JCPenney class action lawsuit is filed.Lead Plaintiff Bernadine Sims alleges in the J.C. Penney class action lawsuit that the store shares its customers’ confidential credit card information with Stonebridge when they make catalog purchases over the phone. Stonebridge then pays a fee to J.C. Penney for every person who “willingly or unwillingly” enrolls in its Membership Loyalty Program.
Sims alleges in the J.C. Penney class action lawsuit that Stonebridge deceptively enrolls consumers in recurring monthly membership programs without their consent by offering “free trials”and “fictitious rebate programs.”

 

These so-called “free trials,” however, are actually negative-option memberships, which means consumer must go through the hassle of canceling their memberships to avoid being repeatedly charged for a program they often do not even know they have “signed up” for. When consumers try to cancel their unwanted Stonebridge membership program, Stonebridge refuses to do so and continues charging them a recurring monthly fee. And when consumers try to use the “rebate programs,” they discover no such benefit exists.
“J.C. Penney has a vested interest in perpetuating and expanding the fraud that Defendant Stonebridge perpetrates on consumers” because the store gets a percentage of the money Stonebridge extracts from each of its victims, the class action lawsuit states.
The J.C. Penney Membership Loyalty Program class action lawsuit is seeking restitution and damages of more than $5 million for allegations of consumer fraud, deceptive trade, violations of the Automatic Contract Renewal Act and Electronic Funds Transfer Act, unjust enrichment, negligence, fraud by omission, and breach of contract.

.C. Penney (NASDAQ: JCP) is in cahoots with a deceptive marketing company, Stonebridge Benefit Services, that has a known track record of “deceptively and without authorization charge(ing) tens of thousands of consumers millions of dollars” for bogus membership programs,” according to a class action lawsuit filed in Cook County Chancery Court.

    I also had been paying for cancer insurance for years through Stoneridge Life / JC Penneys. I had called to cancel . I was no longer billed as previously on my JC Penney credit card, so ofcourse I assumed it was cancelled. All of a sudden this week , 3 years later they are saying I owe the tons of money. I disputed it but it was denied. I’ll be damned if I pay them a cent. Obviously something went wrong in their bookeeping or they are just crooks.
    This is extremely distressing to me.
    My last payment seems to be in 2018 which came automatically to me in on my JC Penney Charge. After I cancelled, I never received another bill. Now I got a notice that they are going after me for $800.00!!! How can this happen!?!?!

        I began a AD and D policy with JCPenney many years ago and then it changed to Stonebridge Life Insurance. Please inform me of the legitimacy of this company and whether I should discontinue this policy. It costs about $120/year for coverage.

    i have questions about this jc penny\stonebridge class action law suit from 2011. i have been had a policy with stonebridge since around 2008 through jc penny. they still deduct payments for the insurance policy to date. i need contact info for this class action law suit.

    I have had accidental death insurance since 1991 with the Old Stonebridge Life insurance Co.;
    I would like to find out more and if there is still a class action lawsuit; I am still paying the new company TransAmerica and if they are not legit how can we retrieve all of the monies we had been paying over the years.
