A Home Depot personal injury claim has been filed in the Supreme Court for the State of New York, Orange County, against the home improvement giant.
In the Home Depot personal injury claim, plaintiff Adam S. alleges that he sustained injuries with grievous and long-term consequences on June 8, 2016 at the Home Depot store located in Monroe, N.Y.
On that day, according to the Home Depot personal injury claim, Adam says he was shopping in the store and was visiting the aisle where ceramic tile was located when ceramic tile fell and hit him from where it was placed five feet above him on a shelf.
In Adam’s Home Depot personal injury claim, he indicates that the tile caused injuries that could’ve easily been prevented if the management of the store had been attentive to all potentially hazardous conditions on the premises. He claims the way they stocked the ceramic tile reflected negligence and recklessness on the part of the warehouse’s employees and agents.
Additionally, Adam states in his Home Depot personal injury claim that he believes the placement of the ceramic tile had been so situated for quite some time. In his assessment, management could have corrected this situation with a reasonable amount of care, concern, and foresight.
Because this reasonable care was not demonstrated by management or expected of employees, Adam claims he was hurt by the falling ceramic tile and has experienced disabling pain of a lasting and likely permanent nature, disfigurement, and lost functionality of certain parts of his body.
He has, according the narrative in his Home Depot personal injury claim, spent a great deal of money attempting to find curative and palliative medical care for his injuries.
While pursuing this care, Adam alleges that he has suffered the loss of income he could’ve been earning. He doesn’t envision this to change in the near future, as he still is in need of medical attention on an ongoing basis which stands in the way of performing his normal job duties.
Adam believes he has been damaged by this accident in such a way that he is deserving and needful of a compensatory award that exceeds the jurisdictional limits of courts lower that New York Supreme Court.
