Hyundai class action settlementHyundai Motor Company Ltd. and Hyundai Motor America Inc. are facing a class action lawsuit alleging certain vehicles contain an engine defect that prevents oil flow to vital areas of the engine, leading vehicles to stall during operation and potentially experience catastrophic engine failure.

Plaintiffs James Kinnick and Wallace Coats claim that the Hyundai engine defect results in the restriction of oil flow through the connecting rod bearings and other vital areas of the engine. They claim that the defect typically manifests during the limited warranty period or shortly after it has expired.

Kinnick and Coats allege the Hyundai engine defect can cause catastrophic engine failure at any time—even when the vehicle is in operation. As a result, the driver and occupants of the vehicle are at an increased risk of an accident, injury or death. Other drivers and passengers who share the road are also at risk, the Hyundai engine defect class action lawsuit alleges.

According to the Hyundai class action lawsuit, the vehicles affected by the alleged Hyundai engine defect include certain 2015-2016 Sonata, Tucson and Santa Fe vehicles with Theta 2.0-liter and 2.4 liter gasoline direct injection (GDI) engines.

“Not only did Defendants actively conceal the fact that particular components within the Class Vehicles’ engines are prone to failure, they did not reveal that the existence of the defect would diminish the intrinsic and resale value of the Class Vehicles and lead to the safety concerns described herein,” the Hyundai class action lawsuit states.

Kinnick and Coats claim that Hyundai has long been aware of the defect but that the motor company has refused to repair the affected vehicles without charge even when the alleged defect manifests during the limited warranty period.

“Indeed, in many cases Defendants have even refused to disclose the existence of the defect when Class Vehicles displaying symptoms consistent with the defect are brought in for service, instead choosing to ignore the defect until it has caused significant mechanical problems necessitating costly repairs,” the Hyundai engine defect class action lawsuit alleges.

Kinnick and Coats both claim that they had to pay thousands of dollars to replace the engines in their affected Hyundai vehicles. According to the engine defect class action lawsuit, Hyundai did not inform them of the existence of the Hyundai engine defect despite allegedly being aware of the issue.

The Hyundai class action lawsuit asserts claims for violations of the California Consumer Legal Remedies Act, California Unfair Competition Laws, the California False Advertising Law, the Ohio Consumer Sales Practices Act, breach of express warranty, breach of implied warranty, breach of written warranty under the Magnuson-Moss Warranty Act, common law fraud, breach of the duty of good faith and fair dealing, and violation of the Song-Beverly Act – breach of implied warranty.

Last year, Hyundai settled a similar engine defect class action lawsuit that allegedly affected 2011-2014 model year Hyundai Sonata vehicles with a Theta II 2.0 liter or 2.4 liter GDI engine.

      I have a 2008 Hyundai Veracruz and recently had bad wreck due to car suddenly exccelarating extremely fast and the brakes failing it is March 20,2023 and my wreck was November 16, 2022. So as soon as I found out that there had been reports of same kind of cars like mine had do t the same thing and even had one of Hyundai ‘s employees even admit Hyundai knows about this problem but still has not issued recall for this. I think this is absolutely ludicrous knowing that a cars accelerater can stick and send car down highway super fast and super quick and then as your going super fast all of a sudden u hit brakes just to find out u can’t stop this vehicle is quiet scary oh and .Let’s not mention that on top of all this my airbags never do deploy and I pretty sure when a car is totalled from hitting a cedar tree u would think air bags would go off . Anyways afyer contacting Hyundai they send me some documents thru email asking me to fill them out and get them pictures of car mind u I’m still recovering from this wreck and I ask for a rental car cause I live way out in country I was told no so to this day have still not made it to my follow up to go over my catscan they did in er with my physican cause I had no way to get to this appointment any ways still not sure their gonna do anything about this but I’m still vehicle less and they taking their sweet time at calling me back or figuring out anything just frustrating guess I will eventually get use to these deformed forehead I have now cause of the wreck

    I have a 2016 Tucson the engine blew I was doing regular oil changes and couldn’t believe it when the mechanic told me it the engine blew because there was no oil I couldn’t believe it. This affected me greatly because I am a Lyft driver. Now I owe on a vehicle I can’t drive.

      The same thing happened to me. No lights ever went on I did regular oil changes and my car just died also paying for a car I can’t drive

        mine just started to knock, we bought it last nov only put on 4000 miles

      Mine is doing the same. It is still under extended warranty where I bought it. Trying to find a motor for it. The oil is by passing the the cylinders and going straight to the spark plugs. They are burnt and oiled and I changed my oil regularly

    I have a 2016 Hyundai Tucson that burns more than a quart every 1000. I have been to other mechanics who tell me I have a serious oil burning problem. Hyundai refuses to assist. They set me up for surveys over a period of 3000 then tell me stop coming after the 1st 1000 mile check. 700 miles later I am out of oil. I’ve done this 3 times. This problem started at 50,000 it’s getting worse at 71,000 miles now. They are not honest and refuse to honor the warranty. I can get an oil change and fill up with oil and I can’t even make it 3000. A year and half dealing with these people. Add me to this lawsuit.

    The replacement engine in my 2016 Tucson SE Sport just blew. I have had regular oil
    Changes and have proof yet car is still sitting in my
    Driveway undrivable. Please advise as to how I get added to this lawsuit. NEVER BUY A HYUNDAI , and especially not from greenway Kia in Madison tn

    I have a 2016 Tucson that Burns one qt of oil every 1000 miles corporate says this is perfectly normal not sure what to do here

    I actually own a 2014 Hyundai Tucson. 134,000 miles. Engine failure. $7000 repair. So I think there may be some affected vehicles slipping through the cracks here.

      Also to add, ?? I am still paying on the loan and can’t even drive the car. Had to refinance to avoid voluntary surrender and tearing up my credit, which takes more money out of my pocket, to afford another vehicle loan for a new car beings this one obviously can’t be driven. What a scam.

    I have a 2016 Hundai Tuscon and it is giving me trouble, Has 45000 miles and thier solution was to buy a 6000 dollar insurance, I am not happy about their trying to dump the problem on the owener.

    Our 2015 Tucson has no leaks and no signs of excessive smoking and mysteriously consumed 1 quart or oil every 500 miles. This started around 99k miles. Had been a great vehicle up until now…

    Change.

    My 2016 with 63,000 miles has a flickering oil light my mechanic told just told me about this known issue. How do I get added to this lawsuit.
