match-logoMatch.com was hit with a class action lawsuit alleging that the dating website forces customers to enter into contracts without giving them a way to cancel their memberships, which is required under California law.

Plaintiff Zeke Graf claims in his Match class action lawsuit that Match’s “conduct is a scheme carried out by defendant which involves making significant amounts of money from California consumers through false, deceptive, and misleading means” by “unlawfully forcing California consumers to enter into contracts that required said consumers to waive important protections afforded by the California Legislature.”

Graf, a California resident, explains in his Match.com class action lawsuit that he joined Match in 2012 for $30 per month for about three months. When Graf joined Match, he had to give the dating service his personal information such as his name, telephone number, address as well as other information including pictures.

However, according to the class action lawsuit, the state of California makes specific requirements of dating services that “in close proximity to the space reserved for the signature of the buyer, a conspicuous statement in a size equal to at least 10-point boldface” that explains that the agreement may be canceled at anytime “without penalty or obligation.”

The dating service is also supposed to include the name and address where a person may send a letter for the purpose of canceling the agreement.

But the Match class action lawsuit alleges that this was not the case — not only was the clause not included, there was also no name and address by which the contract could be canceled.

“In fact, [Match’s] contract explicitly stated that [Graf’s] subscription with defendant would remain active until the end of the plaintiff’s subscription period following plaintiff’s cancellation of said dating service contract,” Graf explains in his Match.com class action lawsuit.

Graf claims that this was not just the case for him but for other Match.com customers as well.

“Consumers were [deceptively] deceived into believing that said consumers had to incur fees and costs to defendant while said consumer’s subscription was coming to an end,” the class action lawsuit adds.

The California man is looking to represent a class of California residents “who purchased a subscription from [Match] via [Match.com] that failed to include the Notice of said consumer’s right to cancel the contract with defendant within the four years prior to the filing of this complaint.”

The Match class action lawsuit accuses the dating service of violating California business law by allegedly “forcing California consumers to enter into illegal contracts for dating services,” as described above; and he charges Match with violating California’s Unfair Competition Law including the unlawful, unfair and fraudulent prongs of that law.

And the Match.com class action lawsuit claims that the dating service violations of California law “were knowing and intentional.”

Graf is asking that the proposed class members be awarded damages “in the amount of the subscription payments made by them.”

    Please – please let us know how we can pursue a lawsuit. They charged me $84.89 after I specifically clicked Do NOT Renew the membership 2 months in advance of its expiration. They said my account was never Cancelled, but that was never mentioned in the instructions for stopping Auto Renew. I did everything right to stop the renewal. They are running a scam. Multiple attempts to get a full refund were unsuccessful via both email and phone. They are now blocking my emails that I’ve sent in an attempt to get a refund. Customer Service is useless. I’ve never encountered such an unethical firm before in my life.

      Please please help us to sue Match.com. This is a scam dating site. I’m the same like other people . I signed up with Match.com for 6 month May 2017 . I didn’t plan to sign it up for other six months again but it was automatically renewed without my permission.
      Match.com knows that many fake profiles and scammers are active on their website but not protect users and never mention for these words “fake profiles and scammers” on the page I signed up.
      I’m a victim. A fake profile on Match dating site. I reported to Match but they don’t care the money I lost close to $280,000.00
      I posted this message ask for help to sue Match.com also help other victims.

    Same thing happened to me. Halted all activity on the site on 10/10/16 and clicked on everything I could find to cancel account. Was charged an additional 80.90 for four quarters until my credit card company caught it. I’ve gone round and round with customer service requesting a refund of $323,60 with not success. I was contemplating initiating a class action suit of my own. Alternatively, I’d like to join this one. Please tell me how I can sign up.

    I am going through this AGAIN although I was promised it was cancelled 2 other times. Will be going over all my statements the last 2 or 3 years to see all the times the $71.97 was charged every 3 months!!!

    Hopefully a lawyer gets interested because the “robot” – ONLY person you can talk to – will not give you any other options, phone numbers so you can follow through. This time he (Mcgee) said, no one can give you any more information because your account was all deleted due to no activity!!!!

    I was charged the 6 month auto renewal 3 times before I caught it on my credit card statement. I was sure to cancel the renewal as this was something I had herd was a problem with the dating online websites. I pressed to speak with a manager or supervisor and was read a scripted answer as to why it was not possible to speak to a manager. the customer service agent was kind and said she sent an email to corporate and we waited a minute for the response they said I could have a partial reimbursement . I then said I would be contacting the BBB and possible lawyer for a class action suit for not contacting me when they charged my credit card. I asked again to speak with a manager cs sent another email to corporate and they agreed to the refund of the latest $119 6 mos subcription. I was satisfied with that but now I see this lawsuit I will be keeping an eye on.

    Hello, I had cancelled my subscription months ago but I got charged for another 6months. I want my money back, I just noticed that match had taking money from my debit card and they told me that my subscription was cancelled. Apparently not, so I need help in this matter. Please help..

      THIS HAPPENED TO ME TOO!!!
      I haven’t had a subscription in OVER FIVE YEARS. I know, because that’s how long I have been with MY HUSBAND. I went through what appeared to be an official account deactivation, again, this week after I started getting Match report emails. Guess what I am still getting after deactivating my account?

