A series of complaints against the Kellogg Company for falsely advertising that its Frosted Mini-Wheats cereal improves kids’ attentiveness may mean your kid isn’t getting smarter from eating Mini-Wheats, but it could mean an extra $15 in your pocket, thanks to a class action lawsuit settlement.
In April 2009, the Kellogg Company agreed to settle Federal Trade Commission charges that it violated federal law by falsely advertising that a breakfast of Frosted Mini-Wheats is “clinically shown to improve kids’ attentiveness by nearly 20%.” Over a year later, a federal court certified a class action lawsuit against the Kellogg Company for false and deceptive advertising and breach of express warranty. The Frosted Mini-Wheats class action lawsuit claimed that Kellogg falsely advertised that its Frosted Mini-Wheats cereal improved kids’ attentiveness, memory and other cognitive functions to a degree not supported by competent clinical evidence. Kellogg stands by its advertising and denies it did anything wrong, but has agreed to pay $2.75 million to settle the case.
If you purchased Kellogg’s Frosted Mini-Wheats cereal between January 28, 2008 and October 1, 2009, you may be entitled to a cash reimbursement from the Mini-Wheats class action settlement. All you have to do is submit a valid claim form either online at www.CerealSettlement.com or postmarked by June 3, 2011.
As part of the Kellogg’s Frosted Mini-Wheats settlement, you can receive $5 per box of Frosted Mini-Wheats you purchased during the class period, with a maximum recovery of $15 for the purchase of up to three boxes. If you wish to opt out of or object to the Frosted Mini-Wheats settlement, you must do so no later than January 15, 2011. A court will decide whether to approve the Kellogg’s settlement at the Settlement Hearing scheduled on February 14, 2011.

I never recived anything from this company. I did not get my refund check for the cereal I got at difference stores. My family enjoys eating frosted mini wheats. Will I be getting anythig from this settlement?
You people are ridiculous. Go read a book! You eat something because you enjoy it. There is a 126 boxes of cereal on your local supermarket shelves. You pick this cereal along with three other types of cereal to take home. Serious people, you eat breakfast in the morning for healthy weight control, energy, focus and nutrition. If you want $15 in your pocket use a coupon for the cereal that you are so faithful too.

It’s pretty slick how corporations have class action suits and many of us don’t even know they exist! I missed the deadline, and have eaten a gazillion boxes of this stuff! I will now be visiting this site regularly…

ii did not find out about this until today 6-28-11 that there was a lawsuit i decided to go on line to fill out the claim form and saw the deadline was 6-3-11. i bought several boxes of cereral and would have been entitled to this settlement. i heard about it on the radio this morning. bumer was this not in the news media earlier than today ?
