Man Files Lawsuit After Unum Long-Term Disability Claim DeniedA South Carolina man recently filed a lawsuit against Unum Life Insurance Company after his Unum long-term disability was denied, alleging the denial was improper.

The plaintiff, Montague O., was employed at a company that provided Unum long-term disability insurance. Unfortunately, he became disabled and was forced to stop working in July 2016, according to his complaint. He filed his Unum long-term disability claim in order to receive his benefits, but was denied.

According to the Unum lawsuit, this denial was improper. Montague says that while Unum was both the insurer of the plan and the entity in charge of deciding whether or not a claim should be approved, presenting a conflict of interests, the lawsuit claims. This conflict of interest influenced the Unum long-term disability denial, Montague alleges, rather than the decision being solely based on the evidence provided for the claim.

When his Unum long-term disability claim was denied, Montague initially responded by appealing the denial. However, his appeal was rejected. At that point, having exhausted all administrative means of combatting the Unum long-term disability denial, Montague turned to litigation.

Through this lawsuit, Montague hopes to be granted the benefits he alleges he was unfairly denied. He filed his Unum long-term disability lawsuit on April 27, 2018 in the U.S. District Court for the District of South Carolina.

Montague is not the first person to have been denied Unum long-term disability benefits he should have received under Unum policy. Some who have become disabled seek reinstatement of their disability benefits by pursuing all the administrative means available to them, including filing appeals to reverse Unum’s decision.

However, even when a person attempts to appeal in this manner, Unum may still deny their appeal. If the appeal approach proves unsuccessful, some turn to litigation to seek the company’s claim denial reversal going forward.

This Unum disability insurance lawsuit and others like it allege that Unum has unfairly denied the disability insurance claims of plaintiffs who are qualified to receive such benefits. Some lawsuits go further, alleging that the company purposely denied the claims of hundreds of thousands of workers with legitimate disabilities for no reason other to increase company profit.
