PNC BankPNC Bank agreed this week to pay $90 million to settle an overdraft fee class action lawsuit that’s part of a multi-district litigation involving more than 30 banks nationwide.

At least 13 other banks — including Bank of America, JPMorgan Chase, Union Bank and Citizens Bank — have reached class action lawsuit settlements in the case, In re: Checking Account Overdraft Litigation, which accuses the banks of reordering debit card and ATM transactions from highest to lowest, rather than in the order the transactions occurred, in order maximize the number of overdraft fees they could charge a customer.

PNC reached a separate class action lawsuit settlement regarding improper overdraft fees last year, in which it agreed to refund customers nearly $12 million in unfair overdraft fees.

A lawyer for the Plaintiffs in the current case says he anticipates the new settlement with PNC to be presented to the Court for preliminary approval later this summer. At least “several hundred thousand” PNC customers throughout the country who were overcharged for debit and ATM overdrafts between 2004 and 2010 will be covered by the PNC class action settlement.

The case is In re Checking Account Overdraft Litigation, Case No. 09-md-02036, U.S. District Court, Southern District of Florida (Miami).

    I AM A SENIOR CITIZEN, WHO LIVES ON A SMALL INCOME, ND THERE HAS BEEN TIMES THAT I HAVE HAD TO USE AN AIDE TO MAKE TRANSACTIONS FOR ME, B ECAUSE I AM DISABLE. IHAVE TO LIVE WITH OVERDRAFTS THAT TOOK A WHOLE CHECK, BUT WHEN EXPLAINED TO THE BANK, I WAS TOLD THAT WAS A PERSONAL PROBLEM, YES IT WAS BUT THEY DID NOT CARE. SINCE THEN THE GOV,T HAS SHUT THAT COMPANY DOWN SO THAT DID NOT HELP. SENIORS HAVE TO DEPEND ON THESE AIDES.

    I HAD BOTH MY REGULAR, AND MY OVERDRAFT ACCOUNT CHARGED 36.00. PAID THE REG FEE BUT DIDN’T REALIZE THEY KEPT CHARGING MY OVERDRAFT ACCOUNT EVERY DAY.

    I started getting charged $36.00 in December and then $7.00 per day until I received my SS Check which comes the 3rd Wednesday of the month. I am a 73 yr. Lady and I just found out about any of this from PNC Bank. I would appreciate if someone could get in touch with me and let me know wht I need to do.

    I think if you got it already from national city then you cant claim this one too UNLESS after it switched over to PNC you were charged those fees again. I also got a small payment from national city much less than what they originally claimed

    How do I know if I am part of this? I received a payment from National City (a very small amount) in April 2012.
