General MotorsA class action lawsuit filed against General Motors alleges that 2010 through 2013 vehicles with “Generation IV 5.3 Liter V8 Vortec 5300 engines” are defective. The complaint asserts that “the piston rings, PVC system, and Active Fuel Management (‘AFM’) System used in the Class Vehicle’s engines were defective causing excessive oil consumption, premature spark plug degradation, and engine malfunction.”

Vehicles covered by the complaint include 2010-2013 models of the:

  • Chevrolet Avalanche,
  • Chevrolet Express 1500,
  • Chevrolet Silverado 1500,
  • Chevrolet Suburban,
  • Chevrolet Tahoe,
  • Chevrolet Colorado,
  • GMC Yukon,
  • GMC Yukon XL,
  • GMC Sierra 1500,
  • GMC Savana 1500, and the
  • GMC Canyon.

The GM oil consumption class action lawsuit states that oil is necessary for a car engine, but can be disastrous if it gets inside the combustion cylinder. The complaint notes that auto manufacturers use several items, including “valve guide seals and piston rings” to keep this from happening. According to the complaint, that is because if the seals fail, “it results in a loss of lubrication throughout the engine which, in addition to destroying the engine, may cause loss of power during acceleration, white or other colored smoke to be emitted from the exhaust, and the vehicle entering a ‘safe mode’ where the engine may suddenly shut-off or run improperly until the issue can be addressed by a mechanic.”

This is exactly what happens to the defective General Motors automobiles, the class action contends. The complaint asserts that first, defective piston rings allow oil to enter the engine’s combustion chamber, where it should not be. Second, the PCV system is in a defective location, also allowing oil into the combustion chambers. And third, a defect in the AFM system allows oil to gather in cylinders when they are not in use. The class action claims that these problems were made even worse by GM’s “oil life monitoring system,” which supposedly tracks oil consumption and tells drivers when they need to get a car’s oil changed.

Plaintiff Bradley Zierke states that he bought a new 2012 Chevrolet Avalanche. Zierke claims that he has to put oil into his vehicle every 1,000 to 1,500 miles, has had to replace spark plugs three times, and after only 87,000 miles he had to replace the entire engine. The complaint asserts that Zierke would not have purchased the truck had he known the truth about the oil defect.

Affected vehicles include the 2010-2013 models of the Chevrolet Avalanche, Express 1500, Silverado 1500, Suburban, Tahoe, and Colorado, and the GMC Yukon, Yukon XL, Sierra 1500, Savana 1500, and the Canyon.

The class action alleges that GM knew of these defects, and corrected the issues for 2014 model vehicles. The complaint notes that General Motors issued “at least seven Technical Service Bulletins from 2010-2013 to address Class Vehicles’ excessive oil consumption.” The class action asserts that despite this knowledge, and that the engine defects should have been covered by GM’s warranty, the auto manufacturer has failed to issue a recall or otherwise address consumers’ concerns.

The oil consumption defect lawsuit requests certification of a class of all people in the US who either currently own or lease a General Motors vehicle affected by the oil defect, or previously owned or leased such a vehicle and had to pay for extra maintenance or repairs. The class seeks restitution and damages, as well as an injunction stopping the unlawful conduct by GM.

    I own a 2013 Silverado ltz 5.3l 4×4. Which has sat in driveway way longer than I have been able to drive it. First the transmission went out. Shortly after the afm misfired on all afm cylinders. I own vehicle outright. Checking to see if I make the list.

      Though I purchased my 2012 suburban used, I had no idea of oil consumption,or electrical issues plaguing this truck. And certainly would not have bought it if I’d known

    I have a 2012 Chevy suburban and was just told it needs a new engine. Routine maintenance has always been done on it. I haven’t had a problem with it until all of the lights went off and it started “rocking” while running. Was told it was the o-rings, pistons, and a knocking in the engine. A $15,000 new engine is not in my budget right now. I’d love to join the class action lawsuit.

      2010 cheverolet silverado 1500 5.3L lc9 v8. It started with oil being put in it consistently to fouling out spark plug after spark plug to now need new motor mechanic said. Live in arkansas is there a class action lawsuit I can join

    I have a 2013 Chevy Silverado 5.3 1500 that I had purchased 2 years ago with a 2-year extended warranty that is elapsed and now I’m having critical issues with my engine. They have found metal shavings and there is a chirping sound coming up from the bottom of my engine. I don’t know about any of these problems I would not have purchased this vehicle but yet sought out to find a more newer model of this truck. Could somebody please get back to me if there’s anything that can be done regarding my issues with my truck.

    2010 Silverado replaced all spark plugs and coils including injectors still cant drive truck because of afm failure. Told I need to replace motor or replace the afm system with non afm delet kit.

    I have a 2010 GMC Yukon Denali. We have replaced the spark plugs last October and the number 2 coil pack. Then it wouldn’t stay running replaced the oil pressure switch. Then had to turn it into the mechanic because the oil pressure light kept going down. The mechanic said after having it a month that it was bad gas and was good. Then last month the stabilization came on every so often and the check engine light came on. The oil we were putting about 2 quarts of oil in it every few days. Then the mechanic that is down the street inspected it and says that the number 2 and number 5 coil packs has caused the rings to deteriorate and the engine now has to be replaced. I have been renting a car for 3 weeks and for my husband and I we are still paying on the car. We need this fixed. We don’t have the extra money to fix this problem. Please help.

    I have a 2013 Chevy Avalanche black Diamond! It has 123000 miles and have had no problem till the last oil change and the it started knocking a little and took it in to have it looked at and they told me that my oil was 1 qt low and it had just been change two weeks earlier. So they put in a qt . In one week it starts knocking very loud! So my husband got under it and oil was on the engine! So I call the shop and he said bring it in so I went to start it and the engine light came on and said low oil turn engine off ! So we tow it to the shop and the mechanic thought it was the oil pump . He check the oil and it was a qt low again. When he started on it he call me and said it not the oil pump it the motor….he had pull the plug to drain the oil and he said it looked like peanut butter and had gold shaving in it ! So I have to put a new motor it !!! I love my Avalanche.. but this shouldn’t of happened with the motor we change it every 5000 miles had no problems and all of a sudden the engine Blown.

    I have a 2013 suburban and a 2012 Sierra 1500 5.3l V8’s that burns 2-3 quarts of oil between oil changes. The suburban has a god awful tick to it. Love my vehicles but these motors are horrible. Saving up the money to get a AFM/DOD delete on both. The mechanic said it is a matter of time.
