LG Refrigerator Class Action Lawsuit Mostly Upheld, Partially Dismissed

LG Refrigerator LawsuitA California federal judge has upheld parts of a class action lawsuit against LG Electronics USA Inc. alleging that refrigerators made by the company came with a programming defect that caused food to spoil.

In October 2011, Jeanette Clark bought an LG refrigerator (Model No. LFX31925ST) for around $3,000. It came with LG’s “Smart Cooling Plus” system, which was advertised as a unique system “to keep your food fresh.” It also came with the LG Slim SpacePlus Ice System, which is located in the door of the refrigerator. It is supposed to provide more space for ice than other refrigerators.

 

According to the class action lawsuit, Clark began having problems with her LG refrigerator after one month. She claims that the ice system was easily clogged and essentially didn’t work. Sometimes when the ice system was clogged, it would burn out the motor, and the entire refrigerator would stop working. When she contacted LG’s customer service, she was told “she would have to empty the ice tray every day in order to prevent the ice system from clogging.”

Clark also claims that the refrigerator would simply stop working at random times and “display various error messages.” LG’s customer service representative told her that she would need “to unplug the refrigerator at least 15 minutes and then plug it back in to reboot the refrigerator’s control board,” she class action lawsuit claims. She claims that this was something would sometimes have to be done multiple times, which she says was quite a hassle.

In her class action lawsuit, Clark claims that LG was aware of these problems when it marketed and sold the refrigerator, but it was never disclosed to her the great lengths she would have to go through to keep the refrigerator working. As a result of the problems she had with the LG refrigerator, water would leak on the floor, creating a safety hazard and causing damage. Further, Clark says she had to throw out a lot of food that would spoil in the process of rebooting the refrigerator.

Clark’s class action lawsuit charged LG with six claims — violation of the Consumer Legal Remedies act, violation of two California Business & Professions Codes, breach of express warranty, breach of implied warranty and violating the Magnuson-Moss Warranty Act.

U.S. District Judge Jeffrey T. Miller dismissed the entire class action lawsuit in June saying that Clark had not defined the class properly. Clark followed up with an amended complaint in July.

On Oct. 30, Judge Miller issued a partial dismissal of the class action lawsuit. He got rid of the claims that were brought on behalf of “the general public.” He also dismissed the breach of express warranty charges. He upheld most of the fraud and breach of warranty allegations. He said that the class issue was now resolved in the new complaint, showing a clear link between LG’s technological issues to the class.

The plaintiff is represented by Robert W. Thompson, Kathleen M. Hartman and Jessica Lulli of Callahan Thompson Sherman & Caudill LLP.

    LG Model LFX31925ST will not cool, compressor runs but does not function. Very disappointing the Refrigerator looks brand new, everything works except it does not work as a refrigerator or freezer.

      I am having the exact thing happen now and customer support basically said “sorry” and I’m on my own. The unit looks brand new and is great when it runs. I have an LG oven that is out of commission also since using the self clean option. Apprently that is a common complaint with their ovens!

    I have a LG refrigerator LFX31925ST and 3 door ice and water dispenser on the door. It stopped working one day and I had just went to the store to days before. I bought it in 2011 shortly after buying my house in 2010. I was so proud of myself for all I was accomplishing. Then my first LG stop also a 3 door. I bought it about 3 years before that. And now I have 2 LG refrigerator in my home and not one of them work. I am disabled with a bad back. I just had back surgery on October 14,2021. I need to be a part of this lawsuit. Oh and went I sought different repair services no one wanted to work on LG refrigerator “they have to many problems” said one guy.

    My fridge the compressor is going out too having issues with it keeping cold and it wasn’t making ice so I got the ice machine replaced and it still wasn’t had a repair man come out and it was going to be a lot and he told me there was a lawsuit I never got notification and really would like to be able to get my fridge fixed or replaced I have 2 small children and I have to buy their milk out of town due to having special milk for allergies and I hate losing milk and food for my kids due to it going out!

    Add me. Spent $3000 for this fridge and have to empty the ice CJ tents every other day and reach in for ice instead of using dispenser. Constantly clogs. Water leaks on floor from ice maker all the time.
    Now have to keep ice in feeezer.

    Add me to the list. Lost over $500 worth of food. I have had problems with ice maker since the beginning. Faulty design. Now it has stopped cooling. Piece of junk.

    Add me to the list most definately please…Ive had the same issues shortly after purchasing it from home depot over 3000.00 and once again dealing with it now and researching for solutions and came across this recall.

    We just had this same refrigerator go out again and the repairman says it’s going to be a expensive repair luckily we bought home warranty plan. Waiting to hear back from them. Meantime we lost over 300 Dollars in food.

    I have the same problems with Model # LFX31925st.the unit no longer cools either the freezer or refrigerator, even LG’s technician man does not know how to fix the problem. he replaced the compressor but it still never fixed the way it was. the refrigerator does not keeps the food cold enough as well the freezer is not freezing anymore. please add me to the lawsuit or tell me how to do it?
