Honda class action lawsuitA California federal judge has granted preliminary approval to a class action settlement that will resolve claims that American Honda Motor Co. manufactured more than 1.5 million defective Accord vehicles that excessively burn oil, causing engine malfunction and premature spark plug degradation.

Plaintiffs Vince Eagen and Alex Soto initially filed the class action lawsuit in March 2012, claiming that 2008-2010 Honda Accords contained a “systematic design defect that enables oil to enter into the engine’s combustion chamber,” causing the engine to consume excess oil. According to the class action lawsuit, this alleged defect led to “premature spark plug degradation and engine malfunction.”

The class action settlement agreement was initially submitted to U.S. District Judge Susan Illston on Sept. 11, 2013. The plaintiffs asked Judge Illston to grant preliminary approval to the Settlement Agreement, which she did on Oct. 9.

“The Court preliminarily approves the settlement and Settlement Agreement as sufficiently fair, reasonable, and adequate to warrant dissemination of Notice of the proposed settlement to the Settlement Class, the posting of the Notice on the Website, and the scheduling of a formal Final Approval hearing,” Judge Illston wrote.

Under the terms of the class action settlement, Class Members include all U.S. purchasers and lessees who purchased or leased certain Honda vehicles in the United States. The affected vehicles include 2008-2012 Honda Accords; 2008-2013 Honda Odysseys; 2009-2013 Honda Pilots; model year 2010-2011 Honda Accord Crosstours and 2012 Crosstours equipped with 6-cylinder engines that have variable cylinder management.

Honda agreed to extend the powertrain limited warranty for up to eight years after the original sale or lease of the vehicle, without limitation as to mileage. Under the terms of the class action settlement, Class Members who submit a valid claim form with a copy of an original repair invoice, receipt or other documentation plus proof of payment for repairs or replacement parts may be eligible for a full reimbursement.

A final hearing for approval of the class action settlement has been scheduled for March 21, 2014.

According to the class action settlement agreement, the Settlement Administrator must notify Class Members about the settlement by U.S. mail by Jan. 10, 2014. The notice will include a claim form, which will also be posted on the settlement website, once the website is established. Any request for exclusion must be postmarked no later than Feb. 24, 2014.

    I wouldn’t get too excited based on what just happened to us. We have 2008 V-6 Accord and have had the oil consumption issue-plugs replaced, etc. About a month ago I contacted Honda of America to discuss the issue with several people. After a long discussion with a rep by the name of Duon (pronounced Don or Dawn) she said she would arrange for an oil consumption test with a local Honda garage. This test would involve us paying for an initial oil/filter change as well as at least one, maybe more in 1000 miles with a variation of only about 30 miles. She couldn’t tell me how many customer paid changes would be required. Also said the dealer would determine if we had a issue covered under the supposedly extended warranty. I asked if she could sent this info to me in an email & was told they cannot ‘send or receive emails and I could not record the conversation as it was all propitiatory information and that California was a 3rd part state’. On a Thursday she said she would call me back on the following Tuesday. No call was received although I left a message for her on the following Thursday and with another contact on Friday. It appears that Honda is going to continue to make it as difficult as possible to collect , even under the supposedly extended warranty.

    My Honda was hit by another car and caught fire, which I woke up in a hospital in Tulsa,Okla. I’m still having problems with my jaw. I know I should get paid something. Its hard to submit a claim.

    I have a 2010 4 cylinder Honda Accord Coupe, which so far has not had this type of repair done. Am I still a viable Class Action participant and should I file a claim?

    Please count me in!!! I had to replace the VTC actuator on my 2008 accord and it was all out of pocket.

    Please let me know if I will be able to file against Honda. I already gave you my story but briefly, Honda replaced my entire engine at no cost. The problem with the new engine was worse. After about four months it died on my way to work. Honda dropped me and said that the new engine was just good will and I would have to pay more than $8k for repairs. I felt abandoned with no way to get to work. Toyota bailed me out by taking the vehicle and given me a new one. I had to take a $5k loss with $2k out of pocket for a total of $7k. Please tell me if I have any recourse.

    Please count me in! My 2009 Honda Accord V6 has required replacement of the #3 spark plug three times in 20,000 miles, fouled by oil consumption. I have 116,000 miles on my Honda but expect much better service. I’ve had nothing but Honda’s for 35 years and have never had a problem. This is very disappointing.

    My 2004 Honda accord did the same thing.bought it at pizza Honda in limerick pa.i was losing a quart of oil every three thousand mile.when I got my oil changed.traded in my 1989 Lincoln town car that never lost a drop of oil between changes.they tried telling me that was normal.was not a drop of oil in my driveway or were I parked at work.fought with them.made me come in every 1 tho.miles to check it.my sons were behind me getting on the hiway and told me had smoke coming out the tail pipe.took it in again,and they over filled almost by two quarts.which is bad for your car.after months of fighting with them.,taking it in every 3 weeks and would be quart low.the put a used engine in it..was married to a mechanic for ten yrs.new it would never be right again
    Which I new by the one time they over filled it.caused more damage to other parts other then the engine.took a big loss ,my loan was upside down.being I had only owned it for a year.bought it from pizza dealership.as a certified preowned Honda .took a large loss traded it in once they put the used moter in.Had to put the difference on my new loan.which would have been payed off by now.so really I am paying. On my Honda still.bought American made this time.and never gives me a problem.but pizza treated me like a stupid women.worked midnight shift and was a big hassle ,taking every few weeks,so they could check the oil level.and then cost me money to get ride of it.they wouldn’t give me papers that my 30,000 mile car only had fifteen like they told me.and left a tool inside the engine compartment.so I kept taking it back,more hassle.treated me like I was crazy.until they found the part ,after I demanded that the service manager take a test drive with me.so they looked around more to see what was wrong and found the part.think it was the same moter as the 2008 -2010.i do believe 2004 was the first year,that they put those moters in.maureen Gavlick.#484-557-5761

    Same here, 2008 accord coupe. Finally failed the oil consumption test enough that they did some work to it. I would like the extra warranty though because I don’t trust that other things with the car aren’t broken because of the oil issue. About 500 miles after having the seals replaced, the entire car shuttered like it threw a rod on start up but Honda can’t duplicate it and now it’s out of warranty. I’ve noticed that horsepower has really taken gone down in the car too.
