NexiumDetails on how to file a claim for the Nexium class action lawsuit settlement have arrived! If you purchased the heartburn medication Nexium in or from Massachusetts since March 2001, you may be able to claim a cash payment from the $20 million class action settlement.

The Nexium settlement resolves a long-running class action lawsuit (Commonwealth Care Alliance, et al. v. AstraZeneca Pharmaceuticals L.P., et al.) that accuses AstraZeneca of deceptively marketing Nexium as superior to its other heartburn drug, Prilosec, and its generic version, omeprazole, in order to get consumers to purchase the more expensive Nexium.

AstraZeneca denies the allegations but has agreed to establish a $20 million class action lawsuit settlement to resolve the litigation.

Class Members of the Nexium class action settlement include any person or entity who, from March 1, 2001 through February 6, 2013:

  • Purchased Nexium in or from Massachusetts, or
  • Reimbursed or paid for Nexium dispensed in Massachusetts, or
  • Reimbursed or paid for Nexium purchased by mail order from Massachusetts

If the settlement is granted final approval, Consumer Class Members will receive 43.38% of the net fund, and Third-Party Payors will receive 56.62% of the net fund.

If you are a consumer, you have two payment options: a flat-rate payment of $25 or a full refund of the amount you paid for Nexium. Uninsured consumers who paid for Nexium with cash can receive $97 per prescription or 54% of the total amount they paid. Insured consumers who paid for Nexium with a co-pay or coinsurance can receive $17.50 per prescription or 61% of the amount paid.

Third-Party Payors will receive an estimated 44.5% reimbursement of the amount they paid.

The only way to receive a cash award from the Nexium class action settlement is to submit a valid Claim Form postmarked, faxed, emailed or submitted online by August 30, 2013.

UPDATE: The Settlement Administrator, Garden City Group, has posted an update that distribution of settlement checks began in late 2013 and is ongoing. Class Members who submitted a valid claim will likely see their checks soon.

    I was an insured consumer, and just received my payment from this lawsuit, more than I’d expected. I took nexium for a fairly short time only. The full notice on their website led me to believe I’d get 61% of my co-pays (the higher of $17.50 or 61%). Here it says 100% in one place and the 61%/17.50 amount in another. I received very close to the 100% amount. Would someone explain to me when one would get the 100% vs. the 61%/17.50?

      I received more than I had expected, but I re-read the info on the site and the last line said if there were not enough claims filed, the ones who did file could get a max. of 3 times their regular claim amount. Hope that helps.

    WOW!!! The checks arrived today, one for my daughter for $458.63 and one for myself (I have been on it a lot longer) for $4,815.57!!!!! Outstanding!!! Thanks Top Class Action for keeping me informed!

    I have taken Nexium daily for ten plus years. I did not know Acid Reflux medication was degenerating my bones. Now I have to take Reclast once year. Along with taking Vitamin D, Calcium and Caltrate daily. Please help me.

      PLEASE BE CAREFUL!! Reclast almost KILLED my mom! It caused her to have kidney failure! (Thats how I found your posting – I was looking for Reclast lawsuits) My mom was in a coma for a week. She recovered, and is no longer on dialysis, but it was very traumatic.

    Please help me get in the lawsuite!!! I been trying for months!!! I am 20 with degenerate disc disease from taking nexium. Have the spine of a 65 year old. Falling apart. Hand and legs go numb at random. Toes was numb for 3 days and just got feeling back in them. Pee the bed because of the shock it sends my body wen I try to get up. Please help me get money for this!!! I need to pay my thinks off before im crippled or there will really be no point in life. Please help.

    BETWEEN NOW WHICH IS 08/09/2013 AND AUGUST 31th. YOU HEAR THE LAWSUIT NEXIUM WILL BE SETTLED. DOES THIS MEAN THAT BOTH OF THE TWO DIFFERENT LAWSUITS THAT IS GOING ON FOR THE PRESCRIPTION DRUG NEXIUM WILL BE SETTLED. ONE IF YOU JUST BOUGHT THIS DRUG NEXIUM ONE IS IN THIS LAWSUIT FOR NEXIUM./ THE OTHER LAWSUIT IF YOU GOT SEVERE SIDE EFFECTS FROM THIS BAD DRUG NEXIUM. SO PLEASE IF YOU KNOW IF THE LAWYERS AND THEIR LAWFIRMS ARE GOING TO BE SETTELING BOTH CLASS ACTION LAWSUITS THAT IS PLACED ON NEXIUM. IN AUGUST OF 2013.
