Lexus class action lawsuitLexus, its parent company Toyota Motor Corp., and two Florida dealerships were hit with a class action lawsuit alleging that the dashboards in their luxury cars are defective and cannot withstand the climate in Florida.

Lead plaintiffs, Miami residents Daniela Perez and Jesus del Rio, filed the Lexus class action lawsuit this week. In their complaint, the plaintiffs allege that after normal use of Lexus brand vehicles, “the Florida heat caused the dashboards and other similarly constructed interior components to become sticky, oily, shinny, cracked and degraded.”

“The condition was and is known to [Lexus and Toyota],” the plaintiffs further allege in their class action lawsuit, pointing out that Toyota had issued a service bulletin in 2011 instructing Lexus dealers to repair and replace damage related to the alleged dashboard defect pursuant to the Lexus comprehensive warranty. However, the plaintiffs allege Lexus and Toyota refused to repair damage for Lexus vehicles that are no longer covered under the comprehensive warranty.

The plaintiffs point out in their class action lawsuit that “[t]hese vehicles are marketed as luxury vehicles and as the product of Lexus’ never-ending ‘pursuit of perfection,’” and argue Lexus should pay for repairs to the dashboards and interiors which occurred during normal use of the vehicles in Florida’s hot and humid climate. “The defective dashboard and interior has caused damage which Lexus K, Lexus F, and Toyota have refused, and continue to refuse, to repair pursuant to its implied warrantee,” allege the plaintiffs. “This is the core issue in this case which predominate over all other issues in this matter.”

The plaintiffs claim the Class Members of this class action lawsuit include “[a]ll individuals in Florida who own a Lexus vehicle which has experienced damage to the dashboard or interior as a result of heat within the applicable limitations period.”

The plaintiffs also claim two Lexus dealerships in Miami-Dade county in Florida, Lexus of Kendall, which serves Miami, Coral Gables and South Florida, and Scanlon Lexus of Fort Myers, should share responsibility for the damage. The plaintiffs claim that Lexus, Toyota and the Lexus dealerships have breached an implied warranty with Class Members. “At all times the class representatives and the class relied on representations made by Lexus K, Lexus F and Toyota that Lexus vehicles were luxury vehicles designed to be used in Florida,” alleges the class action lawsuit.

The plaintiffs claim that Lexus and Toyota should pay them and the Class Members for monetary damages because “ [a]s a direct and proximate result of Lexus K, Lexus F and Toyota’s breach, the class representatives and the Class have and will suffer [sic] monetary loss for required repairs to the dashboard and interior and resulting loss of use of their vehicles.

The plaintiffs, Daniela Perez and Jesus del Rio, are represented by Juan P. Bauta II of the Ferraro Law Firm PA.

    Still told I am waiting for 100 more people’s orders in front of mine. Been two years no telling how much longer. At what point should they be held responsible in a different way because by the time they have them available my car will probably be useless.

    I took my 2007 solar in for pics in may, I have called my local dealer over 12 times, corporate office more than 6 times, I have 6 case numbers still no dash board. I have owned toyotas over 28 years, I will never purchase another one. Tell all your friend!!!

    I was told they would fix it May or June, heard nothing after that. When I contacted them again asking why I hadn’t heard anything I am now told August or September….wondering if this is just the run around….

    Lexus has agreed to replace the Melting Dash and Door Panels. Here is the number to call (800) 255-3987. I have an 08 Lexus IS 250 whichI I bought in 07 which has the melting dash and my door panels are so soft they scratch easily. I called Lexus at the above number and advised them of my problem and told them that I heard Lexus had a recall on it. They took the information of my VIN number, Name, Contact information which they verified with their records and asked for my mileage. Then they advised me that I will get a recall letter in the mail first to notify me of the recall. Then in a few months they will send a second letter to advise me that my parts will be available at the Dealer for installation. I am to take the 2nd letter to the dealer and make arrangements to replace all 3. They also sent me an email that was provided which gives me proof that I spoke to Lexus. I hope this helps everyone who doesn’t already know.

    I am a 2008 Toyota Camry Solara owner with the melting dashboard problem. Does anyone know when Toyota expects to fulfill its promise to replace the dashboard under it warranty enhancement program per letter I got months ago. Or was this just a slick way to hold off more lawsuits over their shoddy product?

    My Lexus 2007 IS 350 has stick, cracking side panels with chunks looking like something chewed it. Got letter from Lexus stating they would replace but as of June 22, 2015 I have not received a notice that I can schedule this replacement. Meantime, more sticky side panels I can’t touch.

    2007 ES 350 with 45000 miles. Dash started getting sticky after 3 years and now has cracks in many places. Third Lexus and my last if they don’t correct this problem on their dime.

    I am getting ready to trade-in my 2004 Lexus RX330 and am thinking of getting another Lexus, but I am hesitant because of all the defects and issues. My dashboard started cracking about 5 years ago and it’s a complete eye sore and sticky. My master break seal went out a few months ago (despite the fact that I had it replaced as a recall several years ago) while on 95! Thankfully my son was not in the car with me…and I was able to safely use the emergency brake to get myself off 95 and have it towed to JMLexus. They quoted me $2500 to repair. I happened to call EF Auto in Lighthouse Point and the guy was so smart to tell me he believed this issue to be a recall and that I should check it out. Lexus did wind up paying for it which was wonderful, but then I recalled paying for a steering seal that blew a few years back and that cost me $1500 – which I read later was a recall issue as well….there are just so many problems with these cars, which is probably why they try to make up for it with their customer service. I remember when my dashboard first started cracking, a work colleague said, “just wait, your entire dashboard is going to crack and it’s going to be a mess”, as that happened to his wife’s RX330. He was right on the money. Who would want to buy a car with a completely cracked up dashboard? I have kept my car very well maintained and it just seems that they use cheap seals, parts on these cars.

    How do I join this law suit? My 2007 is250 is doing the exact same thing and Lexus would only cover half the cost for repairs. The interior is horrendous.

    NEIL, I’m in the same boat as you. I own a 2007 IS250 and the interior is slowly melting and falling apart.
    How do I join this class action suit? If any one has answers please keep us posted.
