Woman passing room key to a guest at check-in desk of hotelMontage Hotels and Resorts LLC is facing a California unpaid wages class action lawsuit from a California woman, alleging the resort company had regularly denied employees overtime rates and regular state wage rates.

Plaintiff Jennifer C. is filing this California unpaid wages class action lawsuit on behalf of herself and other California employees who worked at Montage Hotels and Resorts in the last four years.

Jennifer, who worked for Montage as a reservation agent, is acting as the lead plaintiff in this California unpaid wages class action lawsuit. She alleges Montage Hotels and Resorts failed to pay her and other employees for all hours worked. She claims the company did not pay overtime for overtime hours worked and also paid below the California minimum wage rate.

Jennifer also alleges the company purposefully did not record all hours she and other employees worked, and did not provide them required meal breaks or rest periods. According to the California unpaid wage class action lawsuit, Jennifer alleges Montage Hotels and Resorts recorded time by requiring her and other employees to sign in and out of work on the company’s specific timekeeping system by swiping cards the company issued.

Rather than paying for all hours worked, the resort company allegedly had a policy of rounding all time entries to the nearest 15 minute time increment. For this reason, Jennifer says she and other employees were scolded heavily if they arrived late.

In addition, Jennifer alleges Montage Hotels and Resorts regularly required employees to work off the clock without pay. Jennifer allegedly decided to file this California unpaid wages class action lawsuit after discovering numerous other employees had similar experiences.

Overview of California Employment Policy

Jennifer argues each of these claims would violate California labor laws, which are some of the most progressive employment protection policies in the United States. Under California employment law, non exempt employees must be paid a minimum hourly rate of $10.50 and must be paid one and a half times their regular rate for hours worked over 40 in a single workweek or over eight in a single work day.

In addition, California labor laws also require non exempt employees receive a 30 minute break every five hours and a 10 minute rest period every four hours. During the 30 minute break, the employee must be able to leave the work premises and not perform any work.

If the employee is forced to work during either their meal break or rest period, the employer must compensate the employee by adding one hour of extra pay on their paycheck. In addition to California unpaid wages that Montage Hotels and Resorts allegedly owes, Jennifer also points out the company failed to produce sufficient wage statements.

This is in violation of the California Labor Code, which not only guarantees a minimum wage rate of pay for non exempt employees, but also requires employers to keep accurate wage records and give employees accurate wage statements.

Jennifer is filing this California unpaid wages class action lawsuit on behalf of herself and numerous Class Members who have worked for Montage Hotels and Resorts LLC in the past four years. Jennifer is seeking compensation for all hours worked, along with any other damages for missing meal breaks and rest periods.

This California Unpaid Wages Class Action Lawsuit is Case No. 8:18-cv-00151-DOC-PLA, in the U.S. District Court for the Central District of California.
