Motorola Hit with Second Class Action Over CLIQ XT

An angry Ohio customer has filed a class action lawsuit against Motorola Mobility, Inc. for allegedly failing to upgrade the CLIQ XT mobile phone as promised.
Plaintiff Jack Haught claims in the CLIQ XT class action lawsuit that Motorola promised to upgrade the operating system for the phone, which was sold with an Android 1.5 operating system.
Google has since upgraded that system three times, according to the class action lawsuit, yet Motorola won’t update the CLIQ XT to the current operating system.
Haught is asking the Court to make Motorola refund his expenses for the CLIQ XT, which he says cannot handle popular website like Facebook or manage services like gmail.
This isn’t the first class action lawsuit Motorola has been hit with over its bunk CLIQ XT operating system. A class action lawsuit seeking to represent all U.S. individuals and entities that purchased the CLIQ XT prior to February 2, 2011 was filed last September. The newest case is Jack Haught v. Motorola Mobility, Inc., Case No. 12-cv-2515, Illinois Northern District Court, Cook County.
