Daily deal site Groupon, Inc. will reach a class action lawsuit settlement by March 12 that will resolve a group of consolidated class action lawsuits alleging the expiration dates on its coupons are illegal.
The announcement was made in a February 13 filing in San Diego federal court by lawyers for Groupon and the Plaintiffs stating that they have resolved disagreements about the class action settlement terms and anticipate filing settlement documents for the judge’s approval next month. The terms of the Groupon class action settlement were not disclosed.
The Groupon settlement will resolve 17 class action lawsuits against Groupon that were consolidated in San Diego federal court. The Plaintiffs claim in the consolidated Groupon class action lawsuit that Groupon and various retailers it works with violated federal and state consumer protection laws by placing improper expiration dates and other provisions on Groupon vouchers, such as the requirement that they be used in a single transaction.
“Groupon effectively creates a sense of urgency among consumers to quickly purchase ‘Groupon’ gift certificates by offering ‘daily deals’ for a short amount of time,” the class action lawsuit states. “Consumers therefore feel pressured and are rushed into buying the gift certificates and unwittingly become subject to the onerous sales conditions.”
