A federal judge has apHonda class action lawsuitproved a class action lawsuit settlement for current and former owners and lessees of more than 1 million Honda Odyssey, CR-V and Acura TSX cars that allegedly suffered from broken air conditioning systems that manufacturers refused to fix under warranty.

The Honda air conditioning settlement will resolve a class action lawsuit, entitled Alin v. American Honda Motor Company, Inc., that alleges certain Honda Odyssey, Honda CR-V and Acura TSX vehicles contain problems with the air conditioning condensers or compressors. The lawsuit alleges that the Odyssey is unduly prone to damage to the condenser from road debris, and that the CR-V and TSX suffer excessive failures of compressors.

Honda denies these allegations, but has agreed to a nearly $40 million class action lawsuit settlement to resolve the litigation.

Class Members of the Honda air condenser/compressor class action settlement include all persons who purchased or leased (including initial and subsequent owners and lessees) a 2005-2007 Honda Odyssey, 2002-2004 Honda CR-V, or 2004 Acura TSX.

As a Class Member, you can receive one of the following benefits from the Honda air conditioning class action lawsuit settlement:

Odyssey Sub-Class: Odyssey Settlement Members may receive 100% reimbursement of out-of-pocket expenses made to repair “Condenser Road Debris Damage,” where the repairs were or are performed within the original 3-year/36,000 mile warranty period. This damage is defined as damage to the condenser that was caused as a result of rocks, pebbles or other road debris striking the condenser.

Honda will also make available a screen that will protect the air conditioning condenser in Class Members’ Odyssey from road debris damage. Honda will reimburse Odyssey Sub-Class Members for the purchase price of the screen (up to $35.06) as well as reimburse $20 of the labor costs associated with installing the screen if it is purchased and professionally installed on an Odyssey Sub-Class Vehicle.

CR-V Sub-Class:  CR-V Settlement Members may receive reimbursement of out-of-pocket expenses they incurred within 8 years/96,000 miles from the date of purchase for “Compressor Damage,” which is defined as damage to the compressor and associated air conditioning system parts as a result of the failure of the internal components of the compressor and/or the compressor clutch.

Reimbursement of out-of-pocket expenses will be based on the following scale:

1) Year 3/36,000 miles: 100% reimbursement

2) Year 4/48,000 miles: 80% reimbursement

3) Year 5/60,000 miles: 60% reimbursement

4) Year 6/72,000 miles: 30% reimbursement

5) Year 7/84,000 miles: 15% reimbursement

6) Year 8/96,000 miles: 15% reimbursement

TSX Sub-Class: TSX Settlement Members may receive reimbursement of out-of-pocket expenses incurred within 8 years/96,000 miles from the date of purchase for “Compressor Damage,” which is defined as damage to the compressor and associated air conditioning system parts as a result of the failure of the internal components of the compressor and/or the compressor clutch.

Reimbursement of out-of-pocket expenses will be based on the following scale:

1) Year 4/50,000 miles: 100% reimbursement

2) Year 5/60,000 miles: 60% reimbursement

3) Year 6/72,000 miles: 30% reimbursement

4) Year 7/72,000 miles: 15% reimbursement

5) Year 8/96,000 miles: 15% reimbursement

How to make a claim under the class action lawsuit settlement:

To receive any of these settlement benefits, you must file a claim form and submit any supporting documents showing proof of repair and cost to the Alin Litigation Settlement Administrator postmarked 90 days from the Effective Date. The Effective Date has not been announced yet, but the earliest the claim deadline would be is July 24, 2012.

    I have a 2012 Honda Civic as well. I just returned from the dealership and was told by the service tech that it was a rock that damaged the air compressor. I do not really believe that!! My car only has 25,000 miles and I only drive to work and back. I don’t drive on any gravel roads. I was charged a 140.00 diagnostic fee since the warranty didn’t cover. I am taking car to an independent mechanic that I trust. I am furious as well. I also asked mechanic to check the tire pressure since my “check tire pressure” light keeps coming on. He replied “oh it just does that”. I told him to just check it please. When I picked up the car, the light was still on.

      Not sure if anyone will read this but my 2016 Honda Accord EX-L was damaged by a quote ROCK that went through the front end of my car and punched a hole in the compressor. I have 2.300 miles on the car and before they opened the hood they told me that could be whats wrong. Did not even open the hood and told me what was wrong then wanted to charge $723 to fix it. What a shame. I have bought three brand new vehicles from Honda, ranging from $28k to $36k and this is what happens, horrible.

