Update screen of Microsoft Windows 10.Microsoft Corporation is facing a class action lawsuit claiming the forced Windows 10 operating system upgrade destroyed consumers’ hard drive or caused the loss of data.

According to the Microsoft Windows class action lawsuit, Microsoft released the latest version of Windows 10 in July 2015 and offered all users a free upgrade.

Plaintiffs Stephanie Watson, Robert Saiger and Howard Goldberg allege that Microsoft aggressively advertised the free Windows 10 upgrade to users by causing a Windows 10 icon and popup reminders to appear on their computer screens.

The plaintiffs claim that the Windows 10 popup reminders would appear multiple times per day, providing the consumer with the option to either “Upgrade Now” or “Upgrade Tonight.” If the user does not want to select either of these options, he or she can click on an “X” to dismiss the popup.

However, even if the user clicks the “X,” the popup will appear again at some point during the day, the Windows 10 class action lawsuit states.

“The Windows 10 popups have no provision for their refusal or removal,” the Microsoft class action lawsuit says. Some users reportedly have sought professional IT help to prevent the annoying Windows 10 popups from appearing on their computer screens. Others have used the internet to find out how to remove the Windows 10 icon and stop the popups. However, these attempts were not always successful, according to the Windows 10 class action lawsuit.

“A great number of people have installed the Windows 10 system inadvertently or without full realization of the extent of the download,” the Microsoft class action lawsuit alleges. “Once downloaded, the Windows 10 system does not have an option for its deletion.”

Windows 10 is also capable of installing itself without the consumer taking any action, according to the Microsoft class action lawsuit.

Windows 10 can be deleted, but it is not easy to figure out how to do it, according to the Microsoft class action lawsuit. Most users will be unable to do it on their own and will need to seek assistance from an IT professional. The plaintiffs claim only about 10 percent of users are sufficiently computer-savvy to be able to figure out how to disable the popups or uninstall the Windows 10 upgrade.

“Also, a user only has 30 days to find out how to delete the Windows 10 application or else it becomes permanent,” the Windows 10 class action lawsuit states.

The plaintiffs claim that the Windows 10 installer does not check the computer system for compatibility before installing the operating system, and, as a result, many users have reportedly experienced hard drive failure or had their existing software rendered inoperable after Windows 10 was installed.

According to the Windows 10 class action lawsuit, many consumers have had to pay to replace or repair their computers after Windows 10 was installed. As a result, they have allegedly lost time and money and experienced significant aggravation as they attempted to recover their lost data.

The plaintiffs seek to represent themselves and a Class of all persons in the United States (except those in Louisiana and Puerto Rico) who had the Windows 10 upgrade installed on a computer that had Windows 7 or an earlier operating system, and who suffered loss of data or damage to their software or hardware within 30 days of installation.

    I just got is refurbished hp 14 stream laptop and i did what Windows want and now my computer isn’t working!! I want join this lawsuit for not ONLY for my 14 stream laptop but my other 15 laptop that had Windows 8

    Keep me updated on when the verdict for this comes through; Microsuck owes me for bricking my motherboard and corrupting it’s bios with the forced update.
    Windows 7 to Windows 10 and would no longer boot immediately after installation.

    I too have been a victim of this window 10 disabling my computer. Once clicked on it, it removed my CDrive. After 3 techs tried to help, it still did not work. They returned my computer back to factory default and I lost everything on computer. I want to join this class action suit. This makes me so upset and Microsoft still has found no solution.

    When my computer was forced to upgrade from Windows 10 version 1703 to 1709 it ended in an infinite boot loop of trying to restore previous version then reboot.

    I have just discovered (8th July 2018) that there is a known issue with version 1803 and Intel SSD and Toshiba SSD drives and that there is a patch to resolve the issue. I now believe the issue was with 1709 as well at the current 1803 version.

    Any patch is totally useless if you cannot boot the computer in the first place.

    I bought a new hard Samsung SSD and installed Windows 10 version 1703 after having many issues with version 1803 even after all the updates.

    Surely there are tens if not hundreds of thousands of people affected by these issues but they cannot complain as they either do not have a working computer or are not aware that Microsoft did not thoroughly test the upgrades before forcing them on people.

      Hi

      That very recently happened to my Fujitsu laptop. It was my secondary laptop, now it useless. And the only reason why is because when I shut down I didn’t select update and shut down yet it still pushed the install.

      On top of that, the only reason that I was during it is because the same update completely deleted my documents on my primary laptop (Asus) and I was told by Microsoft’s Tier3 support that I had to take it into a Microsoft store which is practically in another state. This is because everything they have done over remote access didn’t work and that maybe the store could fix it. The guy also told me that my situation is the worst case scenario because all of my documents are unrecoverable from what Tiers 1, 2, and 3 support.

      I now have no current resumes, no recent grad school papers, and other important documents because I have no computers.

    Please add me to the complaints I have gone in 2 the computer and disabled upgrade and it turns itself on again over and over again so every night it tries to reload upgrades and I have to start all over again

    I PLAN TO SUE MICROSOFT AS WELL, WINDOWS 10 IS A SPAM.
    ALL THE TIME UPGRADES, WITHOUT ALLOWING THEM, THEY UPGRADE THEIR VERSION.
    I WONDER WHY ALL THESE UPGRADES?
    YOU LEAVE YOUR COMPUTER OPEN AND SEE THEIR UPGRADES START TO POP UP, I BELIEVE THEY SPAMMING OUR DATA, IS ALWAYS A WASTE OF TIME, ANGER AND EVEN MY COMPUTER SCREEN LOOK DIFFERENT FROM TIME TO TIME, LIKE I SEE WRITING IN CODES.

    HOW CAN I SUE THEM OR ENTER MY NAME IN A STELLMENT IF IS THERE?

    Week of 2/5/2018 Windows 10 attempted an upgrade on my wife’s business computer and it failed. Now computer will not boot and I am unable to talk to the bios. There is no Microsoft support for a problem their software created. They let the user find the bug in their product and do not care.
