LG mobile phone class action lawsuitLG Electronics USA Inc. has reached a class action settlement with customers who claim that the electronics company sold defective refrigerators, in a settlement could reach tens of millions of dollars.

The motion for preliminary approval of the class action settlement was filed by plaintiff Jeannette Clark on Tuesday in a California federal court.

According to the class action settlement, Clark and LG reached the settlement after extensive negotiations and “it provides substantial relief to many who would have no opportunity to obtain recourse for the damages they suffered.”

Class members in a nationwide class who purchased allegedly defective LG Signature Model refrigerators can receive up to $5,000 to cover the costs of property damage, which includes $500 for spoiled food, money to cover the repair of the refrigerator, a $1,500 credit to purchase a new refrigerator, if the refrigerator cannot be repaired, and an extended warranty.

The total settlement amount will be determined based on the number of class members who file claims.

According to Clark’s attorney’s, if $500 is given to 10 percent of the class for spoiled food and five percent received the $1,500 credit for a new refrigerator that would total $48.7 million.

In addition, Clark is asking for $367,000 in attorneys’ fees.

Clark filed the LG defective refrigerator class action lawsuit in December 2012, alleging that her LG Signature Model refrigerator that she purchased in October 2011  was defective, and that she started having problems after about one month after she purchased it.

According to Clark’s LG class action lawsuit, the ice system became easily clogged, which would sometimes burnout the motor and cause the entire refrigerator to stop working.

She claims that when she contacted LG’s customer service, the representative recommended that “she would have to empty the ice tray every day in order to prevent the ice system from clogging.”

In addition, she alleges that sometimes the refrigerator would stop working randomly and “display various error messages.”

When she contacted LG about this problem, she was told by the customer service representative that she would have “to unplug the refrigerator for at least 15 minutes and then plug it back in to reboot the refrigerator’s control board,” according to the class action lawsuit.

Clark alleges that due to all of these problems she had with her LG refrigerator that sometimes water would leak on the floor, which was both a safety hazard and caused damage. In addition, in the process of having to reboot the refrigerator, a lot of food started to spoil, which she had to throw out.

The LG refrigerator class action lawsuit was dismissed in June 2013 with the judge saying that the class had not been properly defined, but the judge gave Clark leave to amend the lawsuit. She refiled the class action lawsuit in July.

The allegations in the second class action lawsuit included a violation of the California Consumer Legal Remedies Act, two violations of California’s business code, breach of express warranty, breach of implied warranty, and a violation of the Magnuson-Moss Warranty Act.

U.S. District Judge Jeffrey T. Miller dismissed some of the claims in October 2013, including the claims brought on behalf of “the general public” and the breach of express warranty charges. However, he said that the new amended lawsuit resolved the issues in the former complaint, and that Clark had showed a clear link between LG’s technological issues to the class.

In December 2013, Miller ordered both parties to attend and Early Neutral Evaluation Conference in January, which began the settlement process.

    And I am finding that many are not aware that there is a “free” service flash by both Sears and LG that replaces the back Evaporator Fan Assembly Cover. This may improve your situation with error codes and loud noises but it did not yield a repair of the problem for me in being able to cool properly or make ice. I am finding many of you were charged for this “free” service to repair a known defect by the manufacture. Sears will try to charge you a diagnostic fee no matter what to sequentially repair this lemon. Be sure to make firm inquiry into the 90 day guarantees. They tried to biff me to replace a sensor that is a component on the Evaporator Fan Assembly Cover so they replace the cover and then came back and said I needed a new sensor that was just replace as part of the service flash.

    I also encourage all those affected by this class action that did not yield a serviceable refrigerator to file a complaint through their State Attorney General Consumer Complaint office (google it, i.e. Texas State Attorney General Consumer Complaint Office, etc) against LG or Sears Holding Corporation. The State will also advise and assist consumers and minimally keep statistics about the business and their unlawful practices. We must all do more to try to expose the cover ups of both Sears and LG in selling a refrigerator that just will not continually work. Get your service records if you have warranty administrator. That is the first thing unscrupulous servicers will do is to not provide service history so they can prove a product is defective. Or as I am hearing, change the service history or make it so vague it’s hard to prove.

    I have an lg fridge that was installed brand new 7 months ago. The tech repaired yest. 12/12/15 and within 1 hr. The fridge and freezer broke,but this time destroying hundreds of dollars in food. With 3 boys this is a huge issue. I have spent 1.5 hrs building my family our dream home, now the flooring around the the fridge is all soaked and probably Ruined as well. I want my whole lg. Appliance package replaced. I cannot trust and will not trust lg. Products ever again.

      Just got the error code tonight and am on hold with the place of purchase. I am solo Mad it would figure I have it full of food! Freezer seems to work but no cooling in the top of refrigerator. I was never sent something about this issue !

    We also have the same LG French Door refrigerator LFX31925ST purchased 7/2/11 along with a LG stove, LG dishwasher and LG microwave. We’ve had to have ALL appliances serviced both the refrigerator and stove multiple times and they still don’t work properly. The stove shuts itself off constantly while I’m cooking and the microwave had to be completely replaced with a new one because it started smoking. Now the current one won’t turn off from time to time. We have to unplug it to turn it off. The refrigerator wasn’t making ice and the freezer wasn’t freezing food. It was serviced for a new compressor in July 2016. They came back out 6 days later because the noise it makes is so loud couldn’t stand it. It is again making VERY LOUD NOISES. I called today only to be told it’s out of warranty so they want more money to come look at it. We didn’t get info about the class action lawsuit until the deadline had passed. Has anyone had any success getting restitution for these terrible appliances???

      Hello. Was there any resolution to this matter? We have the same model refrigerator, and we are having exactly the same experience as you. Did they ever resolve it? We’ve only had ours for about 3 years!

    I have a lg model that was purchased in 2008. The same issue as stated in the complaint. Ice tray jam water leaking on the floor! I think I have found the root cause! Also I have pictures of mold growing behind the cover from the water defect area.

    Hi everyone I am also a victim of LG refrigerator, Model LFX31925ST. I purchased LG refrigerator , Model LFX31925ST, in July of 2012. I also purchased it from Home depot and got an extended warranty on it. This will be my 4th time visit from a technician this coming Monday. It seems to me that the problem is once again occurring. There is a loud noise in the back and the food in the freezer is starting to thaw out. I called LG and they told me that the Tech has to determine that the unit is not fixable anymore in order for me to call LG Resolution dept and see if they can get me a full replacement or find a solution to my problem. I as well, will be interested in joining the proposed settlement of class action from United States District Court under the case Clark v. LG Electronics U.S.A. , Case no.:3:13-cv-0485-JM-JMA. Could someone please send me additonal information as to how to join in or file a claim. Thanks very much.

      I have the same issue.. My LG lmx25964st french door refrigerator purchased 2011 stopped working last month. Warranty expired earlier this year. I paid 400+ for out of warranty repair.. LG came out several times and today finally after 18 calls and 8 in home visits they said its not repairable. I am waiting for them to call me back.I Would also like more information. Thanks in advance..

        Hi Caryn, I’m interested in a class action lawsuit. LG LFX31925st
        Unit failed and am getting the usual warranty run around fro LG. I’m a licensed plumber and diagnosed the design flaw in the refrigerant piping in about 30 seconds, meanwhile the service guy is running a load of garbage by my wife. They told her it was unrepairable because the compresser was discontinued. 1 minute online and I found the replacement model for this unit. What a joke
