A Maryland man has filed a new Roundup cancer risk lawsuit against the manufacturers of the Roundup weed killer product, the Monsanto Company, after he developed non-Hodgkin’s lymphoma allegedly from using Roundup.
Plaintiff Ronald T. filed the Roundup cancer risk lawsuit in Missouri federal court on Jan. 23, 2018. According to his complaint, Ronald alleges that like many others, he developed cancer due to the product’s allegedly defective and dangerous carcinogenic nature. He also claims he could have avoided these injuries with a proper warning from Monsanto.
Ronald, a resident and citizen of Charles County, Md., says that he developed non-Hodgkin’s lymphoma as a “direct and proximate result of being exposed to Roundup.” He also claims that he was completely unaware of the side effects exposure to Roundup may cause, and that he could not have known even through “reasonable diligence” that Roundup and the product’s main ingredient, glyphosate, could cause the development of cancer.
The Roundup cancer risk lawsuit is filed on multiple counts including design defect, failure to warn, negligence, fraud, misrepresentation, and suppression, among others. Ronald demands a trial by jury.
Roundup Cancer Risk Overview
Monsanto began marketing Roundup in 1974. More recently, thousands of consumers have filed lawsuits in federal and state court due to Roundup’s alleged link to the development of cancer, including non-Hodgkin’s lymphoma. More than 1,100 lawsuits have been filed, particularly among gardeners and laborers who are most at risk for Roundup product exposure.
Among the adverse side effects at issue is the development of non-Hodgkin’s lymphoma, a cancer which begins in the body’s white blood cells, known as lymphocytes. White blood cells are present in the body to fight off diseases and infections. They are part of the body’s immune system. Some signs and symptoms of non-Hodgkin’s lymphoma include fever, weight loss, anemia, shortness of breath or cough, enlarged lymph nodes, chest pain or pressure, and a swollen belly.
Plaitniffs like Ronald allege Monsanto misinformed and continues to misinform the public and government agencies of the safety of Roundup. Although Monsanto’s Roundup weed killer is one of most commonly used herbicides worldwide, many users have claimed to develop cancer from the product’s exposure. Plaintiffs allege Monsanto knew of the risks glyphosate presented to consumers but decided to refrain from publicly informing the public of these warnings.
Several agencies have recognized glyphosate as dangerous to consumers. For example, according to the International Agency for Research on Cancer (IARC), part of the World Health Organization (WHO), glyphosate has been labeled a chemical that is “probably carcinogenic.” The IARC based its findings after clinical studies that showed that glyphosate causes DNA and chromosome damage in human cells.
The United States Environment Protection Agency has also said that “glyphosate ranks high among pesticides causing illness or injury to workers, who report numerous incidents of eye and skin irritation from splashes during mixing and loading.”
The Roundup Cancer Risk Lawsuit is Case No. 4:18-cv-00108-NAB, in the U.S. District Court for the Eastern District of Missouri, Eastern Division.
