Top Class Actions viewers are starting to receive store credit vouchers and settlement checks from a class action settlement that accused J.C. Penney of using fake “original” prices to trick customers into thinking they were getting significant discounts on “sale” items.
According to reader comments and posts on the Top Class Actions Facebook page,Class Members who submitted timely and valid claims for the J.C. Penney class action settlement began receiving store vouchers ranging between $87.50 to more than $600 on Jan. 5, 2017.
In addition, Class Members who opted for a cash payout started receiving settlement checks worth as much as $175 on Jan. 9.

The J.C. Penney settlement resolves allegations that reasonable customers were tricked by a deceptive pricing scheme that showed exclusively branded apparel as having a fake “regular” price in an effort to boost sales.
Plaintiff Cynthia Spann filed the class action lawsuit in 2012 after allegedly buying a few shirts that were advertised as $17.99, marked down from $30.
Spann said it wasn’t until after making her purchase that she discovered those particular items were not priced higher than $17.99 in the previous three months.
The class action lawsuit accused J.C.Penney of violating California state law, as well as the Consumer Legal Remedies Act and the False Advertising Law.
J.C. Penney denied the allegations and tried to get a California federal judge to dismiss the fake sale class action.
When that motion was denied and a Class of California consumers were certified, J.C. Penney agreed to pay $50 million to settle the claims.
Class Members included all California shoppers who purchased one (or more) items marked with a discount price of at least 30 percent off the “original” price between Nov. 5, 2010 and Jan. 31, 2012 or Jan. 1, 2013 and Dec. 31, 2014.
The deadline to file a claim for the J.C. Penney settlement passed on June 30, 2016.
