Lead plaintiff Alex Isaac filed a class action lawsuit against the home furnishings company as well as Bargain Discount Markets Inc. alleging that DuraBlend is marketed as a durable leather product; however, DuraBlend furniture is not durable and is prone to peeling and disintegrating.

“Ashley and BD marketed DuraBlend upholstery as durable blended leather,” alleges the Ashley Furniture class action lawsuit. “Indeed, its name is a combination of the words durable and blended, supporting a reasonable consumer’s belief that the DuraBlend upholstery is both durable, and of similar quality, strength, and durability of leather.”

Isaac claims Ashley Furniture began marketing DuraBlend in 2008 as a leather substitute, with the same quality, strength and durability. The plaintiff says that he purchased a DuraBlend sectional sofa for about $1,100 in 2012 based on this marketing.

Contrary to Ashley’s marketing claims, the upholstery on the plaintiff’s sofa began to peel and disintegrate with normal use starting in 2015, alleges the class action lawsuit. The plaintiff says that he contacted Ashley about the disintegration of the DuraBlend sofa, but the store refused to issue a full refund.

This is the second class action to hit Ashley Furniture over DuraBlend. In November of last year, a plaintiff in Florida alleged Ashley “falsely, deceptively or misleadingly promoted, marketed, advertised, and sold furniture with DuraBlend.”

According to the class action complaint, “Ashley provided, disseminated, marketed, advertised or otherwise distributed false, deceptive or misleading information about the true nature, quality, or durability of the DuraBlend upholstery; and failed to disclose material information, or made material misrepresentations about, DuraBlend upholstery in connection with its promotion, marketing, advertising, and sale of that product.”

Ashley sold a variety of DuraBlend furniture, including sofas, loveseats, sections, and ottomans, says the plaintiff. These were marketed as “blended leather products,” alleges the complaint. The lawsuit includes a picture of the plaintiff’s cracked and peeling sectional sofa. Isaac alleges that he and other consumers would not have purchased or paid a much lower price for their DuraBlend furniture if they had known it was prone to peeling and disintegrating under normal use.

The plaintiff in the most recent class action seeks to represent a Class of Massachusetts residents who purchased DuraBlend furniture from Ashley Furniture. The plaintiff alleges that the company violated Massachusetts advertising law.

“Here, Defendants [sic] represented that furniture with DuraBlend upholstery sold to Mr. Isaac and other members of the class had characteristics that it does not have and that it was of a particular standard, quality, or grade, when in fact [it] was of lesser standard, quality, and grade,” alleges the Ashley Furniture class action lawsuit.

Isaac is represented by Josh Gardner and Nicholas J. Rosenberg of Gardner & Rosenberg PC.

    We also purchased an Ashley Sectional and it’s tearing from the seams, cracking and peeling. We just finished paying it off and now have to buy a new couch. It’s just ridiculous! Please keep me posted with any updates.

    Bought the beige linen fabric section. It is not any better. The fabric has to constantly be SHAVED!! It needed it Four months after we bought it and needs it more. So disappointed and this crap they call furniture these days should just be called trash. That’s were it will be in a short matter of time. I wish I could add a picture to this.

    I bought Durablend leather couch, loveseat & kitchen set with leather durablend material.

    The couches are falling apart and peeling and the kitchen chairs are cracking.

    Only my husband and I use the furniture and this should not be happening.

    Ashley furniture company is deceitful. The salesman told us that the furniture was of quality material. I tried and tried to resolve the problem with Ashley but gave me the ru n around. They now claim after 5 years my warranty is over.

    No furniture should peel and crack this way.

    I want my money back.

    My wife and I are still waiting for our hopefully leather furniture, We purchase August 1st 2020 it’s not due till oct 19th 2020 date already rolled back two weeks I’m hoping when this comes this will not be another sad story. Signed afraid!!

      Please request a refund. I purchase beautiful two piece living room and now the couch has started to peel. Very disappointed. Really bad lesson to learn.

    My wife and I purchased a sofa and loveseat from our local military base NEX. They sold furniture with the brand name Ashley Furniture. Both our sofa and loveseat are peeling and cracking where I sit the most. We where under the impression that we were purchasing leather furniture for our home. We are very disappointed with this purchase.

