MyCashNow Text Spam Class Action Lawsuit

According to the class action lawsuit, MyCashNow “has caused consumers actual harm, not only because consumers were subjected to the aggravation that necessarily accompanies wireless spam, but also because consumers frequently have to pay their cell phone service providers for the receipt of such wireless spam.”
The class action lawsuit claims consumers received the following unsolicited text message from MyCashNow on or around December 6, 2011:
DO YOU NEED UP TO $5000 TODAY? EASY QUICK AND ALL ONLINE AT: WWW.LEND5K.COM 24 MONTH REPAY, ALL CREDIT OK. REPLY STOP 2 END.
The lead Plaintiff in the class action lawsuit is seeking a minimum of $500 in damages for each unsolicited text message received from MyCashNow, which is the minimum penalty allowed under the Telephone Consumer Protection Act (TCPA). The TCPA prohibits companies from sending unsolicited text messages without the prior express consent of recipients.
The MyCashNow text spam class action lawsuit is brought on behalf of all persons in the U.S. and its Territories who received one or more unauthorized text message advertisements from Credit Payment Services or MyCashNow.
The case is Flemming Kristensen v. Credit Payment Services, Inc., f/k/a MyCashNow.com, Inc., Case No. 12-cv-00528, U.S. District Court, District of Nevada.
