ashley-furniture-pay-for-rest-periodsAshley Furniture Industries Inc. has been hit with another class action alleging the company’s DuraBlend upholstery is not fit for ordinary use.

Lead plaintiff Alex Isaac filed a class action lawsuit against the home furnishings company as well as Bargain Discount Markets Inc. alleging that DuraBlend is marketed as a durable leather product; however, DuraBlend furniture is not durable and is prone to peeling and disintegrating.

“Ashley and BD marketed DuraBlend upholstery as durable blended leather,” alleges the Ashley Furniture class action lawsuit. “Indeed, its name is a combination of the words durable and blended, supporting a reasonable consumer’s belief that the DuraBlend upholstery is both durable, and of similar quality, strength, and durability of leather.”

Isaac claims Ashley Furniture began marketing DuraBlend in 2008 as a leather substitute, with the same quality, strength and durability. The plaintiff says that he purchased a DuraBlend sectional sofa for about $1,100 in 2012 based on this marketing.

Contrary to Ashley’s marketing claims, the upholstery on the plaintiff’s sofa began to peel and disintegrate with normal use starting in 2015, alleges the class action lawsuit. The plaintiff says that he contacted Ashley about the disintegration of the DuraBlend sofa, but the store refused to issue a full refund.

This is the second class action to hit Ashley Furniture over DuraBlend. In November of last year, a plaintiff in Florida alleged Ashley “falsely, deceptively or misleadingly promoted, marketed, advertised, and sold furniture with DuraBlend.”

According to the class action complaint, “Ashley provided, disseminated, marketed, advertised or otherwise distributed false, deceptive or misleading information about the true nature, quality, or durability of the DuraBlend upholstery; and failed to disclose material information, or made material misrepresentations about, DuraBlend upholstery in connection with its promotion, marketing, advertising, and sale of that product.”

Ashley sold a variety of DuraBlend furniture, including sofas, loveseats, sections, and ottomans, says the plaintiff. These were marketed as “blended leather products,” alleges the complaint. The lawsuit includes a picture of the plaintiff’s cracked and peeling sectional sofa. Isaac alleges that he and other consumers would not have purchased or paid a much lower price for their DuraBlend furniture if they had known it was prone to peeling and disintegrating under normal use.

The plaintiff in the most recent class action seeks to represent a Class of Massachusetts residents who purchased DuraBlend furniture from Ashley Furniture. The plaintiff alleges that the company violated Massachusetts advertising law.

“Here, Defendants [sic] represented that furniture with DuraBlend upholstery sold to Mr. Isaac and other members of the class had characteristics that it does not have and that it was of a particular standard, quality, or grade, when in fact [it] was of lesser standard, quality, and grade,” alleges the Ashley Furniture class action lawsuit.

Isaac is represented by Josh Gardner and Nicholas J. Rosenberg of Gardner & Rosenberg PC.

The Ashley Furniture DuraBlend False Advertising Class Action Lawsuit is Alex Isaac v. Ashley Furniture Industries Inc. and Bargain Discount Markets Inc., Case No. 1:17-cv-11827, in the U.S. District Court for the District of Massachusetts.

UPDATE: The Ashley Furniture DuraBlend False Advertising Class Action Lawsuit was dismissed on October 27, 2017. Top Class Actions will let our viewers know if a new complaint is filed.

SAME ISSUE WITH DURABLEND! I also sent pix and was told that since my extended warranty had expired they wouldn’t do anything to help me. That’s horrendous! I was never informed of the class action suit against them and when I discovered it I guess it was closed but so unfair! I spent a lot of money on the sectional sofa and loveseat and they are worthless now! PLEASE ADVISE IF ANOTHER CLASS ACTION SUIT IS FILED AGAINST ASHLEY FURNITURE IN WASHINGTON STATE. Thanks so much.

  2. Gilberte says:

Wondering I sustain a foot crushi g injury standing on a defective Ashley table bench last week. I learned later that people have fallen off even from regular seated posiy. Would standing on a table bench be consideredmisuse?

  3. Michael Johnson says:

Same problem with my sofa and love seat, If a class action lawsuit starts again I would like to join.

  4. Carolyn Lumia says:

Had same problem . Love seat and couch both peeled within 2 years. No help from Value City Furniture where I purchased the furniture even after being a customer for over 20 years. Also I contacted Ashley corporate headquarters with no satisfaction.

  5. Antionette Allmon says:

I’m having the same issue. Sofa pealing. Went to local Ashley Store and they could not find me in their system. Yeah, right! Called corporate office to see if the fabric was still available so I could get a couple of yards to get my cushion repaired. Was told they have discontinued carrying Durableblend! Took to upholstery shop to try to repair. They are going to match up fabric as best they can but it won’t be a perfect match. Ashley should be ashamed of themselves misrepresenting their products and lying to their customers. I won’t be shopping there ever again!!!!

  6. Patricia Sutton says:

I have a durablend recliner that has had peeling on every part of the chair except the footrest. The fabric has been replaced on all the parts that peeled and now one of the arms that was repaired is peeling again, in addition to the footrest. I filed a claim and sent photos and they are giving me a harder time now about repairing it. My son had the same issue with a couch, loveseat and recliner and they just gave him a credit. I will never do business with Ashley again.

  7. Carinda Peterson says:

I too bought a couch, loveseat, chair and ottoman from an Ashley distributor in Arizona. It was used in a formal living room. The couch has never been sat on the loveseat was used the most and the chair was sat in 2 times at most as our furniture in our family room is used everyday. There are only two of us. My loveseat is destroyed my chair n ottoman destroyed the couch has never been sat on so no visible damage yet but if it were used, it would be as bad as the others. I am angry, that after spending thousands of dollars and sold leather cleaner when it was nothing more than a cheap version of durablend crap and they win the lawsuit???!!!! Disgusting!! My whole house is Ashley furniture just under 10,000.00$ worth. I want to send the whole kittencaboodle back to Ashley at their expense!!!! To have it reupholstered will cost more than a new set. Screw you Ashley! Karma will pay you back big time!!!

    1. Ade O says:

Yep same thing I bought a sectional from an Authorized Furniture dealer and exactly a year later it started peeling. I went yesterday to an Upholstery Business and they quoted me $2500. It would cost me more that I paid for Ashley’s piece of crap.

  8. SCOTT LESKER says:

    Same freaking issues here.
I was told by the sales lady that it was just as good as solid leather too.
I purchased an extended warranty when i bought the furniture.
When the couch started peeling and cracking, I filled for warranty coverage.
Sent pictures and did everything required and they denied my claim.
Something needs to be done here!
Anybody know why exactly this class action was “dismissed”?

  9. Maggie Patrick says:

I have the same problems as listed above in the other emails. The couch and ottoman are a mess. I have gone to the furniture store and there is nothing they can do. They offered to purchase new seat covers for me. But why purchase them if the same thing is going to happen again. Wish I could join this class action.

  10. Catherine says:

Durablend is the worst product I have ever invested in . Within 6 months the of normal use it started peeling and sticking to us . Looks absolutely horrible . I have to throw blankets over it to be able to sit on it until we are able to replace the set . Couch , oversized chair and ottoman ☹️
