A Louisiana man has filed an AndroGel lawsuit alleging that within a few months of beginning testosterone replacement therapy using the AbbVie product, he suffered serious and potentially life-threatening injuries.
The testosterone product lawsuit was filed by plaintiff Michael Bourgeois, who began taking AndroGel in July 2010 when he was 59 years old. However, in October 2010, Bourgeois allegedly “developed blood clots, fluid around his lungs and required heart stent surgery … due to arterial blockage and heart failure caused by AndroGel.”
In the low-T gel lawsuit, there is a focus on the increasing marketing campaign used by the drug maker to convince men that they have the condition also known as hypogonadism. The award-winning ads mentioned fatigue, depression and low sex drive as potential symptoms. The testosterone product lawsuit, however, argues that these so-called symptoms are also simply signs of aging.
It is unclear in the testosterone product lawsuit whether or not Bourgeois underwent testing, but he does claim that he “used AndroGel for symptoms he attributed to low testosterone as a result of … advertisements.” He claims that he did not know that there is a risk of testosterone side effects such as heart attack, stroke and the blood clot issues that he suffered from in 2010 linked to the testosterone product.
Numerous studies have been included in the AndroGel lawsuit and they indicate that at a bare minimum, men using testosterone replacement therapy are 30 percent more likely to develop one of these complications than those who were on a placebo. That is the same percentage of men who began testosterone treatment but were never tested for hypogonadism at all.
Bourgeois claims in his low-T gel lawsuit that AbbVie “knew or should have known the defective nature of AndroGel and that persons who were prescribed and used AndroGel for even a brief period of time, including Bourgeois, were at an increased risk of serious health complications such myocardial infarction, stroke, blood clots, and death.”
The Low-T Gel Lawsuit is Michael D. Bourgeois v. AbbVie Inc., et al., Case No. 14-cv-04516 in the U.S. District Court for Eastern Louisiana.
In general, AndroGel heart attack lawsuits are filed individually by each plaintiff and are not class actions.
