A class action lawsuit against JPMorgan Chase, which was recently removed to federal court, alleges that the bank wrongfully forecloses hundreds of homes.

Plaintiffs Dhimiter Llordi and Natalia Hoshovsky filed the class action lawsuit against JPMorgan Chase & Co. claiming that the bank forecloses homes after missed mortgage payments without attempting to contact the homeowners.

The Massachusetts residents say JPMorgan foreclosed on their home without conducting a face-to-face interview or making any reasonable efforts to arrange such an interview.

U.S. Housing and Urban Development regulations require lenders to engage in interviews, or make efforts to do so, after three mortgage payments are unpaid and before they are allowed to foreclose on a property.

The regulations reportedly state “prior to acceleration a mortgagee must have a face to face interview with the mortgagor, or make a reasonable effort to arrange such a meeting, before three full monthly installments due on the mortgage are unpaid.” The regulations do not apply if the mortgaged property is more than 200 miles from the mortgage lender or one of its offices.

The plaintiffs claim that JPMorgan failed to follow the regulations with hundreds of consumers who make up the proposed Class. “Plaintiffs believe that the Class encompasses hundreds of individuals whose identities can be readily ascertained from [JPMorgan’s] books and records,” the JPMorgan Chase foreclosure class action lawsuit states.

Llordi and Hoshovsky also claim that Chase committed breach of contract, breach of covenant of good faith and fair dealing, and breach of duty of good faith and reasonable diligence.

“The Defendants are obligated by contract and common law to act in good faith and to deal fairly with the Plaintiffs so as to guarantee that the parties remain faithful to the intended and agreed expectations of the parties in their performance,” the JPMorgan home foreclosure class action lawsuit claims.

Alleged damages sustained by JPMorgan’s actions include loss of home equity, moving expenses, loss of property interest, negative credit ramifications, loss of opportunities to rectify their situation, emotional distress, increased fees, accrued interest, and increased principal balances.

The JPMorgan Chase class action was originally filed in the Norfolk County Superior Court. JPMorgan recently removed the lawsuit to federal court, claiming that the estimated money in controversy on the alleged foreclosed homes exceeds the minimum for removal of $5 million.

In their notice of removal, JPMorgan disputing the allegations made in the class action lawsuit. The bank argues that the plaintiffs wrongfully interpreted their mortgage contracts and are not entitled to relief.

“Chase disputes the allegations in the Complaint, including Plaintiffs’ interpretation of the contracts at issue, and disputes that Plaintiffs are entitled to any relief,” the notice of removal states.

The plaintiffs seek to represent a Class of JPMorgan mortgage consumers who were not granted a face-to-face interview before three monthly payments were unpaid, and later foreclosed on. The JPMorgan Chase foreclosure class action lawsuit seeks actual damages, punitive damages, restitution, court costs, and attorneys’ fees.

    I have a mortgage line of credit, and for $2100 chase wants to foreclose on my home. I have a chase checking account that was making bill payments thru the same bank, and for some reason payments were canceled. This is a big problem because neither the bank or mortgage departments want to take responsibility for what happened. I need an attorney to help, I am in California.

    i only owed CHASE 233.434.00 my house was worth 700.000.00 or more. CHASE had told me to lower my payments. i should apply for a modification, but i had to let my payment fall behind 3 months. so i did. Because i had got injured at work and had a total knee replacement and was not working at that time. i sent them a letter stating my predicament. CHASE had told me i totally qualify for a modification. for months they said it should be complete any time now, but the next thing that happen devastated me! there was a pink slip of notice of this property has been auction to a buyer. i tried everything to stop it but i could not. which caused me to go into a bad depression for years.