      We have the same problem with the chair and ottoman. Not only there, but our dining room table is flaking. They replaced it once due to the flaking, and they assured us that it was a fluke. We got the replacement, and it started doing it too. The warranty told us that they will not fix it.

    Purchased the same durablend product from Layton, Utah Ashley store. Several places have been peeling and flaking off. Sofa and love seat look brand new except for this issue. So tired of corporations who knowingly sell poor quality prodict and do nothing on the backend for their customers. Sadly, I will never refer anyone to Ashley, and never say anything positive to anyone about Ashley. Their online messaging app fails to work, the people in-store have no ability to do anything other than look up in their computer for sales history. This is Ashley’s fault, they used and sold a low-grade product, and have done nothing for anyone unless you’re a social media influencer!

    We have the same problem with a Recliner we purchased from Ashley Furniture. We bought a leather sectional that is fine, but the recliner is peeling like crazy. Of course it didn’t start peeling until the one year warranty period had passed.

    I all purchased leather sofa, loveseat and leather is peeling. We should all file another class action law suite against ashley furnture again. I will be giving poor reviews on all social medias

    Ashley Furniture sold me a durablend recliner stating the material was better than leather! What’ll I! They guaranteed if anything would go wrong with the chair and it was unable to be fixed money would be reimbursed in full to the card that it was purchased on or by check if you wrote a check or by cash and it was highlighted in yellow on my paperwork by the sales agent Andrew! I have told him that I was visually impaired and could not read the small print and he reassured me as well his his manager not to worry that they stand behind every piece of product they sell and that this has been proven to be good furniture with exceptional fabric that is partly made from leather and partly made from another material. I was told that the leather was on the main parts of the recliner and the other portion of the recliner was the non leather but was a very strong sturdy material that was like naugahyde and would last for many many years. I informed the sales agent Andrew and his manager that I was purchasing this for my 90 year old mother. She uses it when she watches television it has been well taken care of and it is always covered with a blanket to protect the material and to keep it looking pretty! However, the reclining mechanism and the Locking arm was making such a noise we had to have Ashley Furniture send out a mechanic to fix the chair. The mechanic that came out said pray for your chair! Now a year after that and about two and a half years after purchase the chair arm is starting to crack! I also purchased a five-year extended warranty. Calling Ashley Furniture they’ve informed me that the chair had been knowing of being recalled years before being placed on the floor for sale! I asked why it was they put a such a shameful piece of garbage on their store floor for sale when they already knew it had been recalled and not informing customers of the recall!?! I was given the song and dance that they would have me take pictures give me a full refund within four to six weeks I could expect the refund. Well guess what no refund! Store credit only! Why in the H would I want to buy from this company again when they deceived their customers and falsely advertised durablend to their customers and then broad face punch a recalled item out on their store floor for sale!?! They need to be forced closed they need to be forced to pay back all the money people are paying out of their pocket book! I am going to try and fight this! Who is with me?!? I bet every one of you who have loved the negative feedback comment like you have are wanting to stand in line together! Let’s take them all the way through the top core! Plaster Facebook plaster the news media Blaster everybody we can in order to get our money given back to us! They are a travesty! Now my poor 93 year old mother is needing a new recliner and what am I supposed to do? Now we are faced with a pandemic can’t have any material sent in can’t have any purchases made of furniture and have them delivered! So now what what are we supposed to do? My poor mother having to sit in a recliner like this! They need to be so ashamed of themselves for what they have done! Shame on you Ashley Furniture! I hope the salesperson Andrew is no longer with Ashley Furniture if he is he’s just his deceiving as Ashley Furniture themselves! By the way I purchased this in Rockford Illinois on East State Street at Ashley Furniture! I highly suggest no one going to Ashley Furniture to purchase anything from them! They are very deceiving! They fault advertise! They convince customers to buy things that are trash! Nothing but garbage! So sad that companies like this take advantage of people! Again I say why the H would I want to buy something else from a company that is so deceiving that they steal your money! Thanks for hearing me out I know this is long-winded but boy does it feel good put that information out there for other people to read I hope this is help somebody to stay away from Ashley Furniture on East State Street in Rockford Illinois!
