LG Refrigerator Class Action Lawsuit Mostly Upheld, Partially Dismissed

LG Refrigerator LawsuitA California federal judge has upheld parts of a class action lawsuit against LG Electronics USA Inc. alleging that refrigerators made by the company came with a programming defect that caused food to spoil.

In October 2011, Jeanette Clark bought an LG refrigerator (Model No. LFX31925ST) for around $3,000. It came with LG’s “Smart Cooling Plus” system, which was advertised as a unique system “to keep your food fresh.” It also came with the LG Slim SpacePlus Ice System, which is located in the door of the refrigerator. It is supposed to provide more space for ice than other refrigerators.

 

According to the class action lawsuit, Clark began having problems with her LG refrigerator after one month. She claims that the ice system was easily clogged and essentially didn’t work. Sometimes when the ice system was clogged, it would burn out the motor, and the entire refrigerator would stop working. When she contacted LG’s customer service, she was told “she would have to empty the ice tray every day in order to prevent the ice system from clogging.”

Clark also claims that the refrigerator would simply stop working at random times and “display various error messages.” LG’s customer service representative told her that she would need “to unplug the refrigerator at least 15 minutes and then plug it back in to reboot the refrigerator’s control board,” she class action lawsuit claims. She claims that this was something would sometimes have to be done multiple times, which she says was quite a hassle.

In her class action lawsuit, Clark claims that LG was aware of these problems when it marketed and sold the refrigerator, but it was never disclosed to her the great lengths she would have to go through to keep the refrigerator working. As a result of the problems she had with the LG refrigerator, water would leak on the floor, creating a safety hazard and causing damage. Further, Clark says she had to throw out a lot of food that would spoil in the process of rebooting the refrigerator.

Clark’s class action lawsuit charged LG with six claims — violation of the Consumer Legal Remedies act, violation of two California Business & Professions Codes, breach of express warranty, breach of implied warranty and violating the Magnuson-Moss Warranty Act.

U.S. District Judge Jeffrey T. Miller dismissed the entire class action lawsuit in June saying that Clark had not defined the class properly. Clark followed up with an amended complaint in July.

On Oct. 30, Judge Miller issued a partial dismissal of the class action lawsuit. He got rid of the claims that were brought on behalf of “the general public.” He also dismissed the breach of express warranty charges. He upheld most of the fraud and breach of warranty allegations. He said that the class issue was now resolved in the new complaint, showing a clear link between LG’s technological issues to the class.

The plaintiff is represented by Robert W. Thompson, Kathleen M. Hartman and Jessica Lulli of Callahan Thompson Sherman & Caudill LLP.

      7-1 through 7-7, 21: We just had the same issues and of the ones listed below. $750 to fix it, already replaced the defrost sensor twice within 6 and a yr ago. Service Tech said happens to 50% on this model. Needed to pay $300 on top of the $500 but said LG would reimburse that or maybe would, warranty good for 5-10 yrs on compressor only. We are looking for a new one now, lost over $500 in food as well.

    Nt LFX31925ST unit just lost its linear compressor (I think) since the unit no longer cools either the freezer or refridge. Waiting on repairman to confirm. Can you add me to the lawsuit?

    How do I get added to this list? Compressor went bad, then it started leaking freon. Everything started to thaw out in freezer. I got a new compressor and then it went bad in 4 weeks. I spent a lot of money on this fridge. Please add me or let me know how I can proceed. Thank you.

    After it failed, our repairman advised us the repair was covered by a recall. HOWEVER, neither LG or the appliance store contacted us about a recall.
    Is it too late to be included in this class action lawsuit?

    Er rf error code. I keep unplugging and defrosting but it’s not working. Not cooling properly. Afraid if $650 compressor repair I was quoted!

    Please add me into the lawsuit we have had nothing but problems with the LG refrigerator that we purchased. It is model number LFX31925ST/00 When we first got the unit home the ice maker went out, then the door for the ice broke. Then we continued to have problems with the unit. This last time the compressor went and now LG is saying that in order to have the new compressor installed, I will have to spend approximately $1000-1200.00 to replace the mother board, condenser and some other parts in order for the new compressor to work, which is still under the manufacturer warranty. Even though We have lost food three times and LG’s answer is for us to go by a mini fridge until they make a decision on what they will cover. It has been three months that they have been screwing us around. We purchase a used unit to get by until we can get this resolved. I asked to speak to a supervisor and she told us that they would cover the entire purchase price along with loss of food and any out of pocket for buying ice everyday but said that they needed to consolidate the five accounts they had us under in their system first and that would take 4-6 weeks. Now they are saying that they will only cover the compressor. I will never buy a LG product again and can not believe that they knowingly have an issue and have no problem with screwing people over. Please add us to the lawsuit so we can get back to normal living.

      HAVING ALL THE SAME PROBLEMS BOUGHT THE FRIDGE FROM HOME DEPOT SPEND 3000.00. LIKE BUYING A CAR WITH A BAD MOTOR.

    Add me to that list of my Lg refrigerator model LFX31925ST compressor went out and had to have it repairs and reset. Ice maker problems and first one I got, from Lowes leaked and had to have this one delivered.