        Sounds very similar to what happened when I took my 2015 Odyssey to be checked out. My AC did not cool and feel the way AC should feel in a 2015 vehicle. I purchased it used with about 17,500 miles. Took it in at approximately 24,000 miles – still under the 6-month/7,500 mile warranty the dealership said I had when I purchased the vehicle. Before the dealership even enters me into the system for record keeping, a mechanic comes out with his thermometer, runs the AC, and confirms my suspicions that the system isnt cooling as it should. I ask if this was something they could address and if it was covered under my warranty, since its under the 6 month/7,500 mile restrictions. The mechanic and the customer relations person both continue to tell me that its NOT covered because the likelihood is that a pebble or rock must have made a hole in my condensor, and so its not their responsibility to cover things like this – they compared it to my windshield being broken after I purchased the vehicle. They suggested that I take it to my automobile insurance carrier, and see if theyd cover it under road hazard damage. I ask, what if it wasnt a rock or pebble that caused the issue, what if its something else, and they tell me that its probably a rock because my vehicle is too new to have any other issues, and so without even opening the hood, theyve made their assessment. They also said that if I wanted them to actually lift the hood and check, it would cost me $255 and another $405 to fix it. So…..I have to pay for them to check on what the problem could be, even if I have a warranty and the problem could be something I didnt cause????? Something doesnt sound right about this. And it was interesting that they didnt enter this and the other issues I brought to them into their system of record…no paper trail of my concerns, I guess. Im so disappointed.

    Unbelivable! I am at the dealership now and everyone here with CRVs has failed air conditioners. I have (2) 2004 Honda CRVs , one air conditioner went out last summer the other broke this summer one our cross.country trip. Boy did we suffer. Shame on you Honda! We loved all our past Hondas, what went wrong? That 15% compensation is nothing!!!! You should hear how almost everyone here will NOT buy another Honda. I know it is no big whoop to you folks, but if you continue to build crappy cars it will impact your sales.

    I Will never buy another Honda. They know there is a problem and refuse to take responsibility. If you went to the dealer and they quote you a price that was so high you could not afford to let them fix the air compressor so you let someone else fix it and the same problem has happened again. Honda knows that there is a problem but because they couldn’t STEAL more money from you by allowing them to fix the compressor. Now they want fix the problem they no they have(it does not matter who I let fix it) YOU KNOW THERE IS A PROBLEM. NO MORE HONDAS FOR ME. EVEN IF YOU GAVE ME ONE. PISSED!!!!!

    I currently own a 2001 Honda CR-V and last month on the hottest day of this summer it stopped working! So I scheduled and waited for over a week to have Lester Raines Honda, South Charleston,WV to inspect and give me an estimate for repairs to the A/C. What I wasn’t prepared to receive was an estimate of 1,5000 to possibility 3,0000 Dollars to repair the A/C!!! So I contacted American Honda customer service AND was offered NO customer goodwill assistance at all!!! I have owned four Honda’s over the past twenty years and have NEVER had any mechanical failures! So until I contacted by America Honda to resolve this issue, I will NOT even consider OR reccomend a HONDA PRODUCT!!

    Hello, I received a notice in the mail last Fall referencing the class action lawsuit against Honda for failed condensors. I had to purchase a new condensor in the summer of 2006 for my 2002 Honda CRV. I mailed the invoice of the labor and the total cost to the address listed on the notice as instructed for the purpose of reimbursement. I haven’t heard anything since. I would like to find out if or when am I supposed to receive any compensation for the out-of-pockets expenses I incurred for the new condensor I had to replace. Thank-you.

      I have a 2004 CR-V and my A/C has died. It will cost approx
      $1,500.00 to repair!! Now I’ve become aware that this is not
      an unusual problem. In 2012 a settlement was paid out, with Honda admitting nothing! So can someone please tell me what I and others who will experience this problem can do?

        Do like I have decided to do since Honda has become a shit hole company and refuses to take responsibility for the crap it puts in the marketplace these days…buy from a different manufacturer in the future and by this maneuver you will be sending the deserved message to Honda of FU, too.

    Hello, Are Honda Civics included in this class action lawsuit? I have a 2012 Civic and I brought it into the dealer ship to have them check the air conditioning and was told the only reason the air conditioning would not work in a 2012 is if the condensor was damaged by a stone putting a ding in it, and that Honda did not cover that. I was furious stating my car is only 8 months old,

        I have a 2011 Civic. Have just done extensive work despite the vehicle having just over 50K miles. Interested to know if a class action settlement becomes a reality.

          I haver a 2011 Honda Odyssey that it’s happening too. Started last year and Princeton Honda told me I was low on freon. Spent money to have freon put in and it happened again this Summer. Told me the repair was not covered under my warranty. Now going to my trusty mechanic to see what he says but in mean time, how do we get in on this settlement?

        Hello I have 2003 crv I have this air conditioning problem since 2010 and I keep fix it and now getting is bad agine I call the dealership they say there no recall for air conditioning and the driver side control door can you help me here
