Nissan class action lawsuitOn Monday, Nissan North America Inc. was hit with a class action lawsuit alleging it failed to disclose that some of its Nissan Sentra vehicles contain a defect that can cause premature transmission failure.

Plaintiff Waldo Leyva filed the Nissan class action lawsuit on behalf of himself and a proposed Class of U.S. consumers who purchased or leased any 2012 through 2017 Nissan Sentra with an Xtronic Continuously Variable Transmission (CVT).

According to the Nissan Sentra class action lawsuit, the CVT is prone to premature failure. Leyva asserts that the CVT’s cooling system is designed in such a way that makes the transmission unreasonably sensitive to heat and prone to overheating.

When the transmission overheats, it may activate the “Fail-Safe Mode,” which may reduce the engine’s performance and cause drivers to experience shudders, vibrations, or catastrophic transmission failure, Leyva says.

Nissan also failed to disclose to consumers that the Nissan Sentra vehicles were equipped with a cooling system that is too small to effectively cool the transmission, the Nissan class action lawsuit says. These cooling systems are allegedly prone to malfunctions and premature wear that may cause drivers to experience loss of power or stalling unexpectedly while driving.

Leyva claims Nissan was aware of the Sentra transmission defect since at least 2013, if not earlier, and that the vehicles’ transmissions would require frequent repair. Despite this awareness, Nissan continued to install the allegedly defective CVT and inadequate cooling system, the Nissan class action lawsuit claims.

“Moreover, Nissan not only refused to disclose the problem to consumers, but it also actively concealed, and continued to conceal, its knowledge concerning the defective cooling system and prematurely wearing CVT,” the Nissan Sentra transmission defect class action states.

Transmission malfunctions can create dangerous situations, such as impairing a driver’s ability to control a vehicle and increasing the risk of collision, Leyva claims in the class action lawsuit. He says he would not have purchased a 2015 Nissan Sentra, or he would have paid less for the vehicle, if he had known about the Sentra transmission defect.

The Nissan class action lawsuit points to numerous complaints that have allegedly been filed with the National Highway Traffic Safety Administration and online about the Nissan Sentra transmission defect. Many of the complaints involved issues such as slow acceleration, stalling, clunking noises, and loss of control of the vehicle while driving.

In addition to a nationwide Class, Levya also seeks to represent subclasses of consumers who reside in California and/or who purchased and/or leased their Class Vehicles in California.

The Nissan class action lawsuit asserts claims for violation of California’s Consumers Legal Remedies Act, breach of implied warranty pursuant to the Song-Beverly Consumer Warranty Act, breach of implied warranty under the Magnuson-Moss Warranty Act, and unjust enrichment.

Leyva is represented by Jordan L. Lurie, Tarek H. Zohdy, Cody R. Padgett, and Karen L. Wallace of Capstone Law APC.

UPDATE: On Jan. 12, 2018, Nissan sought dismissal of several claims from a class action alleging transmission defects in certain model years of Nissan Sentra vehicles.

UPDATE 2: The case Waldo Leyva v. Nissan North America Inc., Case No. 2:17-cv-06682 was dismissed on April 20, 2018.  The plaintiff joined a similar case, Falk, et al. v. Nissan North America Inc., Case No. 4:17-­cv­-04871, in the U.S. District Court for the Northern District of California, which is still pending.

    I bought a 2017 Nissan Sentra from a Nissan dealership and I’ve had problems with the Sentra from purchase date 10/17/2017, so after 5 years and I paid off this Sentra , the CVT transmission in this 2017 Nissan Sentra has gone out and A plus transmission Specialist , trying to rip me off
    for $6100.00 for a rebuilt transmission. That’s un heard of !! I’m being charged $799 for them giving me a diagnostics report , no repair work at all on this 2017 Nissan Sentra for $ 799. Wow !!! Something should be done about the Consumers out here being Robbed and ripped out all for purchasing a brand new Vehicle with a warranty , that expired., wow how convenient. I need help .. please , Now I don’t have a car.. I have a sick mother I cant get to . or my job. Missing work. Help me please…

    2017 Nissan Sentra with 95,000 miles and transmission died. $5500 to replace and they say I’m not eligible for any help paying. How do you join a class action lawsuit or access these benefits?

