Maybelline has been hit with a class action lawsuit claiming its “Super Stay” lipstick and lip gloss don’t last as long as promised. The complaint accuses L’Oreal SA of falsely advertising the staying power of both products, which sell for about $9 each.
According to the Maybelline Super Stay class action lawsuit, filed by three women in Manhattan federal court, L’Oreal and Maybelline make “misleading, inaccurate and deceptive” advertising claims regarding its “Super Stay 14HR Lipstick” and “Super Stay 10HR Stain Gloss.”
The products are advertised as having “super staying power” that “won’t fade,” but that’s not the experience the Plaintiffs had with the products. According to the class action lawsuit, “the Super Stay products do not remain on the wearer’s lips for the extended periods as advertised” and “wear off and fade after only a few hours of wear.”
One of the Plaintiffs claims the so-called long-lasting lipstick wears off as soon as she eats a meal or has a drink.
The Maybelline Super Stay lipstick class action lawsuit is seeking more than $5 million in damages for a proposed class of consumers who purchased the makeup based on advertising statements about their “super staying power.” It is alleging unjust enrichment, breach of warranty and violations of various consumer-protection laws.
The L’Oreal Maybelline Super Stay Lipstick Class Action Lawsuit case is Carol Leebove, et al. v. Maybelline LLC, Case No. 12-cv-07146, U.S. District Court, Southern District of New York.

The old, discontinued ones last a LONG time. The next morning, I still have pink on my lips! I still buy those on eBay. I haven’t purchased the new ones yet. Now, I WILL NOT.
I can’t believe anyone, man or woman would be STUPID enough to pay $9.00 for lipstick . LOL
I’ve purchased several of this product, while I love the color I hate that it does not stay as promised especially if you eat or drink anything and reapplying makes the product flake horribly :(
I too was very disappointed. when I bought them I bought 3 of them. Lots of money for lipstick that wouldnt last :()
Yes!!! The SuperStay lipstick with the balm on one end and the liquid on the other DOES last for a long time…I have to use a toothbrush on my lips to get it off in the morning. But these two are horrendous!
I was never one who bought into the whole “class action lawsuit” thing and usually even if I had purchased the product I was just like oh well, you live and you learn and I got some use out of the product so I did not care that I had wasted the money. However, I did purchase two of these products and was very displeased. They DO go away after one meal or drink, and hardly even that. I was so excited to get them and try them and when I did I was very let down and that hurts when you are paying so much for a product. I’m glad someone made them take responsibility for their actions.
Are you kidding me??? A class action lawsuit?? You bought some lip stick that didn’t “stick” as long as it was supposed to…big deal. So, don’t buy it again or return it. Most stores have satisfaction guarantees regarding makeup. GET A LIFE!
Good for them! I was so disappointed after buying them. I gave up my morning coffee at DD just to have it and it certainly wasn’t worth it :(
I had purchased 3 different colors and shared/gifted with my grown daughters all of us came to the agreement it was misleading and wore off after we all drank or ate!
this is a true statement the lipstick does not perform the way Mabelline states it is not worth the money they charge
