jaguar class action lawsuitJaguar has been hit with a proposed $5 million class action lawsuit alleging that the luxury car manufacturer intentionally sold Land Rovers that contained a defective electrical system which caused the battery to drain and created “starting” issues.

Lead plaintiff Amy Block of New Jersey filed the battery defect class action lawsuit against Jaguar Land Rover North America LLC on Monday on behalf of herself and potential Class Members, alleging the company has violated New Jersey’s Consumer Fraud Act.

According to the class action lawsuit, Block purchased a 2009 Land Rover LR2 with all the options that came with the vehicle including an entertainment system. However, the plaintiff claims that the vehicle contained a defect that caused the electrical and entertainment system to drain the battery making the Land Rover unable to start.

The Land Rover class action lawsuit alleges that the manufacturer attempted to fix the issue by replacing the battery but the new battery did not resolve the problem. Lead plaintiff Block claims she informed Land Rover at least three additional times about the defect but the car manufacturer failed to remedy the issue.

The plaintiff alleges that Land Rover knew about the battery defect in their vehicles that were on the market between 2007 to the present day. However, despite this knowledge the class action lawsuit claims that Jaguar “uniformly concealed material information in its marketing, advertising, and sale of the vehicles, which Land Rover knew to be defective, both at the time of sale and on an ongoing basis.”

Lead plaintiff Block claims she filed the proposed Jaguar class action lawsuit on behalf of Class Members who have unknowingly been placed at a safety risk and who have been forced to pay for the cost of repairing the defective system.

The Jaguar battery defect class action lawsuit alleges that reasonable consumers would expect that the Land Rover’s electrical system would function free from defects. Lead plaintiff Block also claims that the proposed Class Members would assume that Land Rover manufacturers would not “conceal problems such as the defect from them, to continually deny its existence, or that Land Rover would refuse to bear the repair costs that become necessary to correct the problems resulting from defective electrical and/or entertainment system and battery.”

Block expects the Jaguar lawsuit will bring restitution to Class Members in the amount Land Rover obtained as a result of the company’s misconduct.

If approved, the battery defect class action lawsuit would be open to all Class Members who reside in the United States who own, or have owned, a 2008 to 2015 Land Rover LR2 and/or any other Land Rover model containing the defect that causes the battery to prematurely drain, stops the vehicle from starting, and needs to be replaced.

The plaintiff is represented by Bruce H. Nagel of Nagel Rice, LLP.

The Jaguar Battery Defect Class Action Lawsuit is Block v. Jaguar Land Rover North America, Case No. 2:15-cv-05957, in the U.S. District Court for the District of New Jersey.

UPDATE: On May 26, 2016, a Jaguar class action lawsuit will continue on breach of warranty claims after all other allegations were dismissed by a federal judge.

    I have a 2016 Discovery Range Rover with 20,000 miles on it. The battery drains every night and if I don’t drive it every 24 hours, it dies. I am on battery number 3 and still having the same problem. Range Rover does nothing but suggest another new battery, which obviously isn’t the problem. The people at Range Rover are worthless!

    Why is there no recall on this issue?? When I spoke with Land Rover customer relations out of New Jersey they claim they have no knowledge of this issue. Obvious BS. Does anyone know of any resolve or this?

      I have a 22 range rover sport and going through the same battery issues. Only 1200 miles and have had the battery die 3x. The dealer has had the vehicle for 4 weeks with no resolution. Today they picked up my car, brought me a loaner vehicle for the third time . I told them I wanted another truck.

    I have a 2011 Range Rover SC and battery drains and won’t start. Local shop had it for two weeks, charged me over $1,000 and now Autobahn in Ft. Worth,Tx has had it for nearly a week and still not repaired. I am at a loss of what to do. Car is perfect otherwise with only 53,000 miles. Would ove tpo join the class action lawsuit. Thoughts anyone?

    I have a 2008 Land Rover LR2 and the battety drains and wont start. It has also had electrical system issues. I live in Northern Michigan where nobosy wants to work on this car!

    2009 LR2 here; owned since 2012 – going on my 4th battery in as many years. constant non start/battery drained issues and they cannot locate problem, totally disgusted. tried to trade in at other cr dealers, basically “a parts car” worthless cause everyone knows about the problem !!!!!!!!

    I have a 2010 LR2 which the battery is dead after setting for two days. I turn everything off in the car but battery still gets drained!! Have had it into the LandRover dealership numerous times. Replaced battery and within the year battery goes dead. They have updated the computer still nothing works!!! So frustrating!! Also had to pay for them to check out the reason and nothing is resolved. They have suggested to install a battery trickle which costs $200.00. Not spending anymore on this car!! Guess will have to trade it in on something else. My LR2 only has 47,000 miles on it……

    I have a 2008 LR RR Sport and recently purchased a new battery and was just told the battery was no good by another dealership. I paid more for the initial battery and the replacement battery is cheaper and more powerful…? What is the update note basically saying?

          Hello victims : I have experienced the same problems you people have been writing here about. I have just purchased,
          used, a 2005 . I might be out of luck due to the age of my Range Rover. It seems to me that this is not at all a battery problem. This is the electrical system that remains on in some way that it drains the battery slowly. I can hear a very slight buzzing sound when I turn off the vehicle. Something is not shutting off completely. Thus, you get a slow drain on the battery. I’m going to look further into this matter.