    Chase signed a contract with my Father 2 days before his death, while in hospice under morphine, He thought what he was signing was a mortgage reduction, so that my Mom would not have to worry about losing his income or her home of 30+ years. We later found out, what Chase had him sign was something called a balloon mortgage. Her mortgage payments went up instead of down and Chase foreclosed on the mortgage. My Mom had to pay thousands of dollars to stop the foreclosure. She hired an attorney to try to get the mortgage reduction my Father supposedly signed up for and they refused her instead raising her mortgage every 6 months to a year. In the past 3 years I have watched my Mothers mortgage go from $1100 to $2876.00. She’s 80 years old for Gods sakes. When we started asking questions, Chase sold our Mortgage to a company name SPS???? Who tells us the can continually raise the mortgage up to a maximum of 11%???? Help, Does this allow us to be a part of the lawsuit???

      Sps is a debt collection. They liquidated your mortgage and it’s not even attached to a mortgage anymore it’s a debt. Select portfolio servicing is the absolute worst company any files fraudulent documents and will steal your home. They are owned by Credit Suisse and will not help you at all. They want one thing your moms home and do not care about anything besides collecting money. JP chase assigned your rights to collect on a debt and They are trying to sell everyone’s loan and get out quick. They did the exact same to my parents. Huge balloon payment of 90 k due after 30 years of payments that increased and increased. This was also done to a couple in their 80s with health issues. It’s a predatory modification and they creat them because they know they are not well known to these bankster schemes. They do it all the time. Next you will get a foreclosure from a different bank stating they own your house. They do not! No one does anymore and you need to either hire an attorney or start looking into securitization and learn the facts of what actually JP chase did with your mortgage. They are scum and are destroying us Americans and created a huge mess! Your title will be clouded forever since the chain of title has been broken. Don’t fall for their lies. All lies and they are not going to do one thing to help you. I have been fighting them . Whatever you do do not fall for their offers such as cash for keys, etc. don’t sign anything or give them any info. They don’t have a title and never will! Start fighting back. Many Facebook groups like select portfolio fraud, etc. start fighting or they will take her home and it’s all illegal federal and state consumer laws are being violated. They don’t care because no one has “yet” to stop them. We are all fighting and working on exposing and shutting these debt collectors down! JP chase has a mess to clean up that they created!!

      Sps inc AKA SELECT PORTFOLIO SERVICING INC. I HATE TO TELL YOU THIS SELL YOUR HOME FAST THEY WILL TAKE YOUR HOME WHILE TELLING YOU THEY ARE TRYING TO HELP YOU THEY JUST SOLD MY 650,000 home in a foreclosure sale for under 390,000 and I’m going to sue them they use all fraudulent documents if ur loan went from chase to them ur documents are phony also everybody is scared of chase or they pay them off so good luck if u rob a bank u go to jail but they rob u and your family and kids and get away with it. Yes I know sps inc very well they lie about everything there is no coincidences and know honest mistakes there is nothing honest about sps. Gdbless sell your home fast they are good at what they do and they hiding in Salt Lake City Utah they don’t have a branch in ur neighborhood where you can see them they worth 30 billion and specialize in single family homes easier to evict one tenant than three or four after they steel your home.     Chase has been giving us the runaround with modification and even threatened to foreclose on us at one point within 2 weeks without a face to face or a chance at redeeming our loan. They have told us one thing and done another. Please sign me up.

    I have been waiting a long time for a class action suit against those sorry thieves. Modification loan? Never existed. They stole my house out right. Please please please dont forget me in this suit. I have waited so long and have all the paperwork to back my claim.

      I found out my house was sold when this idiot pulls in my driveway and tells me he bought my house and I had one week to get out . All thr while Chase was taking my modification money and telling my home was not going to be sold. I never received anything from Chase once they sold my house stating they sold my house. Ibwas keft with no where to go with three animals it was the worst thing I had ever experienced. Those ##ther

        Imagine now people conceal and carry permits nobody is doing nothing about this wait till someone shows up in the wrong house telling domeone I just bought ur home u have to go or try to walk in a residence where the home owner legally shoots the person chase is going to get what they got coming it’s all a matter of time. Imagine guy walking into a home of someone who has no idea there home was just sold fraudulently it’s just a matter of time everyone who stood by while all this happen it will b on them
