, bloating, and kidney failure,” the Beneful toxic dog food class action lawsuit alleges.

Lucido gives several examples of these complaints by other dog owners.

According to Lucido, Beneful is advertised as a healthful and nutritional dog food, but his experience and others has been the opposite.

Beneful dog foods allegedly include propylene glycol, which is “an automotive component that is a known animal toxin and is poisonous to cats and dogs.”

In addition, the Beneful class action lawsuit alleges that the dog food includes mycotoxins, which are “a group of toxins produced by fungus that occurs in grains, which are a principle ingredient in Beneful.”

The class action lawsuit cites the Association for Truth In Pet Food, which tested “Beneful Original and found that it contained dangerous levels of mycotoxins.”

Lucido is looking to represent two classes — a nationwide class and a California subclass for dog owners “who purchased Beneful dog food in the past four years and who incurred any out of pocket costs due to illness, injury or death of their dog resulting from the ingestion of Beneful.”

The Beneful toxic dog food class action lawsuit is charging Nestle Purina with breach of implied warranty, breach of express warranty, negligence, negligent misrepresentation, strict products liability, violating California’s consumer legal remedies act, violating California’s Unfair Competition Law, and violating California’s False Advertising Law.

The Beneful Toxic Dog Food Class Action Lawsuit is Frank Lucido v. Nesltle Purina Petcare Company, filed in the U.S. District Court for the Northern District of California.

UPDATE: On Nov. 17, 2016, U.S. District Judge Edward Chen granted summary judgment to Purina, rejecting testimony from the plaintiffs’ expert that suggested Beneful dog food was the direct cause of their dogs’ illnesses or deaths.

    I am lucky to still have my dogs. The beagle had liver issues they wanted to do a biopsy, My lab had stomach issues and kidney issues. All the vet could say was did they get into anything? antifreeze etc. They stay inside when we are gone and in a fenced yard when we are home. No way they got into anything. I am really glad I found this site. I have already phoned the attorney. Also I have documentation from the vet.

    My Golden Retriever Oz was put to sleep during surgery on April 10, 2015. I had an appt on April 9th for arthritis in his back legs. My vet checked him over but when he opened his mouth, he said he was anemic so he did an xray of belly area. So I wanted to take him home that night and he was scheduled for surgery the next morning. They said his stomach was filled with blood and liver was bleeding. I made the decision to have him put to sleep while he was still under. I was devastated. He was five years old when we got him and has been on Beneful Healthy Weight ever since he was a puppy. He was 12 yrs old. I still cry and I miss him and if I thought it was this food I definitely would like to file a lawsuit against them. Goldens are not noted for liver cancer. I do feel everyones pain

    My 8 year old Carin Terrier mix was on the Beneful Healthy Weight kibble for a few years when I noticed him trembling on a Thursday night. Friday I made a vet appt. for Monday. By Sat. morning he was shaking so badly he had trouble standing and his eyes were darting in the sockets. I rushed him into the vet and she said he had symptoms of toxicity and his motor neurons were `blasting.` She said it was as if he had digested antifreeze which of course he hadn`t. I had to put him down and so she gave him a sedative which did not stop his shaking. She administered enough sedative for a 120 pound dog (Baswell weighed 22 pounds) and still he shook terribly. She said he was so out of it she could perform surgery yet he shook so badly his eyeballs kept darting in his head. It about killed me to watch as she then gave him the fatal shot and he finally relaxed and died in my arms. That was 2 years and 2 mos. ago and I am still torn up. Did the toxins in his food catch up to him? I think so.

    I noticed after my dog would eat the Beneful original he would get bloated and just lay around so changed 2 pedigree and now hes not bloated after he eat,,

    Now I believe it is killing dogs My 9 yr old white German Shepard girl Angel died suddenly last Thursday afternoon in our back yard.
    We were all in shock sine she had no symptoms of sickness but she laid down went to the bathroom in place and a good amount of blood came out of her butt and she died in a mater of minutes.
    It does seem like it could be poisoning from her only food Beneful
    7 days earlier we put her best friend and my best dog ever Tobi 10 yrs old White German Shepard Wolf mix to sleep since he became ill and could not digest food or go to the bathroom for 2 1/2 days.
    Both of them only ate Beneful ????

    My min pin eats blue freedom dry food, but gets a can of beneful wet food a day. After doing some research, the dry food seems to be the only problem. Is there something wrong with the wet food too?

    I hope they recall the dog food and get it off the shelves. Please get it off the shelves. I lost on beagle after seizures and he was only 2 yrs old. I lost my Lassa from kidney failure. Then I got a new beagle and she started getting seizures as well. I was like what the heck. So we changed dog food to a food that does not have all the preservatives. The seizures have stopped. So yes I do believe it was from the healthy weight beneful dog food that we were feeding to all of our dogs.

    I raised a full bred German Shepherd for ten years. For the last six of those yrs. we fed her with Beneful Healthy!! It had peas and carrots in it. Sure seemed healthy! Unknown to us it was far from healthy if fact it could of been harming her. She just up and died while vomiting up some black stuff. She shouldn’t of gone that way. Heck she still had her young dog figure! It was very sad and she is missed dearly today and always.

    So my mom has two dogs who she fed this food and one has died and one is dieing becouse of this food the dog did fine for a long wile and she feed them this food and all a sudden they got sick and it hard for her to lose these pups it is very sad to not be able to do anything u can not trust any company any more make me sick they do anything bet they don’t feed there dogs this crap so sad u can’t trust any company with the life of your animals becouse they do not care all they care for is how to make a profit at the cost of life

    i called, they take your information and a small amount of what happened to your animal, and tell you they will get back with you once they have all the information from others. its worth a try to maybe be reimbursed for vet care at least