    I have been charged $120 for a 3 month membership. I tried cancelling the same day. Match refused to refund anything. I cussed the lady out . Now my account has been removed for harassment. I’m 5 days into a 3 month membership. Praying this company goes under.

      They just did the same thing to me…I called and asked to speak to a manager about the charge and was told that it can be reduced but I would not get a full refund back. I checked reviews online and found that there was a lawsuit back in 2012 for that same thing.

      The exact thing happened to me. I never utilized the program, agreed to give cc for trial and the 6 month cost of $130 not knowing in 6 months they would recharge your card and REFUSE A FULL REFUND. They never credited me the partial refund they promised this has cost much more in interest, in time wasted, I was traveling internationally and was on phone w/my credit card company for over an hour. This is unacceptable, and apparently a common problem. If you sign up log onto your account and immediately de-activate your account so they can not process an auto pay. I’m still yet to get my partial refund. It was a waste of $130 that I accepted initially to realize internet dating was not for me personally but to pay $260 is outrageous. I’m in Hawaii, it seems like they can easily get away with this scam. Your profile never goes away, they use it on their website as false advertising. This kind of stuff is so wrong! When I read for how many years they’ve had this practice and even a class action law suit but continue to engage in the same behavior is horrible. To prey on people like this is disgusting. DO NOT GIVE THEM YOUR CREDIT CARD NUMBER UNLESS YOUR PREPARED TO FOR AUTOMATIC RENEWAL EVERY 6 MONTHS IN THE FULL AMOUNT. WHETHER YOU USE IT OR NOT.

      Be sure to deactivate your account or they will recharge it. I never used it, signed up for “free trial” gave cc number and agreed to pay $130 for 6 months. I never used match.com, never logged onto their site, figured I paid $130 to learn internet dating was not for me. Then 6 months later I’m paying my cc bill and see another charge for $130 on cc bill. My cc company was on the phone we did a 3 way call they refused to refund any amount. After an hour they said they would give $80 partial refund and cc company suggested accepting that amount. This is now 3 months later, I have not been credited. My cc company disputed and credited full amount now I just got letter stating Match provided supporting documents for full charge and was just re-charged full amount. This is an absolute SCAM!! I have spent more time with phone calls and frustration to no results to get a pathetic amount of $80 refunded on something I never authorized. Learning lesson, always take time to read small print. DO NOT SIGN UP WITH MATCH IT IS A SCAM. I WISH I WOULD HAVE RESEARCHED THIS BEFORE. I WISH ANYONE HAVING PROBLEMS WITH THEM GET THEIR MONIES BACK AND FIND LOVE THE OLD FASHION WAY. TAKING ADVANTAGE OF PEOPLE LIKE THIS IS DISGUSTING.

    I recently discovered that Match.com has been charging my credit card account 2 times per year, after I cancelled my membership 2 years ago. My credit card company disputed the charges and Match.com’ s response was “You can’t prove it.” So now I’ve had to cancel my card and I badly want in this class action lawsuit. What steps do I need to take?

    Same here. Thought I canceled 6 months ago, got another charge and offered a partial refund to switch to a monthly membership. Where is the class action lawsuit for this business practice?

    I also canceled the Subscription and was charged again. I called them as soon as I got my charge card bill and was told there would be no refund. I will dispute the charge however, they claim they will fight it. They are a scam.

    When I tried to cancel my prepaid account (several months remaining on 6 months) due to medical illness, the site apparently led me down a rabbit trail. I thought the account was cancelled and did not expect to be automatically billed $89 to renew my subscription. On July 5th I was billed the $89 and I immediately contacted the company and told them that I cancelled my membership. They responded that my membership was inactive but not cancelled, and that there was nothing they could do about it except change my membership to a monthly billing and refund $43 of it. I was upset, but agreed that they could refund the $43, however, they haven’t done this either after a week. I guess that was just another lie. They have lost a long time paying customer. I have been a paying customer for years! I guess that about sums up the whole experience, no relationship… no refund! What a scam!

      I joined match.com in January of 2015, a 3 month subscription for $68. I was disappointed in the service and wanted to cancel. Unfortunately, I did not cancel in a timely manner before they charged my credit card for an additional 3 months. There was no getting a pro-rated refund from them. I had to do some investigating on how to cancel my subscription as it was not obvious. When I discovered how to cancel, I followed all the steps to cancel my membership. Never thought another thing about it.

      This past Friday I received an email from my credit card company wanting me to verify the charges on my card were legitimate. I noticed a charge from match.com. I called my credit card company to dispute this charge. After scouring over previous credit card statements I see that match.com has been charging my account every 3 months after I terminated the account for $68. A total of $350! I have spent hours today trying to secure a refund. Match wants to offer me $18.01 and another month (Why would I suddenly want to use a service that I cancelled due to dissatisfaction?). That is unacceptable. They are saying I never cancelled the account- which I specifically remember doing as I had to research how to do it! As far as I am concerned there is no doubt that this company scams customers. I am contacting my Consumer Affairs for advice in the morning. I am just furious over this deceptive, unethical business practice.