    I have 2012 Nissan Sentra, transmission fail at 88,000 miles, it cost $2,700 to fix it with 1 year warranty in a “X” mechanic, Nissan should be doing all these repairs for free as is a general problem in all Nissans. I’m never ever ever buying a Nissan again.

    I have a 2013 Nissan Sentra, probably 119,000 miles and transmission broke down. Ever since I purchased it in Tucson, Arizona Thoughbred Nissan (worse experience ever). Brand new, with issues with vibration and took it while being under warranty and staff and everyone there would see me like I was crazy. I wanted to return it within 14 days and they didn’t want to take it back. I didn’t have the money to afford a civil attorney for a legal lawsuit. So I had no choice but to keep it. Now, it has been on my garage for over 6 months and I have no clue what I’m gonna do I can afford over $4.500 to replace the transmission. After seeing all these comments, I don’t know how Nissan is not taking responsibility obviously all Nissan Sentra’s ranging from 2012-2017 DO NOT WORK, DEFECTIVE SINCE DAY ONE. So disappointed, I have told all family members and relatives the bad experience and they will not look Nissan on there next purchase for sure.

    I have a 2015 Nissan Sentra started kinda fumbling on acceleration. Like it wasn’t catching properly (around 55) took it in for oil change
    They did the inspection, told us it was great that tge powersteering needed to be addressed @60k the engine light comes on
    We set an appt for the service asked if we’d be seen and out before 3 the rep says yes
    Got there they say it’s a wait of over an hour can’t tell us when we’d be out .been like that all day(What!!) Couldn’t miss Dr’s appointment
    Call back and ask what the 60k service consists of they say top off fluids oil change balance tires (??? 400$) I say we just got oil changed its not due. Go out of town b4 hitting road back we stop @auto zone to runa diagnostic they say you need a mass air floe sensor , youll make it home but get it fixed when you get back. come back siwa well on highway. Drop my mom off and car is losing power, sputtering hesitating clunking. I think its the gas is too low. The next day we call around to find someone to put this air sensor on as Nissan is sayinf the 7th. we take it to get the 316$ sensor put on and that’s Not it it’s doing the same thing.
    Then we’re told it’s the cvt. Nissan use these as transmissions and they’re junk
    The guy pulls up all types of info on the cvt in Nissan
    We call Nissan
    They say sure we’ll trade it in for you
    Get there and they want us to provide proof that they’re responsible for replacing it for free and who did I rank to that said they were going to do a trade
    Wow
    They sent me home and asked that I gather the info that says they’re liable and they’ll fix it
    Worse car yet!

    I’m having a really bad $4200 transmission problem. While going 45 mph transmission slipped at first then failed. I only have 68000 miles on my 2015 Nissan Sentra. Does anyone have any advice?

    Harry Seldon also is having problems with my 2014 Nissan as far as the transmission is concerned I’m losing power in it and I would like to
    join the class action suit please give more information and use my email address to communicate. The repairs is also going to cost over 4500 dollars. So everybody please join the class action suit against Nissan from years past up until now.

      I have a 2015 sentra. And I was on highway and it lost all power. It only has 68,000 miles

      I have a 2012 nissan sentra, only 113k miles. Not too bad but had a chance to take a trip out of town thinking it would make it. It was shuddering & losing all acceleration & the check engine light came on. We went & had the code read & it was our cvt transmission. It’s going to cost about 4k to even get everything fixed. My car is too old & it was too late for me to file a claim against nissan w/ their final settlement in March. I don’t know what to do but can’t afford to pay out of pocket & need a way to work!

          Mine just died Nov 10, 2022 at 114500 miles. bought it used in 2020 from Ed Martin Nissan dealership in Indianapolis. MFers. still owe money on it.

    I paid for a 2014 nissan sentra, I had a problem with the airflow madd sensor, they Tell me the transmission sensor is broken and it’s going to cost $4200 or more to fix, Please help me?
