A California federal judge on Friday approved a class action lawsuit settlement that will provide gift cards worth roughly $500 to more than 1,000 Kohl’s customers who were asked by the retailer to provide their ZIP codes during credit card transactions.
The Kohl’s ZIP code settlement will resolve a 2011 class action lawsuit, titled Whittenburg v. Kohl’s Corp., that alleges the retailer violated California’s Song-Beverly Credit Card Act by collecting customers’ ZIP codes. The law prohibits merchants from asking for personally identifying information, such as ZIP codes or phone numbers, during credit card transactions.
Plaintiffs allege in the Kohl’s class action lawsuit that they provided their ZIP codes after store clerks requested them because they believed it was a requirement to make a purchase.
The Kohl’s settlement is the latest in a slew of class action lawsuit settlements involving violations of the Song-Beverly Credit Card Act against major retailers such as Crate & Barrel, Cost Plus World Market, Bed Bath & Beyond and many others. What makes this settlement stand out, however, is that Class Members will receive gift cards worth roughly $500 – much higher than typical payouts in these cases.
Class Members of the Kohl’s class action lawsuit settlement include anyone who made a purchase at California Kohl’s from March 4, 2010 through October 2012.

I am a long time Kohl’s customer and used my charge card over the last several years and have been asked not only for my zip code but my social. I guess what has me upset is that very few people in California knew about this. I have not received any compensation but yet I know of someone who received a $460.00 check for just saying she spent money in the store in that time-frame. What do the rest of us need to do???
I received my Kohls Card in October 2012 and have been unab;e to find out which legal firm is handling the case.So please E-Mail me with the info if possible.

Scott, thanks for the investigation. I was just thinking I misread the site and I couldn’t believe it closed out so quick. I just remeber a similar thing happening with bens and jerrys settlement, i think they gave people two days and it started a storm on here. Thanks for the info
Was this settlement already closed. I google kohls settlement and saw the website http://www.kohlssettlement.com and it said forms has to be postmarked by the end of January.

I’m working with them so we’re in the loop on all settlements going forward. I REALLY don’t like it when a settlement like this one comes and goes and we have no idea about it. -Scott)
I travel to CA every July and Christmas and take my kids shopping at Kohls. I always use my charge card so there is proof of it except when I bought them gift cards here in Texas. I never thought that much about it, there are a lot of stores that ask for your zip code.
Each time I have made a purchase they ask me my zip code and often my phone number to go with it

Almost all of them ask, for either zip code or phone number. I live in PA and don’t know if it’s legal here or not but they always do it. I just refuse and that’s the end of it but it’s annoying.
I would like to file a claim directed to the settlement administrator as part of the settlement for Kohl’s gift card. I have been asked for my zip code, and credit card info as a customer in Massachusetts. I understand my state is also involved in the settlement.
I got excited about this one. Surprised it’s just California, because a lot of retailers still ask this. Never really thought about how it could be paired with your credit card number to make purchases in your name.
