Ford Emissions Warranty Class Action Lawsuit Overview: 

  • Who: Ernie Miramontes filed a class action lawsuit against Ford Motor Company, Inc.
  • Why: Miramontes claims Ford fails to properly identify parts that should be covered under its 7-year and 70,000 miles emissions warranty.
  • Where: The class action lawsuit was filed in California federal court.

Ford Motor Company fails to accurately identify the car parts that can be covered under its emissions warranty, a new class action lawsuit alleges. 

Plaintiff Ernie Miramontes claims Ford seeks to minimize its 7-year and 70,000-mile warranty exposure by not properly identifying “high-cost emissions warranty parts” as required by the state of California. 

“By not comprehensively identifying the parts that should be included as “high-cost” warranty parts, Ford is able to limit the warranty coverage for those parts, thus saving money,” the class action lawsuit states.

Miramontes wants to represent a California class of Ford vehicle owners or lessees who had to pay for repairs to parts that should have been covered under Ford’s emissions warranty. 

Cracked Cylinder Head Not Covered By Warranty

Miramontes says he had to pay for repairs to his vehicle after it was diagnosed as having a cracked cylinder head and a scored wall. 

“The defects relating to the cylinder head and the scored cylinder wall at cylinder No. 3 should have been covered under the high-priced California emissions warranty,” the class action lawsuit states.

Ford’s refusal to provide coverage for Miramontes’ vehicle was part of its broader scheme to not repair defects that should be covered but aren’t properly identified by the company, the lawsuit alleges. 

“If Ford complied with California law and properly identified all parts as high-priced warranted parts that should be identified as such, then Ford dealerships would properly provide warranty coverage for said high-priced warranted parts,” the class action lawsuit states. 

Miramontes claims Ford is guilty of unfair and deceptive prong and in violation of California’s Unfair Competition Law and Consumers Legal Remedies Act

Plaintiff is demanding a jury trial and requesting compensatory, exemplary and statutory damages for himself and all class members. 

Last month, Ford announced it was recalling almost 250,000 of its F-150 pickup trucks and its Transit cargo van over a possible noise insulator issue.
