Brazilian BlowoutA California judge has granted final approval to a $4.5 million class action settlement resolving claims that the manufacturer of Brazilian Blowout failed to warn consumers that the popular hair-straightening product emits toxic formaldehyde gas, a known carcinogen, even though the product labels said it was “formaldehyde-free.”

California Superior Court Judge Elihu M. Berle signed off on the Brazilian Blowout class action settlement on Dec. 24, calling the deal “fair, reasonable and adequate.” Consumers who filed valid claims will receive a $35 payment for each Brazilian Blowout treatment they purchased, up to a total of 3 ($105). Hair stylists will receive $75 for each bottle of the product they purchased. Any Class Member who submitted proof of medical expenses incurred as a result of exposure to the formaldehyde in the Brazilian Blowout products will receive up to $2,000 in medical reimbursement.

According to the Final Approval Order, the Claims Administrator received 6,098 Consumer Claims, 1,608 Stylist Claims, and 58 Medical Reimbursement Claims, for a total of 7,764 claims that will be paid out within 30 days of the Effective Date of the class action settlement. Class Members who filed valid claims can expect to receive their settlement checks soon.

UPDATE: Multiple Class Members are reporting to Top Class Actions that they received settlement checks from the Brazilian Blowout class action settlement, starting the last week of March 2014. As of April 1, no update confirming the distribution of payments was posted to the Settlement Administrator website. Payments are reportedly ranging from $70 to over $1,000.     Now, if I have to wait, until MARCH 24th, to get PAID, what choice Do I have. However, I was reading that there was a “PRORATE INCREASE”, so if They are paying more than what is EXPECTED, than i guess, it’s worth the WAIT!!!

    Im praying too. My minutes are out for the month or I’d call… IF ANYONE DOES, PLEASE POST. There are certain requirements they must follow but its time for them to get to mailing theese checks! By my count, I agree with the post above, Feb 24th should be the longest they have…

    If anyone finds anything out, we all would be GREATFUL to know… also post if/when you get anything in the mail.

    This one has me worried, I guess because they are taking so long. Like I said, I wish I could call, but im out of minutes till the 2nd :-(

    HI! where is everyone hearing this infomation from, I hope & pray, that the checks will be mailed out to everyone, by Feb 24 th, They were approved, by the Judge, on Dec 24th 2013.

    Has anyone got an status update when they will be sending out checks. I heard they were going to start mailing the checks in February 2014?

    Has anyone heard anything about this, either those who called or anyone yet to receive a check?

    Unfortunately for my situation I didn’t know THIS was the reason for my short bouts of sickness each time I had my hair done. I just assumed in the multiple times my headache and slight nausea was smelling all the other salons’ functions like the nails being done or such, so I never went to a doctor. It passed and I was fine the next day so I never assumed it was what I wwas getting done to my own hair… Unfortunately like I said, I notice now my hair IS THINNER. I still to this day wonder if this had anything to do with that. Heck, as much money as each treatment cost, I thought they were using higher quality products, or at least the lady’s doing the treatment would of noticed something wrong well before… Well, you live and learn.

    They are not abiding by what the court order. Checks should be going out by tomorrow. They told me they won’t be sending them out until the next 7 or 8 weeks. How do you report them?

      Really… thats what your so worried about? I think the fact that we dont pay any lawyer fees or court costs and still get to be included in the settlement is well worth the extra couple weeks.
