Honda Civic class action lawsuit

Angry Honda owners have filed another class action lawsuit against the automaker, this time over allegations the company manufactured and sold vehicles with defective window mechanisms that cause the windows to drop into the door frame without warning and break or become permanently stuck in the fully-open position.

Plaintiff Phyllis Grodzitsky of San Diego claims in the Honda class action lawsuit that the right passenger side window fell into the door of her 2002 Honda Odyssey LX in September 2011.

“It was a startling, loud sound that jolted me. I lost use of my Odyssey for two days and it cost over $400 to fix the window,” she says. Grodzitsky says she made a complaint to Honda but was told there is no recall for the window systems in her vehicle.

The other Plaintiff in the Honda window class action lawsuit, Jeremy Bordelon of Tennessee, claims he’s had to repeatedly pay to fix the problem.

“Had I known I would be faced with serial replacements of a substandard part, I would not have bought a Honda Element. Both of our windows failed during normal driving — one failed when we were at a complete stop, in fact! I have had to pay to fix my Element twice and am concerned that I will have to keep fixing it. That’s not what I would want from any car, much less one from a brand that sells itself on its quality and reliability,” Bordelon said.

The Honda window class action lawsuit claims the defect poses a hazard to drivers and passengers nationwide, and affects not just the Honda Odyssey, but also the Pilot, Element, Accord, CR-V, Civic and Acura MDX models from model years 1994 to 2007.

The alleged Honda window defect is caused by a defective piece of plastic that is meant to keep the windows in place while the window motor operates. The class action lawsuit claims the piece of plastic breaks under normal operating conditions, causing the defect Grodzitsky, Bordelon and other Honda owners have complained about.

The class action lawsuit further alleges that Honda knew that the fix it made available to consumers — replacing the failed part with a new part of the same defective design — results in repeated window regulator failures on the same vehicle, and yet Honda failed to reimburse Honda owners for the costs of repeatedly replacing the failed window regulators. Further, the complaint charges that Honda has failed to provide a permanent remedy to the window regulator defect.

The proposed Honda window defect class action lawsuit is brought on behalf of all persons nationwide who purchased or leased certain 1994 through 2007 Honda vehicles that are equipped with the allegedly defective window regulators.

The Honda Power Window Defect Class Action Lawsuit case is Phyllis Grodzitsky et al. v. American Honda Motor Co. Inc., Case No. 12-cv-1142, in the U.S. District Court for the Central District of California.

    I have a 2008 Honda Pilot, this just happened to me yesterday. I was driving down the road and heard a loud sound. I thought something had run into the side of my suv! I think Honda should have to fix this. It has happened to far to many people.

    I have a 2008 Honda Pilot that has had 2 of these window failures. Honda should pay for these failures. I have less than 80,000 miles. I am shopping for a new car and want a Honda but this has left a bad taste in my mouth.

    I have a honda pilot and the same thing happened back
    passenger window went down and now I have to find someone
    to fix it. I am 84 and a widow on a fixed income. Mine is a 2004
    but it only has 55,000 miles on it because I had another car I
    drove most of the time. I live in Schertz, Tx right outside of
    San Antonio any idea about a resonable place to have it fixed

    I have a 2003 Honda Accord was driving last night heard a loud noise on the drives side and the window went down and will not go back up! How and what happened? You has to have this fixed? Me or Honda?

    We have replaced the window regulators FIVE times on four different windows on our 2008 Honda Pilot. I loved this vehicle until this defective window hell began five years ago. Honda doesnt seem to care enough to fix the defective part. I will not be buying another Honda.

    sitting in my PILOT on my lunch listening to my radio and POW A loud noise left side window had fallen no body sitts in the back um why would a window just fall?

      Charles, Ours just did the same exact thing. What year is your Pilot? Ours is a 2008.

    Why is it that there still has been no action on the regulators for the Honda Element? I was driving on the freeway and there was a loud bang. Scared me to death and just missed having a horrible accident. I have since read about so many problems with the regulators. It just does not seem right!,,

        I have a 2008 pilot and replaced right rear mechanism and 2 days later the left rear dropped.

      I am now replacing mine for the 4th time!!! I came outside to leave and my window was inside my door. The last time this happened I was on the freeway!

    Bought a used 2005 Honda Pilot have had it less then two years. I have had to fix my windows (not the same one) , at least five times. I am so disgusted and frustrated. Its not a cheap fix.

    We have a 2003 Honda Accord Coupe and the drivers side window has been locked in the up position for well over a year. Honda should definately fix it for free and for good. It would go a long ways towards helping us to decide if we ever want to buy a Honda again. They should do it because it is the right thing to do.

    I bought the pilot from Honda 2007 new. My logic was that Honda was reputable, and honest and the most important safe. I drive my young grandchildren around everyday to and from school. Now for the 2nd time repairs have to be made to the window. I don’t understand why it would just fall down when the windows are never opened because we live in Florida and the air conditioning is always on. We are stuck with the car because we are now retired and on a fixed income. We had hoped that this pilot would not have to be replaced till after we were gone. We also do not drive very often so we have low mileage.
