A California man is filing legal action against Unum Life Insurance Company after the disability insurance provider allegedly denied his claim for benefits. According to the Unum claim denial lawsuit, this man met all eligibility requirements for long term and short term disability coverage but the company still denied his claim. He is now asking the court to review and grand his previously denied claim for benefits.
Plaintiff Daniel L. was previously fully employed by Fujistu since 1984, with his division later being acquired by Socionext on March 01, 2015. When his division was acquired by Socionext, he held the title as Marketing Director. In this role, he was responsible for the company’s revenue stream.
Under both Fujitsu and Socionext, Daniel was provided insurance policies that were supposed to provide short-term and long-term disability coverage.
Overview of Unum Claim Denial Lawsuit
Prior to June 21, 2015, Daniel was in good health and performed his occupational duties without problem. However, on that day, Daniel was reportedly struck over the head with a blunt object during a mugging that occurred in San Francisco. He was reportedly waiting for his bus after a trip to the grocery store and was then attacked.
Due to the head injury, Daniel reportedly developed problems in concentration and work performance. He claims he was unable to respond to questions, made mistakes during meetings, had trouble with calculations, and became forgetful. After seeing his doctor in the fall of 2015, he was initially diagnosed with anxiety and depression because Daniel forgot to mention his head injury during the meeting.
After it was suggested he take time off work, Daniel applied for short term benefits from Unum and was approved for a designated disability coverage period. However, when Daniel mentioned his head injury during an appointment on March 11, 2016, his doctor became worried he may have suffered traumatic brain injury.
Daniel then applied for long term benefits, to which Unum reportedly denied claim for benefits on April 12, 2016. According to the Unum claim denial letter, Daniel’s claim lacked sufficient information regarding his condition and his claim lacked medical evidence to justfiy his claim for long term disability benefits.
After the Unum denied claim for benefits, Daniel met with a neurologist who determined the head injury may be causing his concentration and memory problems. Daniel filed an appeal with Unum in a timely manner and submitted additional medical testimony that further indicated the severity of his condition.
Even with additional medical testimony, Unum still denied the claim for benefits. Daniel says that denial has further worsened his situation. Daniel’s physicians provided testimony in each of his claims, urging the insurance company to give the much needed insurance coverage.
Ever since his head injury, Daniel has reportedly been unable to work in a similar occupation and has not been able to earn a sufficient income. At this point in time, Daniel has exhausted all administrative options and has been forced to resort to legal action to retrieve his benefits.
Daniel is filing this Unum claim denial lawsuit alleging the company wrongfully denied claim for benefits and is seeking damages for all missed payments.
