cell phone in hands, TCPAOn July 31, 2017, Plaintiff Melenie C., a resident of Seminole county in the State of Florida, being sick and tired of being on the receiving end of over 900 robocalls, filed a Sallie Mae Bank TCPA lawsuit in U.S. District Court, Middle District of Florida, Tampa Division.

In this Sallie Mae Bank TCPA lawsuit, Sallie Mae Bank is accused of making hundreds of harassing phone calls using an automatic dialing system with a pre-recorded voice.

The phone calls were made to her cellular number and continued long after she revoked any permission to be contacted in this manner from the banking giant. The purpose of the phone calls was to collect upon an outstanding student debt.

Sallie Mae Bank has its headquarters in the State of Delaware, but does business in many states including the State of Florida where the plaintiff resides.

According to the Sallie Mae Bank TCPA lawsuit documentation, the plaintiff expressed her feeling of harassment to the defendant on Aug. 13, 2013 and demanded that the automatically-generated phone calls to her cellular phone stop immediately.

The plaintiff identified the harassing phone calls as being generated by an automatic dialing system which does not need human intervention once set in place to make said phone calls. It has the capacity to store thousands upon thousands of phone numbers and dial them randomly or sequentially.

The plaintiff also identified the phone calls as using an artificial voice and being pre-recorded. These elements are both in violation of the Telephone Consumer Protection Act (TCPA) of 1991.

In the Sallie Mae Bank TCPA lawsuit, it stated that the defendant has been accused of similar violations by other complainants and has been sued in federal court 312 times since August 2013 when Melenie C. revoked her permission to receive phone calls of this nature from the bank.

It is also stated that there are pending federal lawsuits for telephone harassment against the defendant as well.

The documentation of the Sallie Mae Bank TCPA lawsuit goes on to state that there have been 212 registered complaints to the Better Business Bureau of which 125 have been classified as related to billing and collection issues.

Melanie C., complainant in this Sallie Mae Bank TCPA lawsuit, reiterates in the documentation that she expressly revoked her permission to be contacted in this manner by the bank.

She refers to the phone calls as harmful in that they invaded her privacy, wasted her time, shortened the life of her cellular phone battery, and used minutes which she had to pay for in a plan through her mobile service provider.

The plaintiff is asking for a minimum of $500 per violation of the TCPA which is her right under this law.  She also is seeking punitive damages and any other relief determined to be just and proper by the deciding court. She is only bringing one count against the defendants and that is Count one – Violation of the TCPA.

The Sallie Mae Bank TCPA Lawsuit is Case No. 8:17-cv-01821-EAK-AEP, in the U.S. District Court for the Middle District of Florida, Tampa Division.
